The lady would be responsible for her tree damaging the neighbors fence, but at 86 years old, she can't be expected to cover the repairs, the neighbor should have gotten to know the lady and her situation and offered to help cut up the tree, hopefully you can help her with that tree in another video 👍

After watching several yard transformation channels, I've determined that there are more people who WON'T help their neighbors than those who do. It's a shame but people just aren't like they were, once upon a time. Thank God for people like YOU, Erik!!!! You will never run out of people to help!!! Excellent work gentlemen!!!

If he hasn't talked to her he doesn't know what she'd do, she's 86 for goodness sakes. Out complaining to the guys working on her property, makes me think he's trying to get some work for free since he's not speaking to the homeowner. She might be 86 “for goodness sake” but, I’m sure she has a telephone and is more than able to call someone in the clean up the tree. Maybe the homeowner is not to approachable.

I'm 72 and I help the lady next door to me. She is younger than me but her health is worse. But I would definitely help her. I bet he doesn't even have sympathy for his own mom. God Bless you for helping her.

I’m 70 and can’t do my yard anymore. I have Tommy do it for me. Small yard and no trees. So Thankful he does it for me. If I was able to of course I’d help my neighbors out.

Maybe he can't help her. He hasn't been able to get the tree out of his own yard either. We don't know his circumstances and shouldn't judge.

If it fell on my property, broke the fence, I would call my homeowner insurance and see if it’s covered and if it is I would have it removed ( tree) and the fence fixed. If I can’t use my insurance and I could afford to get it cut up, I’d tell the 86 year old neighbor that I would take care of it. I would hope she would say bring me the bill and I’ll pay for it but if not I guess I’m stuck with the bill. I don’t know her finances at 86, or whatnot. Either way if I wanted it cleaned up I’d would do that. BTW Erik you and Mark are doing a great job on her property. It’s beautiful. Maybe you could set fire to it but have the fire department around just in case.

The fact the lady was elderly it would have been nice if the neighbor helped her out and shared the cost to get the tree taken care of . How would he like a neighbor treating his elderly mother like that.

It's a shame folks don't help neighbors anymore. 😢 I am 68 and in a powerchair, and I am weedwacking outfront of our home. The neighbors are out mowing and weedwacking, but never offered to help. When I was young like them and I saw my elderly neighbor needs help, I would go help. I know since the tree was in her yard and she's responsible, but talk to her. You getting the view back for was a blessing. ❤❤❤ Love you guys🎉

My neighbour is 94 and lives with her daughter that is 65. If something like that would happen we would help her.Thats a no brainer! Here in OK we help each other. We live in the country. Ive been blessed with my neighbours.

Here in FL if a tree falls from a storm and causes damage it falls on the owner of the property that was damaged as it's considered an act of God/Nature and is a no fault issue. Each owner is responsible for the clean up on their own property. This is due to the Hurricanes, tropical storms and tornadoes that we have here.

My nephew had a tree from a bad storm come through ,it fell half on his neighbors yard.it was consider an act of God,each responsible for their side to clean up,but they worked together and got it removed.That is how it should be,neighbor helping neighbor.She is elderly,maybe she could have helped with half of the cost to have the tree removed.But she at least got help from you,good job on the clean up.That is a really big tree,big chain saws will be need to remove that monster.Thanks for helping her.🤗❤️

@@brendacain3214 Homeowners insurance comes standard with liability insurance. Her property damaged his property. The insurer (as in her insurance company that she has policy with) is legally required to pay for such damage.

in my state that tree falling is an act of nature, he would be responsible for the fence and removing the tree on his side, you can cut anything over the property line. now days most do not help not even family

You helped & didn't disrespect the elders in your neighborhood. Looks so cleaned up, great veiw! I do live next to an 87 year old woman and she's not only my landlord, but also my MOM!! And yes I help her all the time! Oh and if a tree damages anyone's property, the owner of the tree is liable, at least in my county!

I just talk to my insurance company a couple months ago about our neighbors tree that is rotting out if it falls on my house or deck who is responsible? Well I was told it is my responsibility to fix the damage. Go figure. People just don’t care to help neighbors like it use to be anymore. It’s an inconvenience. The property looks fantastic. It’s so satisfying to see your work. I like doing my own yard and always have. I got double frozen shoulders from moving boulders around to form a new planter bed. My work is beautiful but it could be a year before I get to play again lol. Your videos fill that void for me.

Another great job! Cleared the view to the beautiful lake. NC law states that if your tree is damaged by decay and falls and damages the neighbors fence; then the tree owner is responsible for the damage as it should have already been removed. If an act of God; such as strong winds; then you are responsible for any damages on your own property.

It depends on the state. The general rule in most states is that the owner of the tree is liable for any damage caused by the tree, regardless of where it falls. This means that if the tree is on your neighbor’s property, they are the owners of that tree. And if this neighbor's tree falls on your fence, they are responsible for removing the tree and paying for the damage. However, if the tree belongs to you or is on a shared property line, or if it falls due to natural causes or unforeseeable events, you may be liable for the damage and the removal of the tree. Also, there are some exceptions and nuances to this rule, depending on the causes of tree falling. Act of God or Act of Nature One of the most common exceptions to the general rule is the act of god or act of nature defense. This means that if the tree falls due to a natural event that is beyond human control, such as a windstorm, lightning, earthquake, or flood, the owner of the tree is not liable for the storm damage or similar. In this case, each property owner has to deal with their own damage and file a claim with their own insurance company. However, if the tree was dead, diseased, or decayed, and it fell due to negligence or lack of care, then the owner of the tree is liable. This is because a dead tree or dying tree poses a foreseeable risk of falling and causing damage, and the owner of the tree has a duty to remove it or prevent it from falling.

Good job Eric...obviously that old woman is very old but ignorant to the fact that any tree etc.that falls on your neighbors fence, bldgs.etc. is the Tree owners responsibility to removed it. She's either playing dumb or is ignorant as a fox. And it's obvious your not getting in the middle of it. So smart. My mom and dad had a pecan tree fall in the back yard. Uprooted the tree, came down on neighbors fence. The homeowners insurance paid for damage of fence and cleanup on neighbors side, and cleanup on parents side but not the removal of tree root part on my parents side. Hope this is helpful. There is probably a timeline on it though. Who wouldn't think of homeowners insurance if you are that concerned about a tree falling on your property.

Not exactly, that’s jurisdictional upon laws, as well as even simple overgrowth onto another property. Essentially once that part is on your land you are responsible for it. Assuming you know is what gets folks in trouble, resources and research is being knowledgeable rather than uneducated neighbors and keyboard cowboys.

Not sure about the state you are in, but in Mass. the owner of the tree (where the roots reside) owns the tree. If the tree crossed the vertical property line, the neighbor is responsible for the portion of the tree that is on the neighbors side of the vertical line. If a HEALTHY tree falls onto the neighbors fence, the neighbor is responsible for the portion of the tree on that side of the property line, and needs to fix their own fence. HOWEVER, if the tree is SICK or UNHEALTHY, and the tree owner knows it, or the neighbor calls the tree owners attention to it, then the damage is the responsibility of the tree owner (where the roots reside) due to KNOWN DANGER and is considered NEGLIGENT for not removing the danger. From what I understand that rule is common throughout most states. In this case, it appears that the willow tree may have been sick before falling as willow trees tend to have short lives and cause all kinds of problems when they start unraveling. So, did grandma know the tree was sick? Did the neighbor inform her of the potential hazard? Probably not, but no matter how viewed, nobody should plant a willow near a property line. The wreak havoc with their shallow roots, fall over easily due to the shallow roots and dense foliage, and rarely last more than 25 or 30 years in good health. Plus they attract bugs by the billions.

The owner of the tree usually has to pay for damages. The removal of the tree though is on the property owners shoulders. That is if it was an act of God and the tree was in good health.

Why in the world did he not cut it up himself when it happened. His homeowners insurance should cover something like that. He seems like he wanted something for nothing. He had to have known she was elderly.. People are so nasty nowadays, when I was growing and up and in my younger years, neighbors helped neighbors. I remember getting groceries for and older lady who couldn't do it herself. I asked nothing in return. When I mowed the lawn I would help the neighbor out. People are so selfish. I'm glad I grew up in a time when it was a beautiful country and loving each other. I'm older now but if it was me I would get that tree out for her, even if I could only work for 5 mins at a time. I had neighbors tree fall on my fence and our insurance fixed the fence and they paid my deductible. They took care of the tree. I'm sure she doesn't have that kind of money to have the tree removed so why don't the neighbor just do it if he is that concerned. Take care and GOD BLESS. ❤

I do help my elderly neighbors... I own and operate a lawn service business, and I do three of my older/elderly neighbors' lawns for free... Here in Sarasota, Florida, I charged no one for any storm cleanup for the past 6 years...!!! Thanks for sharing... Keep up your awesomeness...!!!

I think people don’t help their neighbors anymore because they have to work too many hours to make ends meet. I pray you and your wonderful wife who is usually right by your side along with Bill whom you’ve chosen to help are making enough money from KZbin to cover expenses . Wonderful job as always and you take on some big and amazing transformations that there is no way they could afford

I'm no spring chicken, retired and all, but my neighbor is 85 years old, which is not quite 20 years my senior. I'm not sure how old his wife is. Anyways, he gets around very well, unbelievable well, but I still offer my help whenever I can. It's sad because we live in a society these days where people don't bother to get to know their neighbors, let alone offer to help one another.

Eric, if the tree came from the ladies property line, then she is liable for the fence. What is it about 5 square and a few poles. She is lucky that it didn't destroy heavy farm equipment.. She should be humble, and replace the parts that are damaged, as far as neighbors helping neighbors there are very far and few. I thank god that people has neighbors and friends like you and your wife. God bless.

Where I live the general rule of a tree falling from one property to another. The property owner that the tree fell from pays for any fence repair. The part of tree that is on the receiving property now belongs to that property owner. Yes I would help anyone. A tree fell the other day from my neighbors property across their fence and across my driveway. I was able to just lift the tree straight up off his fence with my excavator, without doing any more damage to the fence . The tree was a small cottonwood so I just cut it into manageable sizes and deposited it in the fire pit. I then took the photo evidence and showed him the pictures. The tree did bend the top part of the fence. Anyway he was happy to know what happened.

The neighbor should check with his insurance company. I have heard when a tree falls it's considered an act of God. Amazing job you two are doing for this elderly lady.

According to my insurance agent, I am responsible for damages done by my trees to someone else's property and vice=versa.

I had a Colorado spruce tree get hit by lightning and hit my neighbors gutter , we both contacted our insurance companies and was told her insurance had to pay for the minor damage to her gutter . So I guess it all depends 🤷‍♀️

Your insurance company does not always cover damage from your trees. I think the catch is that it has to be caused by a major weather issue. You may even not be covered if this is the case. Check your policy covers this, is my advice.

Insurance will not pay for tree damage caused by wind, lightning etc. Considered an Act of God. I guess a tornado isn't an Act of God they seem to cover that.

She is responsible for his fence, it was her tree that did the damage to his property. Also that house on that land with the yard that big that actually touches the water and the size of the property, where I live would be worth in the Multi-Millions to purchase. It is the type of residence we all dream of having. You do Excellent work Brian, keep it going.

Usually the property owner where the tree is growing is responsible for the removal when it falls. As a neighbor who is caring and helpful, I would take care of the tree that fell on my property for the older neighbor. ❤

If a tree falls onto a neighbors fence and is an act of nature, and you want it fixed, it's on you to get it fixed. If the neighbor caused the tree to fall it is their fault and they are obligated to fix the fence. If and 80 years old lady lived next door to me, I would help her every chance I had unless she was a bad and angry person

I never knew a mulcher like that would be capable of devouring such large logs. Seems to me like you were pushing past the design limits of that machine. However, you proved it could be done!

We had this dilemma. In S. Carolina it is the responsibility of whomever's yard the tree fell into to deal with it. Thankfully our neighbor graciously paid to have it removed as it was his tree.
