You would be correct if one party were suing the other for rent owed while squatting (neither party has the right to collect rent in a dwelling they illegally occupy). Here, the plaintiff is suing the defendant because she was "scammed" by her even though it's clear they both knew they were in the wrong. Thus, this isn't the plaintiff looking to have the court enforce an illegal act, but to have the court un-do what she tried to paint as a scam. JM clearly picked up on this and therefore did not allow recovery for funds the plantiff willingly gave in a situation she knew was illegal.

That HOA is as shady as they come. They knew that the owner did not know that people were in the house and did nothing to notify the owner. They must have also known that the owner would not be coming around for quite awhile or the owner would have seen for themselves that there were strangers in the house. Edit to add: what happened to coming to court with "clean hands", this should have been thrown out asap. Very disappointed in the Judge ruling on this case. How could they start the electricity in their own names when they are squatters. These idiots think paying the HOA fines is paying rent. Something is definitely off. Where is the owner? No way the Plaintiff or Defendant contacted the owner and the owner simply said "send me the HOA bills" and "you are the manager"(Plaintiff). How about GET OUT of my house, I have no idea who you are?!? PURE SQUATTING, the only one with grounds for a lawsuit is the homeowner, WHO IS NOT SOME GUY IN CHINA.

I see this a lot as a real estate agent. Owner has to leave the country and there are people who know this. That’s how they have access/keys. HOA can’t find the home owners and HOA fees aren’t getting paid. Usually results in default/litigation. An agent that I know has literally became the management “company” for home owners who had to go back to China. She’s just an honest agent and hasn’t scammed anybody that I know of. LOL!

Oh my goodness. In 2017 I was being evicted by my brother-in-law after my husband passed, his brother. Never late or did not pay rent. He told me he sold it because he was moving. He did not and rented it for triple the rent to someone else. Okay that's life. Was desperately looking for a home for me and my pets. Found one on Craig's list that was too good to be true. Luckily to good to be true raised some red flags and I researched on line. He did not own the property. I was mad after what I had been through I messed with him for days about going to Walmart to pay him. He had to wait for days at Walmart for me to send the money to Florida. I was more upset at my husband's family than the scammer. Cut them out of my life. That greedy guy can help himself to happiness after promising I would always have my home after my husband died. But messing with the scammer made me feel a little pay back.

Judges do feel and that’s why the Supreme Court is not about law but which political party has the majority in the Supreme Court. It’s unfortunate they judge on beliefs and not the constitution. They have overturned some rulings but not overturned other rulings that were the same legal precedent.

I am curious as to why either of them received anything since they are both coming into court with "dirty hands". Judge determines Plaintiff gave the monies to Defendant willingly and then both the Plaintiff and Defendant became squatters, so whatever they lose, they lose, they were there illegally. How does the Plaintiff get to win anything at all, especially with no receipts or proof.
