My driveway is a publicly accessible area and I'm telling you now, don't try and conduct any of your bullshit business there. My friends florist business that specialises in bridal flower arrangements is accessible to the public, but the sign on the front door says "Bridal Parties by Appointment Only" so unless you are getting married and have an appointment you won't be served and you will be asked to leave and if you don't you will be removed from his private establishment. One of my other mates has a "point that camera at me and I'll ram it down your throat" policy, most times he warns people with those exact words, but only once, I've lost count of how many times he has actually stomped some poor bastards phone to pieces, he firmly believes in his right not to be photographed/filmed without his permission but accepts that if he enters an establishment that has security cameras he is giving that establishment permission to film for security purposes only. You guys seem to forget the 9th amendment which states that no one’s Constitutional rights should be used to infringe upon the rights of another citizen.

What about the garbage collection contractors and waste management sites, do you really think they are public spaces where you can demand access because they are contracted to take the garbage away and dispose of it. Get real. The officer explained it quite clearly, this particular office is a contractor completing some work for the DMV in their own private premises with private employees and it is clearly indicated on the entrance door and this private operator only does some basic transactional stuff for the DMV, it doesn't store DMV data, make decisions or policy about how the DMV operates, all they do on this private premises is process some transactions it doesn't make them a public business.

It seems like the state government is trying to avoid transparency and accountability by farming out vital, mandatory services to third party providers. It should be spelled out in their contract that by accepting this agreement you now fall under the FOIA act that all government agencies must adhere to or forfeit the contract.

In Missouri there are private DMV offices that are given to political supporters of the government as a reward for supporting the governor and such. There are a few offices that are state owned. They are slightly cheaper too. Contract offices add a fee to transactions.

The private business asked the auditors to leave, they declared they weren't and had a right to be there so the private business called the police to have these trespassers removed, in the meantime the police arrived and begin their enquiries to see if a law had been broken. And the dickhead with the camera lied about them refusing service, they weren't refused service they were just asked to wait outside if they didn't want to wear masks, and considering how many were in the queues their turn hadn't come round. You guys seem to forget the 1st amendment is to stop the Congress from passing laws that infringe your rights whilst the 9th states that no one’s Constitutional rights should be used to infringe upon the rights of another citizen.

I'm trying to understand so the DMV is private company that collects taxpayer dollars for your tags and then they turn all that money over to the government and get nothing or are the employees getting paid by taxpayer dollars and therefore it is still open to the public

This is not an isolated incident the department of motor vehicles / department of licensing all across the nation are privately owned it’s not right because they’re taxpayer funded we should have full access to the public areas

Private entities contracted by the Government,makes them an extension of said Government. Therefore, unless the auditors are being disruptive, the argument that the private entities have the right to request anyone from the public to leave the premises on their request, does not apply in this case.

So when the government contracts Kinko's to print notices, annual reports or just stationery is Kinko's an extension of the government and therefore these frauditors can occupy a corner of the Kinko's shop and film? Lets say Kinko's only print the monthly reports for the Finance Department on the first of the month (for the previous months finances) but have the contract to do this for 3 years, are they an extension of the government for that entire 3 years or just the one day a month they actually print the reports - but it only takes them 4 hours to print, so is it just those 4 hours that they are an extension of the government. Your argument, logic and understanding of law are farcical.

@@josephconner3742 That wasn't a DMV, the cop showed the door and the private contractor's name, just like Kinko's printing stuff for the govt - no fkn difference. Ask your Lawyer friends and they'll set you straight, stop trying to interpret the law as a layman, it's more complicated than you think.

DMV IS a government agency, if they are located in a privately rented property they cannot assume it is private as an agency of government body. If they are contracted it's whole different matter you should contact a public representative to ensure government agency is not outsourced.

How can that cop know if that office can't do a public records request? Just made that up. I know no one asked me. But it seems one route would be to contact the state off of DMV and ask them what the are the expectations the public can expect from contracted DMVs? What can they do to serve us. Can they deny service to citizens without losing their contract?

If the DMV is a contractor of the government, the same laws apply. Their records are public records.

I see you guys ran into the same problem I did out Here in Washington state...I'm from Miami and couldn't believe it when I moved here and discovered that you get your tabs and license in the same Grocery Store that you get your wine booze cigarettes and lottery tickets from!! They call them sub agents and everyone is confused, Including employees. Half the people think it's a private business and half of the people think it's a government office, And the written legislation says it's half-and-half. @ BradLee Jones ...While I'm not a First Amendment auditor I did have the balls to go the Distance In October 2021 after having been trespassed the year before Because they would not honor my legitimate medical Mask exemption And the responding police didn't care to protect my Civil Rights Or charge them with disability discrimination. So I went back this year and recorded the entire incident which I walked away with a disorderly conduct charge That carries a potential fine of $1000 and 90 days in jail when I was the victim, Merely Standing Up for my rights speaking up for myself and pointing out that it's a DMV not a Grocery Store. However that has also led to discovery that the local courthouse And City Hall building are also not in compliance with Federal ADA regulations Concerning Public Access and reasonable accommodations For the disabled And have no desire to do so Since the court Cordinator is Married to the local police chief who just retired And is the acting ADA Cordinator for the courthouse with no Credentials or sympathy for The nature of the conditions of the people she's dealing with And supposed to be helping facilitate Paperwork/ records for Ongoing court cases! I filmed both of these entire incidents and would love anyone to help! My public offender has just asked for a competency hearing for me, i think, as a tactic Because I don't think he wants to face the issue which I would like to the court to address, Being the entire validity of the mask mandates Themselves which resulted in me Catching charges for redressing my Government at the Grocery Store DMV!! So if there are any civil-rights attorneys in the state of Washington I can make you a lot of money right now if you take my cases against many many local businesses, please help. Imagine if they weren't doing this now and waited another 10 years we'd have no rights. You'd get that lame ass excuse that's the way Its always been. We the people have always held the winning hand but those cards are useless if they make up there own rules to the game and you just go along with it but once you know the right way to play the game it's game over for them because your holding all the cards and now know how to you them you see. Just saying game as a reference not in the literal sense because our rights are and freedoms are not a game.

Doesn't matter if it's a private company. If they're contracting with the State, to perform a State function, which is a public service, and they're making a portion of their interior space publicly accessible for the purposes of performing that public service, then the same freedoms apply therein as would apply if it wasn't a private company.

Every single state contracts with private businesses. The child support office for example is a an executive branch 42 USC 654(3) "single and separate unit" (aka private business) that is under a 45 CFR 302.34 contract with courts, DA's, Attorney Generals, and law enforcement. They are literally a private debt collector that is contracted with the courts.
