The plaintiff says she moved into the defendant’s property because she seemed nice, but she turned out to be a nightmare. The plaintiff moved out because of the stress, but the defendant won’t return her security deposit. She’s suing for that money, and pain and suffering. The defendant says her property was immaculate and newly renovated, but the plaintiff destroyed it, so she kept the security deposit.

The thing is, the plaintiff wanted to drone on and on about irrelevant stuff instead of just answering the judge's questions. I'm sure that's what she means when she says she didn't get a chance to speak. I remember once on Judge Judy, a litigant was telling practically her whole life story, and Judge Judy shut her down and told her 'Just answer my questions.' The litigant said 'Well, I'd like to tell it in my own way', and Judge Judy said 'Well, you can't! JUST ANSWER MY QUESTIONS!' 🤣

Maybe that's how it works in America, but in Canada, if you own a house and rent it out to tenants ,,, it's still YOUR house, it belongs to you. Hereabouts you don't get to own property because you pay rent, you have to have what we call a mortgage to own property or buy it outright.

The lady was on section 8 trust that landlord was charging way more than $485. That $485 was after she received $1000 minimum from HUD. I believe the tenant told her about the leak just like she sent her a fix it list every month. That landlord was pissed because it was eating into her profits. Also, that landlord is double dipping because when a house is damaged section 8 will reimburse the landlord for any damage especially in Florida. 9x of 10 that house was in the hood.
@billmoran3219
@billmoran3219 Жыл бұрын
My friend has multiple properties in California and sec 8 never has reimbursed him for damaged property from bad tenants, they only pay him for the portion of rent that tenants can’t cover, plus they dictate to owner and tenants any contracts , up keep and eviction proceedings. He had to sue multiple people for rent and and damages. Sec 8 only covers rent at market value , meaning if area had homes renting at 2k a month sec 8 guarantees landlord portion of that 2k tenants can’t make, same for deposit. What tenants can pay is negotiating when they applied for assistance.

Landlord is lucky that she was able to get the lady out of property. My brother had a tenant who complained every time rent was due. He would send people over to fix items, (many that were her doing)and repair people wouldn’t want to come back because tenant was nasty and uncooperative . It was a small town with few resources and my brother was 3 hours away. He finally had to evict her because she tried suing him for a fall she had on a gravel driveway and she stopped paying rent. She lost her case for the fall , he won his case for eviction but she wouldn’t leave taking him to court again, he put house up for sale and court gave he 3 day notice ( this was 1 year after first eviction) to vacate and sheriff had to physically remove her. She left the place a mess and even took some appliances and broke things like toilet and sinks. He cut his losses and sold property at a loss but still hasn’t received a 10k settlement against her for rent and other costs.

@arthurvasey

I thought Section 8 paid the entire rent, with no money payable by the tenant - if a landlord takes a Section 8 tenant, whatever Section 8 determines is the maximum amount for that kind of property, they give the landlord is the most the landlord can have - they can’t coerce, force, strong arm or whatever tenants to make up any “shortfall” between the going rate set by Section 8 and the asking price set by the landlord - if the landlord wants $600 a month, but Section 8 assess it at $400 a month, they get the lower amount only - that’s how housing benefit used to be over here until Universal Credit took over - properties are also assessed for how many tenants can comfortably occupy the property - if they turn a family home into two dwellings, and it’s big enough to rent like that, they also have to install separate meters for each dwelling, if they don’t include utilities in the rent!

The judge was thorough and fair (as always). In these situations it's always about providing proof. The tennant claimed that while she was there she was always unhappy - people like her will be unhappy even if living in a mansion rent free with a butler and chef on call. The most extreme example of this is when guests on an ocean cruise complain that the elevator buttons haven't been wiped since it was last used because they can see finger prints - believe me - if there is reincarnation then they will come back as a one armed beggar in the worst neighborhood in the poorest city in the world

True, you can't rely on a tenant to change the air filters. In my last apartment, I HATED that the landlord would schedule maintenance every three months (once a season) to replace the air filters. It was annoying, but I appreciated it since I didn't have to replace it myself. In my apartments before that one, I was always responsible for replacing the filter myself, and sometimes you just forget to it. Good advice by the judge. The tenant seems to be somewhat of a bad dream, but not a total nightmare. The tenant caused a lot of problems, but at least she paid her rent on time. Neither of them were perfect, but I think the landlord probably should get out of the real estate business if she can't keep her cool around these type of tenants.

The housing authority should have a form that a section 8 tenant must sign stating that they cannot vacate the unit or home without paying all expenses and balances owed. The landlord signs the form stating that the home is in good standard and all balances have been met. Also, inspectors are sent out each year when it's time to renew. If there are issues in the home...the tenant has to report it yo section 8 and section 8 gives the landlord a certain amount of time to get it done. It's apart of the contract! The tenant should have reported her issues to her housing authority... Not sit and complain or be unhappy. Any damages made by the tenant is due by the tenant. Section 8 inspects the place before the tenant moves in and each time it's time to renew the lease. It's the tenant job to report any issues in between. I'm sure the tenant knows that. All section 8 tenants are not like this. I have a friend that wasn't on section 8 that tore up the landlord house. I told her it's a shame. Stop using section 8 to call out nasty people. I think JM got it right. Plaintiff was irritated with Defendant constantly “talking down” to her and saying it was ‘Plaintiff’s house’, which it was. But the homeowner has to step up and take responsibility for maintenance that tenants will likely not do. It just complicated things to expect tenants to do all of the homeowners duties. I’ve worked with landlords and property managers. If you are charging top dollar for rent, be prepared to step up and just take care of certain things because it is YOUR property. Of course, tenants who are just irresponsible and destructive deserve to be docked. Just do due diligence be careful who you rent to!

I wouldn't consider $445 a month top dollar to rent a house, but even if it is, it was in her lease to take care of the lawn & small repairs, but the homeowner still paid for the plumber when it was the tenant putting baby wipes down, the homeowner sent the hvac repairman when the tenant complained. So I think the homeowner was responsible.

Most Section 8 tenants do not take care of the properties they live in. Granted most of the properties are not the greatest looking and are owned by slum lords, when I start buying my properties, I won’t participate in that program. It’s not worth it.

Not true...most states enforce rules. A section 8 tenant can't vacate until all expenses are paid and the landlord must sign off that everything is in good standard in order to vacate the unit. Section 8 sends an inspector out to check the unit. It's weird that landlords are getting their homes destroyed. A landlord can also report that tenant to the housing authority and they will lose their voucher for not keeping up the unit.

The litigants argued and discussed the damages, and renovation costs, and the judgement was given based on what they said. The judgment was just and fair. I would say to the landlord - your probably going to get real criminals as tenants in the future- people move in their boyfriends, and many tenants refuse to leave without an eviction. The landlord is very fortunate that that did not occur in this situation.

This is what blows me, sections8 tend to pick the most disrespectful people to help. A lot of people I know who has sections8 are dirty and mistreats the apartment.

W I was raised to always respect other people’s ‘things’. A house is no different. You may be paying but you are paying to BORROW something that ISNT YOURS. Treat it with respect.
