What if I added the terms on the actual government trademark register of approved class words. I'm registering a UK trademark that has about 7 different classes which has some product classes and service classes

Yes, using the wording from the preapproved list reduces the risks.

At 6:40 you talk about reponding to office actions and being a US citizen. Do you need a US attourney to respond to office actions if you used the madrid protocol i.e. filed my own Canadian application and want to use Madrid for USA application.
@trademarkfactory4 жыл бұрын
Yes you do. Check out the official document from the USPTO that clarifies it: www.wipo.int/edocs/madrdocs/en/2019/madrid_2019_52.pdf In other words, while you do not need a U.S. attorney to FILE a Madrid application that designates the U.S. as one of the countries, you do need one if there is a provisional refusal (office action), opposition, or if you need to file the maintenance statement of use. Hope this helps.

What do you think the odds are of a successful appeal to a rejection of a trademark application [hypothetical example]: "Gather Together" (which was rejected) because there is an existing trademark of "Americans Gather Together". Could this be successfully appealed?
@trademarkfactory Жыл бұрын
Intellectual property, and trademarks in particular, are very fact specific, so hypothetical examples may not be overly useful. In your case, I would give it maybe a 20% chance (because you'd have an argument that in Americans Gather Together is a weak trademark where "gather" describes a state of things whereas in your 2-word phrase "gather" acts as a command. Either way, it would be an uphill climb and we would not be recommending our clients to move forward with such a trademark.
