You know this probably happens a hell of a lot more than we hear about when you consider that the average age of a American congressmen is in there mid-70s. That means they're all at the age of senility or beyond it. Every last one of them is probably lost or misplaced paperwork.

Listen I'm all for calling out the elderly members of the US government... but there's no need to exaggerate. It just makes your point lose validity when the actual average age of a US congressman in the House is 58.4, and senators 64.3. Not the mid-70s. Simple Google search is all it takes.

Frankly, Biden’s breeches show that the exit process from the Whitehouse in general isn’t good enough. Maybe it’s time to stop having their internal staff sort things out when they leave, and start having the records office staff do it instead.

Agreed the US has a corruption issue on both sides. Biden has made a mistake where trump was more deceptive. At least so far. Biden is still at fault but it's not to the same extreme as trump.

tbh, i support biden, but regardless of how the records were returned, he needs to be subjected to the same quality of investigation as trump, otherwise we're setting bad legal precedent; if someone's been found to have classified documents in their possession at a time/place where they shouldn't have them, they need to be subjected to rigorous investigation for the sake of the country, no matter what their political affiliation may be.

The real problem with what Trump did is not returning them when asked. Documents end up in the wrong place all the time, but they usually aren't prosecuted unless there's intent, which is why Trump keeping classified documents wasn't news until they actually raided his home. But because Trump's docents turned out to be a big deal, everyone's acting like Biden's documents are a big deal, either to be political or to appear non political.

@@matthewparker9276 indeed, and im not accusing biden of stealing anything or obstruction, because they have been nothing but forthcoming about the presence of the documents. this simply indicates that there arent tight enough controls on the location of classified information, and that what we really need is a bit of reform in how we allow powerful people to handle dangerous documents. however, in the interim, it feels prudent to treat these events with a similar level of scrutiny, to be equal in our application of justice, if nothing else.

He really should not be the Democratic candidate in 2024. He is a liability at this point and that should frankly be obvious to everyone. The Dems need to come up with a much stronger candidate that can adequately represent the future of the party and get voters motivated.

This report is biased. The legal code specifies that you cannot take and retain classified material in this way. Just having the material outside of a secure facility is a criminal offense. For TDLR to state that President Biden has no legal issue is factually incorrect.

as funny as it seems, this is a legitimate defense for a president. no one is above him in classification. This would only make his actions a violation of the records act, which carries no punishment.

There is a REASON why the president is the final authority on classification....because what if the president needs to negotiate with other countries? The US has a lot of classified secrets, particularly abroad. If the president is not the final authority, then his power in diplomacy is particularly meaningless. To be blunt, your words are a fantasy. Yes, there would need to be a paper trial to comply with the records act. However, there is no punishment for violating it, nor is trump being investigates for violating it. He's being investigated for violating the espionage act, which is different. What its going to come down to is, is the president considered acting in executive capacity when taking documents while moving out of the white house. If yes, then there is no violation here. If no though, then there might be an argument to say its espionage. However, the judiciary may be reluctant to decide that.

The weird thing is that this could work as a legal defense. There isn't really a standard process for declassifying documents. It is a stupid argument, but it could cut down the potential conviction to just mishandling documents labeled classified (which is still a crime even if they aren't actually classified anymore). Although, this would also end up creating a scenario where they have to release the documents since they are no longer classified.

So things to keep in mind. Criminal perspective : the criminal code in question is literally speaks to the willful retention of government documents. Classification doesn't really change the severity of this, just the amount willfulness of retention. Politically and financially: it's a bit of a headache. Mostly cause the more documents with classification the more investigations have to be done to mitigate any ways&means info. There is the risk of dog whistling to those who will never bother reading the legislation causing the oversight, but the more material issue really is the waste of money tasking agents with what should be unnecessary investigations and mitigations. Procedurally: DOJ should probably develop a process and team that is in charge of vetting all outgoing items from the White House and probably Congress too when an official's term ends...

This is a national security issue that needs to be addressed no one but the president or the record office should be allowed to sort these types of documents & every single member of congress who exists congress for the last time should be vetted so this doesn't continue to happen there clearly needs to be some reform on this front or else this issue will continue to happen which could put this country or our allies in danger depending on what the documents contain all In all this is simply unacceptable & a national embarrassment

Both should face the full extent of the law. We need to set the precedent that this behavior is illegal and then adjust the law to see that the National Archives are the ones handling the removal of documents when a president or vice president leaves office.

At least with Biden he's been more corpitve than trump. It's probably a headache dealing with him and his lawyers since ever since he left office It looks like he's been going off the deep end. Though it's not to say Biden is good either, like he was tearing into trump with how he was handling the classified documents( rightfully so in my opinion) when he had some to. Though it could be that he forgot( like he's the oldest president so far) which I hope a bit since I like him some what but also like what this guy said if more reports of this comes out then it's going to be hard to chalk this off as he forgot about them.

I really hope Biden does not run in 2024. Being better than Trump (or at least appearing better to the general electorate) is such an outrageously low bar, and Biden is the single Democrat I can think of that barely clears it in numerous areas. Literally any other Democratic senator or governor looks better than Biden right now.

Since Trump still hasn't been sentenced to anything for the assault on the Capitol, I don't think that Biden will be that much at risk (at least concerning the justice system).

That’s not to say that Trump will not get into trouble. Justice in the US is like molasses in general. It gets there eventually, but Lord is it slow getting there.

I mean you have a great point the average life expectancy of Americans is the mid-60s most congressman or in their mid-70s see Natalie and early onset dementia starts in the mid-to-late 60s. So the odds of almost every single solitary member of the upper house of Congress having some form of severe mental impairment due to age and still being an office is extremely likely.

Their staff is usually responsible for handling documents. In the case of Trump we know he ordered them to be seized.

5:50 this is where you lose me. It takes a fourth and fifth batch of documents for you to call his claims implausible? Not the second batch? Or the third? Or the fact that some were in a private safe in his garage next to his car? How are you going to pretend like Biden didn't "knowingly" have these documents? Just because he claims it, doesn't mean you should be reporting it as the truth and acting like his actions are any different than Trump's. It's a failure in your journalism, and your journalistic integrity.

He was Vice President for 8 years, and many of these documents could have been left over from over those 8 years. However, the President and his then team did a poor job indeed of keeping track of this stuff. That is, of course, is giving the President the benefit of the doubt. We will just have to see.

Well repblicans can literaly do anything in the house, but they will not get anything done in the senate. (and actually getting Harris into presidential seat might be BAD for republicans in long run...) Plus they would have to throw Trump under bus now... so... :D :D :D ITs not helping republicans that much.
