This whole thing makes absolutely no sense. If she approved a prototype, why would you make something different? Even if the pattern was incorrect, call her and alert her so that you can reproduce the prototype that she approved. They just were careless.

Because they went based off the blue sample when they gave her the prototype which is a single unit. When they are going to mass produce, they lay down the fabric on top of itself in many layers and use the pattern to cut out at the same time. When they used the pattern, the instructions were incorrect and when the assembled it it didn’t turn out right. They actually paid and have her free labor when they told her how the pattern should be cut.

I can only hear the case there is no picture. If they cut the sample on the bias they should have told her. It makes a difference in the fit. Cutting on the bias would make it have more give. All product created after should be cut the same because that is wht she approved.

Agreed The manufacturer failed to communicate with their client about their concerns from the get go. They should have informed her if the fabric for the prototype was not enough, ot that they cut it a certain way different from the pattern. Or, that the pattern did not indicate cutting instructions adequately. Or, whatever else they were concerned about. I have worked with CMT (cut, make, trim) businesses (they make small orders) and it is imperative to provide a first sample for the client to approve - it must match the prototype. Some people don't care enough about their business reputation or the clients satisfaction to put their concerns in writing or to take that extra step - it's all about them getting the order to make money. Sad and shortsighted 😢.

I think deep inside the defendant know she made a mistake. the problem i think is lack of communication. Knowing this is a product, the defendant should have communicated to the plaintiff that they actually did the sample differently and discussed the issue. the other problem is probably the person who proceeded to do the production run was not involved with the initial communications with the plaintiff. Even small mom and pop operations suffer from lack of communications. :(

Exactly. Whenever Milan doesn't get an excuse to yell, insult, slap the podium and hammer the gavel..... like in this case where both the plaintiff and the defendant were both pleasant and respectful of each other.... then she has to create an opportunity to do so. That's why I can only watch her in doses because otherwise I end up yelling and cussing at her through the screen. She is a loud, boisterous, rude woman. There was one case where the defendant was as soft spoken and respectful as she could be. Milan just started yelling at the woman. You could literally see her wince from Milian's foghorn volume. The first few times she took it but finally the defendant told her that she could hear her and she didn't have to keep yelling. Oh what did she say that for..... Milan melted down, flapping her arms, sqwawking like a chicken laying an ostrich egg.....I thought her head was gonna spin in a360. She worked herself up and then just told her to get out. The hypocrisy........ it's ok for her to yell, shout, belittle people, verbally abuse, insult and disrespect people and if they speak in their own defense, she gets offended... like how dare you not be my punching bag and let me verbally abuse you. I would never go on that show because the moment she hollered at me, my episode would not be able to air once I got done flipping over podiums, throwing microphones, flinging water pitchers, and breaking that gavel in two pieces. She'd be running to the back with that robe flapping in the wind as that gavel flew past her! 😅😅😅😅😂😂😂😂

Also a tailor will work more with altering existing clothes to fit a client (with a heavier lean to formal wear such as suit jackets) whereas seamster/seamstress will do more all-rounder work and constructing garments from scratch. There is a lot of overlap between these two jobs as well but the key difference is a tailor works more specifically with formal clothing

I think it was a simple misunderstanding. The line with the G is meaning the grain goes this way and the sharpie line is the direction you cut it (against the grain). However, the Defendants thought the line with the G was the way you cut it (with the grain). The tailor said that when he saw the prototype, he thought they understood how to cut it.

I was trying to give the benefit the doubt to the defendant. She said a whole lot of things but didn't always answer the questions the judge was asking. She knew they were supposed to make a sample first to be approved. A sample is not just to get the sewing right. It needs to be approved. If they didn't follow the pattern and she approved the one that they didn't follow the pattern they should have verified with her first and asked if she wanted them to follow the pattern or cut it the way they did for the one the gave her.

A production sample is just getting the sewing right. The initial sample is the idealized version that gets more attention, the production sample is what's actually getting shipped out the door when you have four people sewing them together and is done during the process. It's lower quality unless you're paying for the best quality. A lot of confusion during this trial were about the three samples: The blue prototype, the red prototype, and the production sample. Now, you are completely correct that if the tailor didn't do the prototype right the tailor should have confirmed which route they wanted to go.

I think the defendant just didn't know how to explain what she was trying to say. I also sew, and what I gathered that I feel judge Milan missed is that there was no pattern to follow when they made the prototype from the tailors sample, which was cut differently than the pattern instructions he actually provided. Thats poor communication on the tailors part, and a lesson learned for the company to confirm these things before making such a grave mistake, even though the tailor had partial responsibility in the mistake as well. As the defendant said, the production sample is in fact just for the sewing, and the rest can be made and shipped without prior approval.

I also sew and the judge did not understand how the process works. It would be cost prohibitive to cut single samples after approval. The tailor made a bad pattern, he confused cross grain with straight grain and should have been clearer with his marking when drafting the pattern. The production company should have clarified that the pattern did not match the sample. Both are to blame IMO.

Also, I have *never* seen a pattern with markings on two sides. If someone gave me a pattern and I opened it and saw sharpie on one side, it would never occur to me to flip it over and look on the other side for pencil marks. They should have been clear with the client that the initial ‘prototype’ was not cut according to the pattern instructions written in sharpie OR they should have told her that she did not supply enough fabric to make the prototype according to the pattern. That was their mistake. It was not a mistake to cut all the fabric after approval and before a production sample.

What she was trying to say but couldn't get out is that they had a blue one already cut out, which is what was used to make the prototype. Which also goes to say that their cut out one did not match the pattern that was brought in, according to industry standards (regarding the grain). They are both at fault. They gave the company a different pattern for the prototype. The company should have double-checked since the patterns were different.

@@Call_Em_Yall Then you didn't understand the case. The plaintiff *loved* how it was cut for the prototype, therefore it should be cut that way. HOWEVER, they were supposed to make a sample, which they did, yet they did that sample AND cut the ENTIRE fabric before asking for approval of said sample. For some reason, they backtracked on what the plaintiff liked all of a sudden, which is what the Judge asked about, but they kept dodging it. The fault only falls on the defendant, hence why she kept going in circles. They knew they should've gotten the sample APPROVED by her first, but they proceeded to cut everything without permission. It's the whole purpose of creating a sample. And that's why the verdict didn't end up as the costs being shared, but the plaintiff winning everything instead. Because if BOTH were at fault, they would've shared the damages.

The judge is saying the defendant did the sample one way that the plaintiff loved and did the prototype a different way which she did not like. She wanted the original sample. The defendant was saying we alter the sample to our liking so we need credit. The prototype was the plaintiff original idea. But they told the plaintiff after they cut her fabric that she paid for the prototype. That’s a lack in communication which becomes the defendants fault. When they gave her the sample she loved that was their opportunity to say hey, we actually changed some things that will costs you more. Instead they made her believe it was her original prototype.

Take in consideration 1. She has read the complaint and defense and is aware of this entire case. 2. If she doesn't interrupt them, they start telling a long story about something that can be answered in a few words. Often a yes or no will do. 3. She only has a limited amount of time for each case, she has to shorten their stories otherwise they'd be there for many hours in each case. 4. I don't have a problem with her interrupting because I don't want to listen to either side's long-ass sob-story.

A big part of the problem is that when you say "grain" you usually mean "straight grain" which is why they said parallel with the selvedge. The tailor meant "cross grain" which is the line that runs perpendicular to the straight grain. It is like in wood, if you have the grain lines of the wood and you cut across them. He marked the CROSS grain as "G" and didn't specify that he meant cross grain. You usually don't mark cross grain on patterns, unless you mark it as direction of stretch on knitted fabrics. You usually mark the straight grain. He should have written words rather than "G". The pattern was amateurish honestly. They should have checked. They should have pointed out that they couldn't cut the prototype the way the pattern was written (or in this case, mis-written). They should have told her (ob. in writing!) that if she approved it, she needed to be clear if they were to do it the same as the pattern OR the same as the prototype. I suspect they missed it because frankly, the pattern is very similar to a pair of stirrup pants and in pants the stretch goes the other way. So it didn't seem weird to them that the stretch went around the "body" of the garment. The reason they didn't cut one only and do a single production sample after approval is that it is not cost effective and if a client wants that they should pay extra. Cutting a single sample out is expensive. I personally believe that both are to blame. I don't think the judge was familiar with production methods.

As a fashion designer I can definitely say that they cut the fabric wrong according to the pattern. That being said, the original seamster made it confusing by putting multiple directional arrows to begin with. Typically an arrow in bold marker is placed on a pattern to show which way the pattern is to be placed on the material, and the arrow will simply follow the grain of the fabric making the orientation of the piece correct. The small arrow with the G was signifying the grain of the fabric but totally unnecessary. The bold arrow was meant to show that the fabric should be cut perpendicular to the grain BUT this means that when the family turned the pattern the "correct" way the grain line (G) was now in the wrong orientation so it makes total sense to me that they would be confused. This case comes down to massive miscommunication and lack there of. I feel sorry for both sides because ultimately she came up with a fantastic product and she faced unnecessary losses - the family clearly has a lot of experience and knowledge that she doesn't have and were provided with misleading information.

But they seem like they are a successful business and I hope they continue to be successful. Her father getting easily offended might have cost them a huge contract. I'm confused. How did the prototype come out perfectly if they didn't understand the pattern? Oh well. Great product. She's going to be so rich. We need to invest.

The prototype came out correctly because she only gave the defendants a piece of fabric large enough to be cut the correct way. They couldn't turn it sideways to cut like how they cut all the other pieces off of the full bolt of fabric.

She talks so much omg it’s annoying. She doesn’t even let someone finish three complete sentences before talking.

In a more professional court with a real legal team the word "relevance" would be thrown around a lot here. The defendant was talking around answering the question at one point which the judge was getting annoyed with.

The judge is NOT allowing the woman in the red top to speak or explain AT ALL. Horrible. Kept cutting her off.
