A landlord still has taxes, insurance, and possibly a mortgage to pay, they need some level of income to cover that. It's a BS law that doesn't help actual renters or landlords.

They are listed under "adverse possession" If you google "Adverse posession laws [State's Name]" you'll find them. I think it's in all US territories as well, but I'm less sure on that since some places like American Samoa kind of do their own thing.

This is a law from ancient times when people sometimes went hunting or whatever and died. Their homes were therefore left vacant and anybody that came along could take over the home. Before the authorities do anything at all, they should simply be required to check for proof from the 'renters' (squatters) that they have been paying rent, and have a signed, legal rent agreement. When I first found out about squatters rights I looked into it. Apparently it's old laws from before everything was digital, and back then people would just disappear without a trace sometimes. When that was the case you would want laws that made it legal to reclaim this unused land, as otherwise larger and larger parts of a country would just become unused.

@@Luckyyshot- It can still be an issue even today - sometimes land is just outright abandoned, and most states give landowners a reasonable term of 10 to 15 years to get rid of the squatters before they actually lose the property. Just pop by once every two or three years to make sure nobody's openly living on it, and you can keep your land. This is especially true for hedge funds and speculators that buy and sell land without ever looking at it - it could end up being lost to squatters if they never actually send someone to take a look at it, but even then it has to go on for more than a decade before the land is actually lost.

But there is an extremely long drawn out system that she has to follow that's linked to human rights. Please check for me as I'm not American. But as far as I'm aware all states follow very similar rules. Meaning Texas have it just as bad as everyone else. (Castle law doesn't apply to a place you don't live at day to day.)

The police and courts told them that they had two houses, these people had none, so its only fair that the house goes to them. They do have a lease agreement - its just fake. Short story, somebody else has hoodwinked them (it only requires a printer). The problem is that the cops don't do civil matters; the courts need to make the decision on the validity of the lease agreement. It is usually very quick once you get into court, but the courts are rammed and can take years to get a date. The solution is to require lease agreements to be registered with an authority under witness from the owner (who will have documentation). Then, no registered lease, out you go (probably to jail).

My mother ended up killing herself because of squatters. Also in queens NY. She owned a 4 family house and after the tentants on the 1st floor moved out she tried to rent the apartments, but before she could a set of squatters took over the 2 apartments and trashed them. Took 8 months to evict them and they destroyed the two apartments. They also didn't pay for electricity as they somehow hooked into the electricty meter for the common areas, and my mother was on the hook for about $5k in electricty costs, beacuse the squatters said it was like that when they got here. In total she was out about $20,000 in rent, $6k in utilities and was quoted around $60,000 to repair the two destroyed apartments.

The trick is to create a lease for someone and then have them move in and call the cops. If the cops show up and have one person with a lease agreement and one without, they have to take the legal tenant serious, leaving the squatters with no choice.

A lack of documentation would end the discussion. To get to tennant status you would have to openly announce your presence (usually a newspaper ad or signage) take over utility payments, and then file for adverse possession at your local court house with your SSN and ID. At this point the owner is contacted and can stop you. If they choose not to, the owner cannot be contacted, or it just goes uncontested then you become a legal tennant of the property. The newscast doesn't really go into any of this, probably for sensationalism.

@@skyh3r0es not quite, but close. There's a defined process for this in every state called "adverse possession" laws. The court is required to make "every possible attempt" to contact them, but what that actually means is a grey area... in practice it's probably just a letter and a phone call. But the larger part of it is that you have to be demonstrably living there openly. If you hide, keep the lights out at night so it looks empty, disguise your presence in any way... that nullifies the attempts to adversely possess the property. Practically speaking: In most cases your neighbors will call you, or report the intruder to the police. It's intended to be more of an "I'm here, and clearly nobody cares" than an "I'm in your house, what are you gonna do about it?!?!" situation. The original intent is for things like finding an abandoned farm house or cabin, and living in it for a generation and then owning it because clearly the owner isn't coming back... or to resolve disputes like "I just checked the property line and his 20 year old barn is 3' over it so can I make him demolish his barn if he pisses me off" and with adverse possession these things wouldn't need to go to court. To be clear this is a holdover from the frontier days where finding abandoned properties was far more common. The whole "squatting" thing is certainly not the intended purpose of the law. I would think extending the period before squatter rights kick in to two years (instead of 30 days) would be both reasonable and preserve the original intent of the law, as those 2 years would be trespassing.

Unfortunately Asmon in Houston and Austin they've been adding to squatters rights. I had a friend who's grandmother was dying of cancer and had to be in a hospice for the last few years of their life. The family was trying to keep the house but shortly after word got out she wasn't there illegals broke in and claimed they were renting it from her. they proceeded to pawn all the furniture and trash the house and the local police couldn't do anything and the courts were dragging it out making what would normally be a 5 month process take almost 2 years. which put it DANGEROUSLY close to them winning squatters rights and keeping the house. Then the uncle came up with a brilliant idea. He got a formal agreement with the grandmother to rent the house. went in when all the people were gone with moviers. Moved them all out and changed the locks. Since he was an introvert and could work from home he never left the property unoccupied and the squatters never challenged in court. He essentially squatted on the squatters (but leagally) due to this the uncle got the rights to the house after the grandmother passed away. Although he sold it immediately because on two occasions people shot up the front of the house.

Two years of legal proceedings costs tens of thousands of dollars in legal fees, property taxes, and lost rent. A mag and a shovel cost a few bucks. Brutal vigilante justice is always just one bad law away. We need to make sure the law sides with the property owner in cases like this if we want to prevent violence.

The flaw in that logic is, that both sides are capable of potential violence when unsatisfied, the criminal assumedly even more so. So if the main goal is to "prevent violence", that could lead to laws that demand the property owner to give in, to stop the potential escalation from the criminal. Laws should be made based on whether they are good or bad in themselves, not based on fear of what if the people violate the law, cause if they do, they just get punished then. The squatter rights are a bad law without that fear, because it both hurts property owners, without actually solving the homelessness issue for the vast majority of people without homes. Even if you want to redistribute property, a tax on unused land used to build social housing would be a much fairer solution, than basically a house theft lottery.

Violence generally seems to come about for two reasons - one is that the law does not do its job, someone gets backed into a corner, and decides that they have nothing left to lose, so they decide to extract the justice that the system denied them by force. The other is that someone is just a criminal and simply does not feel deterred by the law against initiating violence to get what they want, so they do so. The way to prevent the first is having a system of law and a legal process which is as credible, simple and affordable to access as possible, with as few loopholes as possible. The way to prevent the second is allowing the likely victims of violence to have the lowest barrier to entry to defending themselves, so that the incentives are stacked against whoever would initiate violence on a whim just to get what they want.

I could turn this right around and try to claim that "just a criminal" might feel forced backed into a corner by their circumstances, while a vigilante could be motivated by just a desire to satisfy a feeling of vengeance. A crime is a crime. Feeling entitled to take the law into your hands threatens the social fabric as much as feeling entitled to steal. So if we shouldn't accommodate our laws for thieves, then we shouldn't accommodate them for vigilantes. A self-defense is something else entirely, and doesn't involve needing a shovel to hide the bodies. And especially not a plan to do so.

When the police came to our house to investigate and get our statement, they said we could have been charged for defending our property. We didn't, but hearing that kinda blew my mind. This happened to me in California. My grandpa passed and he owned a property that was infiltrated by a squatter. The person that claimed she owned the place was a crack head that lost custody of her children. We called the police and that's when we were introduced to Squatter's Rights. The police couldn't do anything about it. We were essentially locked out of our own place and we had to go through several court proceedings to get it back. After about 2 months we finally were able to get the squatter a 2 weeks notice to get out. As the days went by she tried to get that time increased because she was trying to regain custody of her kids. Luckily that didn't happen. She was finally out after about 2 and a half months and when we finally got back into the house, all of the windows were destroyed and many personal items were either lost or destroyed. I'm so glad to finally be out of that hellhole of a state. The people living there are continuing to vote in the politicians creating laws that side with criminals. That state is a lost cause. Had no idea New York also did this.

How is squatters rights even a thing to begin with? Like, I understand "you get a few days to get your shit packed and leave". But how is it a thing that ownership just passes to the squatters after a certain amount of time? That baffles me.

It usually comes into play if the squatter was actually maintaining the property, and even then it would have to be for at least a year. Like some guy owns a second home and he doesn't use it. The neighbor can come in and mow the lawn and varnish the fence etc, and the idea is you more or less purchased the house with labor and supplies. This isn't one of those cases. This is just NY being awful again.

This is a real problem here in Spain. The owners have hardly any legal tools to defend their property, the courts take years to make decisions, and, if during this period you stop paying utilities or try to enter your very own property, it is you who can end up arrested and sued.

I think that Castle Doctrine in many states deals with this issue just fine. NY is a hellhole, and they voted for this 4 to 1 in NYC. Probably 90% in Queens.

This happened to my sister's rental about 9 years ago. We had to take matters into our own hands to remove the squatters because the police and the courts WERE NOT ON OUR SIDE. It was not a pretty situation and it took a month of non-stop harrassment and vandalism to get those people out of her house.

I heard of a worse case. The squatters were trashing the mansion and there was graffiti on the walls. But the owner wasn't allowed to cut of amenities to the property and as it was registered as his house he had to pay the gas water and electric bills by law or go to jail. They wouldn't let him cut the services off because it was illegal, something to do with human rights violations that the facilities companies had to supply those services. But he got the bill as the owner because it's his property. Now imagine being told you gotta pay all that while the new mansion you built can't be sold and you gotta pay second home owners tax while the courts take their time over eviction for 2 years. 😐

Yeah, it's not really that different in the US. After 30 days you have to go through the courts to get them out with a proper eviction notice, but it's still 10 years before they can claim the house.

It's an imperfect solution to the problem of real estate speculation in a place with an extremely tight housing market. Some investors would happily sit on uninhabited properties for months or years until market conditions are right for them to make their moves. This can create artificial scarcity in housing which drives up rents and leaves New Yorkers unable to afford places to live, and ultimately dependent on public assistance programs. The real problem is using housing as an investment vehicle, people should buy homes to live in them. The lady in the video might have been screwed by the circumstances... it's also possible her parents who left her the house were renting it out and had a lease agreement with those tenants, the news story doesn't really give us all the details.

It's 10 years in NY state as well. This particular timeline (30 days) applies specifically to NY city as far as I know, and dates back to the old days of reckless property speculators, absentee landlords, to prevent real-estate neglect, and mitigate severe housing shortages. Old New York city (pre-1990s) could be a really grim place, these laws made a lot more sense at the time.

Its not "America". Each state is basically a country. NY is a shit place, its not like that in like 90% of the country. Most of the country is red. Its just that these places like NYC have a shit ton of people and thus... representation in the congressional house. Each state gets 2 reps in the Senate, they get proportional representation to their populations in the house. Of course, our census that dictates these things doesnt discriminate from citizen or noncitizen. So all the millions of people here illegally that moved to those blue locations just give them more representation in the house and more federal electoral votes. But we have those laws too in my state, just not 30 fucking days. Its 7 years here... for similar reasons. Shit happens, sometimes a property isnt really owned by anyone anymore and it takes forever for the government to get involved. I have seen massive two story ranch homes overgrown like a horror movie. Who would let a 500,000$ home go to waste like that? This is why these laws exist here. My state is 7 years and they have to maintain/repair the property as well as pay the property taxes. If you come up and ask them to leave/get the police involved then you dont really have to worry too much. Its a hassle but theres not really a chance that they will win out and take your property. You just have to pay them the taxes they paid and possibly the repairs/maintenance... but that would be for civil court to decide. They would be out before you did any of that mess.

Because of how it's legally set up. Scenario, you're renting a home. The landlord decides to show up and evict you with 6 months left on your lease. Instead of going through the eviction process in civil court, they change the locks. This is how squatters are getting away with it. Make up a phony lease and make the homeowners have to go through the eviction process because it instantly goes to civil court. Also, keep in mind NYC has renter rights laws to allow people to continue renting.

That's not squatter's rights. 30 days means he invoked landlord/tenant. The required time for squatters to take over a property depends on state, with the shortest being 6-months for certain apartments in NY. Most squatter laws cover detached homes (possibly condos) and the shortest time is 5 years of continuously occupying the property, in addition to other requirements, as well as passing certain tests to determine if you are a squatter or tenant. What this squatter did was instead of saying he's squatting, he said he was a tenant. He probably sub-leased the property (It looks like migrants, which meaning cash under the table) that he was squatting for free. The people who got escorted out probably had no clue it wasn't his property. He probably had fake documents claiming he was the owner. He probably also had ones claiming he's a tenant in case this exact situation happened, specifically so that he could invoke Landlord/Tenant laws, knowing full-well that he'd be able to either live there, or collect rent from a subletters for up to 2 years before the gravy train ended. Squatters can be removed by police. But when Landlord/Tenant gets invoked you HAVE to consider them as a Tenant and go through eviction court to get them removed by court order. Or pay them to leave.... which essentially makes it legalized extortion. [Not legal advice] In my opinion, you should never pay them to leave without a contract that specifically identifies them as a squatter/adverse possession and that the payments are being made under duress. If you don't then the payment creates a legal relationship that retroactively justifies/validates a pre-existing "rental" agreement. Meaning you are limited in being able to go after them for other damages. If you set yourself up correctly, legality-wise, you can sue to reclaim the payment you gave them to leave, as this may be seen as an extortion payment that can be reclaimed, rather than a "voluntary transaction."
