IP rights holders should not be allowed to pick and choose who they want to strike with copyright takedowns. Period. If Nintendo can take down that video because of just the title screen showing, Then KZbin should force them to actively pursue every single video that includes any Nintendo Switch video game ever. This would force Nintendo into the path that would very much spotlight how toxic their legal team is. And then if Nintendo doesn't aggressively seek out every single video of a Nintendo Switch game running, they should lose their ability to issue copyright takedowns.

It wasn't even the title screen. The timestamps in Nintendo's claim only showed the game's _title card_ on the home screen. They gave him a _hard strike,_ a serious threat to his channel and his livelihood, because he showed how to exercise his legal right to back up game cartridges he purchased. In protest, I think the entire community should treat Nintendo's entire existence as obscenity which is unsafe for kids to see. Show but _prominently_ censor-blur anything they've ever made, like their games, consoles, controllers, and characters. Bleep every mention of their name and properties. This takes away the copyright-based attack vector they use to file bogus strikes, eliminates free advertising for them, dings their kid-friendly brand image, and makes a strong point about how obscene their behavior is.

I hate to be that guy, but protest isn't going to work. We can't, but it's also two sides of the same coin, not all the same side. Them essencially doing the disney because they don't want any more kitchen in their own kitchen genuinely reminds me of how certain people close source their game mods because "I gotta do it myself! Only me!". Except unlike those guys, Nintendo usually delivers to compensate. Even their duds are generally still perfectly fine games in their own right, so it is worth it to endure the less good bits.

Although i'm not interested in nintendo roms in general (given that many games are multi-platform and on pc) , i completely agree with your reason. It's about morality and emulation or preservation rights, not just 'revenge'. If Nintendo sues anything just for sales, or doesn't allow emulation, or even storage the rom. What happens if the game goes too old or not in physical copies? Is it lost forever? I find the case of lost roms just as terrifying as losing important artifacts or ancient exhibits. And how come every other console company is somehow content with open source emulation and Nintendo just rages at the thought? If i buy a game through switch , is it my game? If yes, then why not let me as a single person enjoy that game in other screen or device? I can't understand. (I'm not directing this to you specifically , but to comments like the one below)

Honestly Im on the same school of thought about executives not really having repercussions when theyre the ones making decisions that fail and cause layoffs. Removing the cause is the best case. Look what happened when Yoshinori Ono left Capcom. We have used Steam family the beta (2 parents and 3 kids) and it is a massive feature. It’s been a fantastic way to buy once for the whole family instead of rebuying the same game again and again. Biggest drawback is that two people can’t play the same game at the same time, even in single player. I hope they allow that feature (or allow developers to enable it)

Family Sharing is such a Valve move. I share a library with 5 friends and I got almost any game I can think of, we got more than 600 games in that library and it just works, if you have multiple copies you can even play multiplayer. It's basically just free games.

The Mig Flasher is using stolen decryption keys to perform anti-circumvention for which Nintendo is protected in the USA against by the Digital Millennium Copyright Act, Section 1201. What Russ showed was proof he violated that law by showing that game was indeed decrypted and running on a non-Nintendo device. He should know better - but obviously doesn't. People beg me to cover Switch emu on my channel - and the answer is simply "hell no". I don't agree with Nintendo doing this - but they are within in the letter of the law to do so. I started playing on the Xbox One back in 2017, so I can't speak for when it released back in 2013. Up until now, friend requests were never a thing. All you had was a button that said "Add Friend" and you would be in their friends list just like that. In order to know when they did add you, they would be one of your Followers. If this change gets rolled out, I wonder if the many people I have played with once or twice will still be in my Followers list or the only people that I'm still mutually friends with will only show up on my profile page, as I removed those people years ago. So, it didn't used to be mutual, but it will be when it was already a thing on the original Xbox and Xbox 360, so I don't understand why they not only changed how it works at all, and why they're changing it now. About what Mr. Sujano said about getting nasty messages, I don't think this matters unless you put family settings on your account to only show you messages from who you're friends with anyway. Not sure if it has to be mutual or not. If I remember correctly, your friend list was also public even if you had family settings, which from a privacy perspective, is no longer the case.

Laws need to change, and so does KZbin. Google is an awful company for how they handle this. Corpos should be required to make public statements on KZbin about such challenged content strikes so they will have to deal with not only the court of law, but court of public opinion in an open and honest setting.

I mean basically he's reviewing something we all know what it does, very surprised he even put up a 3-second Mario clip or of the cartridge because Nintendo is just horrific with this. You ask why didn't KZbin let him just take out the 3 seconds because it wasn't about the three seconds Nintendo has a chokehold, there are millions of channels dedicated to Nintendo KZbin knows that that would be a lot of revenue lost if Nintendo starts putting strikes on everything. So even the Kings have to answer to somebody at certain times. Totally agree about Microsoft why would you cut at the root that is nice and healthy when the rot of the tree is at the top get the keep on chopping areas that are healthy and are not the problem. Seems like it's just easier to get rid of people they don't do it like Nintendo does if revenues don't come in a lot of Nintendo's honchos they take a pay cut because they know it's on them and then down the road they make all that money back. Why because they know down the road they will fix anything and come up with another hit and another hit after that, some people may not like Japanese culture but at least they take responsibility at least at Nintendo. Everyone knows not every game is a slam dunk, but firing people for no reason just so you meet your financial quota for the quarter so it doesn't seem as big as a loss. Just seems so volatile and mean that people who work there can just be cut off like they're nobody when they probably pour their heart and tears into these games and testing these games.

If KZbin would allow to remove the 3 second material Nintendo let their A.I. sent a DMCA for, it would still suck big time but at least it's somewhat of a compromise. As for GTA3, one of the devs actually said it would have been fully possible but due to the weak sales numbers, they canceled the Dreamcast version back then. Confused about PPSSPP on Switch here though. Pretty sure I have it already on my hacked Switch.

This reason we need to unionize as gamers and no longer invest in anything Nintendo period . It's so anti-consumer that it's fans can't even celebrate the fandom of the company that gave him the games that they grew up with. Honestly this is an overstep of the bylaws of the United States has and conjunction with copyright claims on fair use and furthermore should be banned from the United States until it recognizes vetting processes for companies in the US.

Honestly, I sorta have the feeling that we are about to eat good. Almost always when Nintendo gets obnoxious about their IP, something good is around the corner. Kinda like how when they struck down AM2R(even tho the game actually came out stronger in the end, so nothing was lost) because Samus Returns was on the way and it is one of my favorite Metroid games(Haven't played Dread, for reference).

Lmao, imagine liking samus midturns. Am2r is superior in every aspect(and if you like samus return features like parry and 3d graphics - they will return in dread). I won't trade my smbx for mario maker and I'd never trade 10 years of hard work of am2r to this crappy looking mediocrity(even if we think about them both as free and for pc, if we're thinking in "fair and legal way", there's absolutely no chance of me playing worse game bought for pretty big money on worse platform which I should also buy). The only saving thing about samus returns - that its success allowed mercury steam to make metroid dread, an absolute masterpiece. Best nintendo game is made by an outsource studio, what an irony.
