It's the old "Something must be done!" mentality. With that mindset, you lose the ability to consider each option rationally, because you've effectively removed the option of inaction before even knowing the situation. When the option comes up to do "something", you've already decided.

an important lesson we've seen repeated ad nauseam. Paranoia when paired with Patriotism will always seek out the nearest weakest scape goat to villify and parade before an adoring public. Did you see how the media jumped on this and ran with it without any due diligence, all to get ratings, and now they sell it back to us once again as a horrible miscarriage of justice.

"Nah I don't think we have to turn it over"?! The Brady disclosure and other common law practices require prosecutors to disclose any evidence that may be used against a defendant and any evidence that could exculpate them.
@TonboIV
@TonboIV 6 жыл бұрын
The unfortunate lesson here: Don't trust police. Don't answer their questions. Never consent to a search. Don't physically resist if they insist on it, but say explicitly that you do not consent. If you consent, an otherwise illegal search can become a legal search, and the evidence can go from illegal to legal.

The prosecution and law enforcement did not make any mistakes in this matter. What they did was deliberate and knowing criminal activity. Everyone involved should be put on trial, those found to be incompetent need to be relieved of duty, those that had malicious intent in framing these innocent people should be publicly executed. There are few crimes greater than using public trust and police power to kidnap and abuse citizens.

I think the broader lesson is how the justice department thinks about crimes. Innocent people aren't going to ever become cooperating witnessed because they have nothing to cooperate with. It's why "coconspirator" evidence should be given so little credence. Your coconspirator is whoever you say it is or someone decides is. I can remember one murder conviction where the actual killer was told that he had to say someone was involved or his girlfriend was going to be arrested. The other person was completely involved, didn't even know him, and had witnessed that said he wasn't there. The actual murderer said multiple times he did it alone. All it took was the interpretation of the evidence by one "expert" who said there just have been two knives and suddenly he's on death row for years. That could happen to each and every person who watches this. "Go to jail for X number of years or tell us who you worked with and you get out sooner" and people are surprised that isn't reliable? Or even better "we will execute you if you don't say what we want", or "plead guilty and you can go home or spend a year waiting on lockup". The system is built on expediency not logic.

We have plenty of hearsay and conjecture. Those are kinds of evidence. - American prosecutors
@kcal1829
@kcal1829 6 жыл бұрын
While what these prosecutors did was egregious, it does show the good in the American judicial system. In other countries if they want you convicted, no amount of evidence proving your innocence matters. So the fact that after receiving evidence that brought doubt upon the prosecution's case, the judge did the right thing and overturned their conviction. That's one positive thing I can take away from this story.
