NICS Exemption: Skip A Background Check When Buying a Gun

Ok love your videos … I do have a question I need help with. In my mid 20s (2005) I took a felony charge of possession of controlled substance. It was my girlfriend’s joint. So long story short I live in Alabama & my attorney got me a full pardon with my rights to posses & conceal. I Have aAlabama gun permit in good standing. Have never had any issue with arrest of any kind other than the one charge. Where I have run into trouble is buying a firearm the forms clearly ask if you have ever been arrested or convicted. My attorney advised me once you are given a full pardon as far as the government is concerned it’s as if I was never convicted or arrested. So I bought over 6 months several long guns & pistols. I went to the same dealer above & bought a 22lr pistol & they held me up & then flat out dented me. So I’m at a loss what the best moves I should make to ensure this is not handled wrong. When u was denied I let the dealer sell the gun. ( I should have fought it but not having clarity on the checking no to have you ever been arrested scared me into second guessing if that was correct.. any help would be very much appreciated !!!🤪 Ohh in case it might matter original charge 05 possession controlled substance 2011 full pardon with all rights restored & all gun rights restored .. thank you !!

If you’ve been pardoned, if you read the instructions it says to answer “no” to the question. If you answer no and you get denied by the NICS background, your recourse is to appeal the denial and work the process.

In Utah with a concealed carry permit no sale point background check is required.

@Gunner 411 I have a texas LTC. I went to purchase a firearm, filled out the paperwork and was denied. I answered 1 question on form 4473 incorrectly. How do i fix?

You weren’t technically “Denied” they just refused to proceed because you didn’t answer properly. Study the form and go to another store or talk to that store and explain that you misread a question and see how long they’ll make you wait before allowing another.

Mi has changed that. You have to go through NICS and permit doesn’t matter anymore.

Your permit is only valid in your state if your state honors it for the purposes of a purchase exemption. You can only buy long guns out of state as long as that state and your state allow it, however, you’d be subjected to that states background system.

@@Gunner411 1 more question please. What if I'm delayed at a big box store at the moment, will it slow things down if I went to a small dealer and bought one therefore I could get it after the 3 business days? Or would that just complicate things even more?

Oklahoma you can walk out with any gun I just show my license Just sign my name No questionnaire

If you aren’t completing a 4473 then your dealer is doing something wrong. It’s a federal requirement and Oklahoma doesn’t have a permit exemption - and even in permit exemption states the form is required.

@@coziii.1829we are constitutional carry here in Mississippi too. There is No connection between constitutional carry and NICS exemption. Basically whoever let you walk out that door with a gun and without a 4473 just committed a felony.

Your permit exemption is only valid for your state of issuance and residency. Out of state purchases still fall under the normal laws. Long guns only, had to be in compliance with the laws of both states.

@@Gunner411 With a CHP, Concealed Handgun Permit, an additional background check is not required. It's been that way since I can remember, for years. I don't recall when it started but probably when the CHP was implemented.

According to NICS they have a permit exemption. They could have changed something and not allow their residents to use that permit exemption.
