During the life time of parents they have given 25 cents of land to the daughter by a settlement deed which is stated as the property given as the share of the daughter and didn't taken any consideration. Later they expired and the balance property is about 75 cents. They have one daughter and one son. The daughter already received 25 cents as share during the life time of the parents. Want to know that what will be the share of the son and the daughter of the remaining property. Please advise

It is not permissible for either parent to give a gift only to one of their children, to the exclusion of their brothers and sisters, unless there is a Shar‘i justification for doing so.

This is mentioned in Al-Fatawa-Al-Kubra. Simply speaking if the gift is not returned to the father during his lifetime or if the father dies the remedy is to subtract the gifted share from the actual share of the daughter at the time of partition. So her actual share is 1/2, which is 50 cents. But in the presence of son (her brother ) will be inherited as a residuary. So she deserves a share which is half of the share of her brother.

Suppose your mother is living she will inherit 1/8 of the total share. If the total share is 100 cents then the mother will get 12.5 cents. So the balance is after the subtraction of 25 cents it is 62.5 cents of land. As per your law, the daughter is entitled to get a share which is equal to half a share of the brother. That means if the son will get 62.5 cents, then the daughter will get 31.25 cents. So she is eligible to get an additional share of 6.25 cents. Suppose your family consists of more members than you stated, then the shares will also differ.
