I know many people lost their jobs during COVID and genuinely could not pay rent. Felt so sorry for all the small landlords because I witnessed so many dishonest people not pay rent because they thought they had a free pass. But they could still afford their alcohol, weed, new electronics, cars, and other luxuries with the stimulus money. My tenants had some issues with rent, but we kept in communication and they paid what they could. Now they have finished paying me off for all the back rent. I really appreciate them, so I let them have 3 months free of charge.

Besides that libraries have free wifi usage, it's all about ur drive to find things out. Ignorance is no excuse these days (there are exceptions but I'm talking ur average able bodied individuals)

These are the kind of plaintiffs we like to see. Her sister may want to consider a job as a lawyer or in the legal profession because she was exceptionally thorough in crafting that letter and ensuring that both parties were complying with the law. Very detailed & very clear. I understand both parties here. She didn’t want him to do anything illegal or against the law, which he kind of was bordering on, while he didn’t want her to skimp on the rent or get into a position where she couldn’t pay, which seemed reasonable. In some ways, I think an honest conversations on both sides and a meeting of the minds could’ve helped. Sometimes, it helps to just sit down with someone, put your cards on the table, and communicate the issue. I also think, if he’s going to be a landlord, he needs to be more accurate on the law. Overall, great case.

Unfortunately it’s the new reality… with inflation at a all time high, finding any place lower than that for 1 or even 2 bedrooms is a day dream. I pay 1750 for my 1 bedroom 1 bath 800sq ft.

I have been living in my apartment building for almost 20 years now and it is just constant bad management. I cannot tell you how many times they have been sighted in housing court trying to illegally evicted tenants. I keep all of my receipts and I take a picture on my phone and email it to myself so I can place it in a folder. I cannot tell you how many times the rental office has claimed to not have received my payment even though I have a receipt that is signed by them. You definitely have to do your research when it comes to landlords and document document document

One thing I've never been able to understand is that in the eyes of the law, a tennant must move out on the last day of the month, but when they move into a new place, they can't move in until the first day of the next month. Where are they supposed to sleep on the last night of the month? Seems to me they should be allowed to have their things out in the morning of the first of the new month in all fairness.

Are you sure? I've rented places online and they have calendars that let you select your move-in date. Maybe the law varies by state or maybe it's being misinterpreted.

Several things missed on this case. The move out date on the email that the tenant sent the landlord said June 18, 2021 but should have been June 18, 2022. The Rental Assistance Program paid for months in advance on an expired lease. Her lease ended the last day in February 2022 but they paid until May. 2022 The pro-rated amount was incorrect. If the monthly rent was $1700.00 the pro-rated amount should have been $1020.06. The daily rent is $56.67 times 18 days is not $1019.99.

He kept saying she couldn't afford it. News flash most rental apts want Two or three times the monthly rent as your income ....well here in Virginia a 2 to 3 room rent Is 1700 plus....ok who is making 5100 a month ???????!!!!!! It's unrealistic

Wooe!! I didn’t know we paid up to 6 mos for people whose job was affected by Covid. I thought it was more like 3 mos? Surely 3 mos is enough time to get paperwork filed for unemployment, Covid Assistance, Food Stamps, etc.! Seriously, wonder how many people took full advantage of this who didn’t need to?? No wonder we are in such debt as a country!! Wow! Govt needs to stop supporting people that don’t really need it, or who are capable of working, etc., (this is about the Govt’s excess waste of $ in general and not about the case that was just on!) …I’m just surprised!! 😳😲😵‍💫!

I absolutely hate how tenants abuse the landlords. That's why I don't want to rent out my property because they screw people over so badly. I have a ton of friends that were landlords and stopped renting because the tenants screwed them over.

I tried to come up with a clever analogy to illustrate the reasoning, but I failed and will bore with a dry explanation. The state assumes authority to protect the “little people” in this world. The people who cannot afford to buy their own homes. The state does not tell a homeowner that they can’t paint their home whatever color they want. The state steps in to regulate when the homeowner decides to enter the market where consumers and other people’s rights come into play. It is important here to realize that the state does not force a homeowner to enter the rental market. That is the decision by the homeowner to purposefully avail them of the authority of the state in that space. Homeowners, in exchange for the benefit of a return on investment by entering the rental market, give up some of their autonomy as an owner. This is a decision that they have made. Just like businesses and corporations decide that in pursuit of profit, they will subject themselves to the corporate laws of the state (and if a publicly traded corporation, federal exchange regulations). None of this is forced - it is a conscious decision to submit a piece of their authority to the state. Circling back to my original point, the state has to have rental regulations or those investment seeking entrepreneurs will take advantage of the “little people.” Therefore, it works hand in hand - the state’s purpose is to provide some protections for those in different positions while homeowners who decide they want to take the rental route agree to those protections. If you don’t like the “little people” argument, that’s fair, so think about it as consumer protections. Same concept explained using a different term. Because of the asymmetries of power and information, the state steps in to protect consumers in cases where they would have no leverage compared to someone with more resources (such as ownership of a home).

I know people that scammed on rent. My landlord had another tenant who stopped paying just before COVID hit, so when the moratorium on eviction came, he thought it was a jackpot. He continued to not pay until he was finally evicted. Meanwhile, I’d developed a health condition and was out of work - but I paid rent every month I lived there.

I disagree with the judge not awarding the entire month of June even though she gave him advanced notice the judge has to think about other people moving from one property to the landlord's property it's going to be unlikely that another tenant is going to move out of their property on the 17th and move into the new property on the 18th most people move out on the last day of the month and then start a new tenancy on the 1st so I think it would be a little bit harder for him to find someone that's going to be willing to move in on the 18th, everyone cared so much about the tenants during covid but no one cared anything about the landlords and everything they had to eat and take a loss on! not only that but there were so many dishonest people taking advantage of government programs during covid! do people not think that these landlords have bills and a life to pay for to?

Basically, New York law allows her to be a squatter and we the people are required to pay for it. I would never ever allow another tenant with this assistance to live in my home ever again with those kind of rules. Never I feel sorry for the landlord he’s getting screwed.

Such a stupid thing putting eviction notices on a door. In Australia they have to be mailed. Putting on the door is a breach of privacy, especially like in this case, when they make an error and so easy for someone to rip it off walking past.

COVID protections were only for temporary suspension. You still need to pay all the back rent once the suspension was lifted.

I have been watching a lot of these videos of renters/landlord issues and I am totally amazed at the number of renters that get rental assistance for months and not being during Covid! As a landlord myself it is also very sad how many landlords do not get very many rights but the renters by law get rights that just is not fair to landlords. I guess everyone thinks that all landlords are just rich creeps who can afford to not get paid their rent or has plenty of money to repair damage to their property by neglectful, disrespectful tenants. Pathetic!

I don't like that landlords can show the place while others are living there. I personally don't like shoes worn in my home, and people are thieves. I barely let family and friends in my house. Damn sure don't want strangers in my house while I'm gone walking around with shoes, and eyeing my belongings.

But in this case,unlike most, the tenant had asked for and received a prorated first months rent which proved that the landlord was open to prorating once, so I think that helped her with her case. Also, JM was heated with the defendant because of that false eviction notice scare tactic 😂

Soooooo she just up and got an apartment without actually knowing how things work? She’s a grown woman. Everyone should know that after a lease expires, it automatically becomes month to month unless the tenant and owner do otherwise.

I was a landlord I say WAS because I had 3 properties I rented and 2 of the 3 ended up not paying rent during Covid and I only received partial rent for 1 of the 3 long story short I had to give up 2 of the 3 rentals & sell the 3 bedroom 1.5 bath with garage house I built to keep the one 2 bedroom 1 bath rental no garage..I went from making $1800+ a month after paying all 4 of my mortgages to loosing out over $140,000 & the house I built for 4 years by the time it was all over with 😢
