And there’s so much rote that he has to do, like all those questions if someone pleads guilty. But when he hears an answer that’s not normal - “knowing this may affect your probation, do you still want to plead guilty?” - he immediately comes out of the rote and questions more carefully to ensure the defendant’s rights are being adequately served, and that the guy is not accidentally getting himself in an even word situation than he’s already in.

I have watched Stormie McGee on several other occasions with Judge Simpson and it has ALWAYS been the same. She is lacking the info or hasn’t got the info and is rarely ever prepared for court….especially compared to the other attorneys. Judge Simpson has exercised extreme patience with her on other occasions. Judge Simpson has repeatedly requested her to talk to the client in advance. I don’t blame Judge Simpson in this case nor would I want Ms. McGee as an attorney. I am very surprised at how long Judge Simpson HAS been patient with her.

Ms. McGee seemed like she was having a rough day. From what it sounds like, Ms. McGee was covering the three defendants we saw for another attorney in the PD’s office. Of course attorneys should meet with their clients before court, but I do have sympathy for what seems to be a PD’s office that seems to be overwhelmed with cases. That said, Ms. McGee’s jab back at the judge about knowing how to do her job seemed very I’ll-advised. It’s most likely very fortunate for her that Judge Simpson was talking over her as she said it. If he heard her, I think he would’ve had some more very choice words for her at the least.

I understand the judge's frustration but, I wonder how many clients these public defenders are assigned to meet with and represent. It might not be a case of laziness or procrastination and more a case of them just being swamped with too many clients. I know a lot of public defenders complain about this issue a lot. Most of them say they take a plea on 99% of their cases because they simply don't have the time to take any of them to court. That's why when I got in trouble- many years ago- I refused the public defender and hired an attorney. The pd told me my best bet, only choice really- was to take the plea deal which was 1 year in drug court, 1-2 years on supervised probation, and 60 days in county jail. Otherwise, he said it would go to trial and I would do up to 5 years in prison. I went and talked to a real attorney- he said he could get all charges dropped- but it would cost 7,500 dollars. Went and got the man his money and viola- he made a deal with the DA that if I got in no trouble for the next year all charges would be dropped. Look at the difference between those two outcomes- all because I had money. If I hadn't of had the money to pay an attorney- I would've been screwed just like 99% of the guys who come through that court room. It's sad but true- you get what you pay for guys- even in the judicial system- especially in the judicial system. I was innocent of the charges they had against me to- not innocent mind you, just innocent of the charges they had against me- didn't matter, it still cost me 7500 bucks to get free of it. That's why they made the deal with my lawyer so quickly- once they looked at the case, they realized they didn't have anything on me really- I was just present at the scene when they busted someone else basically. The DA knew that, but he decided to charge me anyway and just rely on the probability that I couldn't pay for a real lawyer. And tbh with you, at any other time in my life I wouldn't have been able to- but I had just come into some money- luckily. So, I was able to basically pay my way out of a situation that in reality I should've been released from free of charges. I aint bitter about though- no sir, not me..... can't you tell?
@Cranberryopah Жыл бұрын
It seems like your second lawyer spoke with the DA and got your charge dismissed without a trial. Honest question: why couldn't your PD have had the same convo with the DA? Would it have been more work?
@stoneysdead689 Жыл бұрын
@@Cranberryopah I have no idea, all I know is that he refused to do anything but plead it out. His excuse to me was that this was the best course of action- which was obviously not true but- that's what he kept saying. Then I found out that this is what he had done with every case he had gotten- it's all he does. Like I said- or I think I talked about it anyway- he lives in public housing and is literally the town drunk. Every time I had seen him before becoming his "client" he had asked me for a cigarette. I had no idea he was the PD until I got in trouble. Imagine being introduced to your lawyer and realizing "This is the drunk guy from the projects that's always asking me for a cigarette."

I totally agree!! The question is are we providing adequate resources for the Public Defenders Office for this to occur? If the PD has had the opportunity to meet with their client do they have the time and energy to provide the best defence for their client? I'm a nurse; I can truly empathize with an overwhelmed PD. What SHOULD happen and what actually DOES happen are entirely different stories. The public really needs to be aware of the reality of these situations are. I know I never really thought about how will the PD's office is funded and how about their allocations of resources. I can see the haunting similarities of what happens when you are overwhelmed, understaffed, and overworked. It is literally a difference in life or death. It's easy to lay blame on the attorney who hasn't seen the client; it's much more difficult to look into (and correcting) a system that is preventing this from occurring

After watching all of these videos of people with public defenders, it really does seem like many of these public defenders couldn't care less about their clients. Im sure there are some decent ones out there, but there appears to be a lot more that barely do ANYTHING for their clients. It seems that you can only get justice if you have the money to pay for a lawyer.
@notrab132 жыл бұрын
I don’t get that impression at all when I watch Judge Middleton’s court. Almost every defense attorney you see in that call is appointed, and I have yet to see anything less than what I’d call admirable advocacy. From the Yancey sisters, Rhonda Ives, Johns Barnes and Bush, and our buddy Keith Stickley, I only see lawyers that care and try for their clients. St. Joseph county is obviously less busy than Detroit or a Ann Arbor, though, so their appointed counselors are most likely much less overwhelmed with cases.
@aprilleerose2 жыл бұрын
@@notrab13 I also see very caring and engaged public defenders too when I watch court online. I don’t know how true that is as a whole in the U.S. with public defenders. They have so many clients at any time, I have no idea how any of them keep up with everything.
@johnsilver80592 жыл бұрын
I don’t think they don’t care, but that in some areas they’re overwhelmed by the number of cases. If one is working 3 felony cases and 2 suspended license cases, more effort will be put into the felonies because the consequences for the client are more severe.
