The husband of a Long Island doctor is taking Walt Disney World to court, alleging that his wife, an NYU Langone doctor, died after an allergic reaction to food she ate at a restaurant there. NBC New York's Pei-Sze Cheng reports.

Dr. Tangsuan was mine and my daughter's primary care physician. I had finally found an amazing doctor that was kind, professional and thorough, only to lose her after two visits. My condolences to her family, her practice family and other patients. This brings such sadness for negligence that could have been avoided. My heart is heavy all over again. 💔

With such severe food allergies, she shouldn’t be eating out or at least not trust a simple waiter. It seems like she lacked common sense which I’d expect from my doctor.

I am not sure we should EXPECT restaurants to provide guarantees for people with such allergies. There are some ppl who have to seclude themselves due to allergies. They should not expect the world to become a bubble environment. The waiter probably had no authority to give such an assurance.

I too have a dairy allergy and people tend to think that you're just lactose intolerant, and I have to correct them. I had somebody accuse me of being a Karen because I made sure they re-did my burrito. I said no cheese she slap a handful of cheese on it. I told her no I said no cheese, she just started picking the cheese off of the burrito. I told her, "You have to change gloves and remake that" she started arguing with me. I told her, "girl this could kill me" she accused me of being "dramatic." I asked for her manager got a refund and left. If you say you have a nut allergy everybody trips over themselves but if you say I have a dairy allergy people just think you're on a weird diet.

Yes this is soo true!!! 1. My daughter has allergies and people think I’m being a vegan, Karen, almond mom. She is allergic not just lactose intolerant or sensitivity. 2. I’m not allergic but a place kept putting cheese when I said no cheese. They made it 3 times and I said never mind I don’t want food from people who can’t understand no cheese 😢

I feel you but why trust that people care or that they can even grasp the severity of your allergy. Most people don't have food allergies so this isn't common to the average food worker. I used to work at a pizza place and a customer always came in with his own rolled dough because he was allergic to the bread that we made.

I used to work at a seafood restaurant and a woman came in with a shellfish allergy but wanted tenders. My manager told her sorry we absolutely can't serve you anything in this restaurant. I always like to triple and Quadruple check as a server. She was on Vacay with her friends and they all wanted to go to a seafood restaurant (knowing she had a major shellfish allergy) cross contamination is soooo real. Every restaurant should have a gluten/allergy free menu. I worked at an Italian restaurant too and this woman came in and she was allergic to so many things. She had to modify the oil the pasta was cooked in, the sauce it was tossed in, the kind of pasta it was, and the seasoning. It was sooo many modifications I had to cross my It's and Dot my I's and kept checking back in with the cook to EXTRA MAKE SURE her pasta was done right, it was sooo stressful knowing that someone's life kinda depended on me as a server. Even if a person requests no butter and the kitchen brings the food out topped with butter I will LITTERALY have them redo the order, most servers just scoop whatever off the plate and keep going. Even though you scoop whatever they requested not to be on the plate off the plate, still doesn't mean nothing. It's still cross contaminated with the item that you just took off the plate.

Thank you. I have celiac disease and as much as a alienates me I do not eat out because it is not worth the risk and my reaction isn't fatal. She is culpable for her decisions blaming a restaurant server is ridiculous unless the restaurant had signage promoting nut and dairy-free cooking this is a ridiculous and frivolous lawsuit

If you have allergies that severe--never eat out. The dish could have been nut/dairy free but prepared in a kitchen with nuts and or dairy.

Exactly. More than that, if you have such severe allergies, this menas they need to comoletely clean the entire kitchen. And change the cooking utensils so nothing is cross contaminated.

BUT IF COMPANIES ARE NOT COMPETENT TO UPHOLD THEIR PROMISE TO KEEP IT ALLERGEN FREE, THEN THEY SHOULD BE HELD RESPONSIBLE. ALL FOOD RESTAURANTS NEED TO HAVE STANDARDS. ESPECIALLY FOR PEOPLE WITH NUT ALLERGIES. I'm not even allergic to food but this is a stupid and basic comment.

Of course there was definitely dairy around in the kitchen and probably nuts too! A lot of the restaurants have a salad with nuts and peanut sauces. Ive ordered it so many times at different places so its common

Even if the item does not contain allergens, it may come into contact with other food or objects used to cook food containing allergens. Even if they listed every ingredient in every item they sell, it still wouldn’t be safe.

I working at restaurant all of my life, and I can say is, if you are serverly allergic to something which probbly lead you to die. Please please stay away dining out. We serving thousand of customer everyday, the kitchen is small, busy, and at peak hours, in order to make an dish for an allergy customer it messed up the whole kitchen. One again, kitchen in commercial is not at hospital, it is very hard to make sure it is 100% clean of something.

I once had a customer come in and say she was allergic to garlic. I worked at the Olive Garden. We told her nothing there would be nothing safe for her to consume. Not even the water. A cup could have been contaminated with garlic. She was upset. But who goes to Olive Garden allergic to garlic?😭 I feel so bad for this poor woman. Because she was told everything wpuld be ok. I hope she gets justice. Rip🥺

I manage Asian restaurant and i get customers that have onion / garlic allergies. Always tell them, almost 99% of the menu contain either onion or garlic and the only safe thing they can have is drinks. They get upset but I’d rather be safe than sorry.

Sadly, people dont realize that even some spices contain dairy and other allergens. As a parent with a child with a dairy allergy, I have to check everything! So to be safe, we cant take a chance by eating at restaurants.

I'll be honest... I have no problem trusting that restaurants here in Seattle are actually allergy safe when I say I have a dairy allergy. It's like that in almost every big liberal city because we have a lot of minorities who can't have dairy. But Florida? Florida is a mess. I grew up in Florida and would never trust anyone there to serve me food. You're paid minimum $19/hrs plus healthcare and dental here in Seattle to serve ice cream. Staff is trained to decontaminate properly and will only use freshly cleaned scoops, change their gloves, etc when serving customers with allergies. Florida has a culture of not liking to learn. They pay poorly. The healthcare there is SO bad. I would know. My mom is a doctor there, and she'll believe Republican conspiracies over wanting to research medical facts. She'll come up with the weirdest diagnosis. After my kidney removal surgery from cancer, she said my physical pain was because I had taken testosterone. (I'm FTM). When I go visit family in Florida, I do NOT eat out. It's likely she was unaware of how different it is in Florida. It's uneducated chaos there. To give you an idea of how bad it is... I would tell my mom my symptoms my entire life. Terrible cystic acne after eating pizza for example. Her response was that it hasn't been proven in literature so I was making it up and tried to convince me to eat pizza repeatedly until I finally lied and said the stress of eating pizza caused me acne. That is how badly doctors are trained in Florida when it comes to allergens. My friend came to visit Florida with me. He's allergic to lavender. My mom had no idea that was a possible allergen. If doctors in Florida aren't trained in allergies, do you expect staff to be trained?

Sad story. I would be terrified to eat out if I had a severe food allergy. How could you trust anyone to know with 100% certainty what the food contains, especially if they’re not in the kitchen prepping it. Seems too risky.

As harsh as it sounds, I don't think she should be entrusting her life to a waiter & a cook at a restaurant. That place is a glorified bar and those employees have no idea what's in the foods they sell. They don't keep dishes or pots and pans separate. The pan with the cream sauce with dairy is the same pan used to make marinara sauce (non-dairy). Those employees can't guarantee anything.

I agree, the risk is just way too high for cross contamination to take place. The kitchen in a restaurant is super busy and pots & pans are moving everywhere. Since most people do not have life threatening allergies, the kitchen is likely not focused on this issue. Not every single tiny ingredient of a dish is required to be listed on the menu. The wait staff are also not qualified to know these things.

@@kosmosbjm Sounds like the waiter was super confident in assuring her the food was fine for her, though. It's true that as someone with such an allergy you can't trust anyone. Lapse in judgment on both her part but also the waiter's. He should not guarantee anything that can't be guaranteed.

@@kosmosbjm Exactly. Half the time *I* don't even know the fully extent of ingredients in the foods I eat at restaurants. The only way I would would be in the foods I actually buy from the store because it lists them. Restaurants are usually very busy and mistakes, especially if they're not careful, can certainly happen. The restaurant was NOT her babysitter or caregiver. She should have KNOWN better if she knew her allergies were THAT severe!

I will never ever understand why people with severe food allergies eat at restaurants. Almost no restaurant is going to be able to confirm that food is safe for those with severe allergies. Even if the allergen is not an ingredient in the dish, the prep area or the utensils used may have come in contact with the allergen. Rule of thumb: if the restaurant has ANY dish that contains something you are severely allergic to, do not eat there. If the allergen is in the kitchen, there is no way to guarantee it won’t end up in your food.

There was this couple that had 2 baby kids almost and the parents said that that daughter are allergic to nuts(?) I can’t remember but the restaurant we were in is literally has nuts in the title. They requested a dish without one and the waiter is like wait-no no I’m sorry but we suggest not eating on the menu at all for her safety. The parents freakin risked it anyway!! I was like omg. Not only that but The kids kept running back and forth and dropping their baby bag and jackets, (waiters almost tripped on it too) parents don’t do anything at all just no consideration for others, and that really says a lot and I felt bad for the kids because I feel like the parents are doing this on purpose in order to make a lawsuit.

I worked in restaurants too. This incident could have been a case where a food expediter in the kitchen sent the wrong order to this woman. Her allergen-free meal could've been properly made, but given to the wrong customer. I any case, it's a very tragic incident, and I believe Disney should be held responsible at least to some degree.

This is true. She was on vacation she thought nothing would happen to her. After this tragic death . I hope they family gets justice and peace. Disney needs to change be responsible and hold accountability for passing of the doctor . Disney or any park theme and food chains needs to be careful with food allergies because if this tragic happen to a doctor I can't imagine for a child .

If a restaurant says they will honor dietary restrictions and health issues, you shouldn’t end up dead after eating because they were careless and cross contaminated a plate with other ingredients. Either the restaurant say they can’t do that or GET IT TOGETHER. Too many sloppy employees. It’s not that hard to avoid cross contamination if you pay attention. This was preventable. Awareness is needed!

Raglan Road is a Third Party restaurant. This is not going to to affect Disney at all. Also if you have an allergy this severe I wouldn’t recommend eating out at all. There’s always a chance of cross contamination no matter how careful a cook is.

This is horrible. I question why a doctor of all people would trust a waiter to know the ingredients and possible cross-contamination of all the food in a restaurant? That severe of an allergy is a disability and requires special care just as a blind person would need or someone using a wheelchair. It was really not safe for her to ever eat food prepared in a restaurant. Her poor parents and husband though. Such a devastating loss to her family and her community.

First off, as a waiter, you will be expected to know every ingredient that goes into a dish - you are supposed to, thats your job. Least that's how it was for me for every restaurant I served in. Having said that, he should not have guaranteed it because he has no idea if there will be cross-contamination (either by accident or laziness). Sadly if its that severe, I recommend not eating out. Its too risky.

@@tellurye If a server had to know every ingredient of every dish and how it was prepared there would be no servers. Dining out as we know it would be gone, limited to self-serve kiosks. The turn-over rate for a labor intensive low paying job is too high. People with food allergies have to be responsible for their limitations, not the people who serve the food.

@@nealeorinick1700 You clearly have never worked in the food industry. Im not talking McDonald's - Im talking high end restaurants and yes - I knew every ingredient in every dish. Most restaurants are very simple so it wasnt that hard. Most restaurants (the real ones, anyway) have 15 - 25 dishes and recipes arent that exotic. That's why when Gordon Ramsay rescues kitchens - he destroys their menu that have like 75 things on it. Narrows it down to about 20. My favorite at one of the restaurants was the Pasta Chardonnay - butter, garlic, shallots, salt, white pepper, heavy cream, chardonnay wine and fresh basil. 8 ingredients. Simple. You cant memorize that, I dont know what to tell ya. I do agree with you that folks should own their own allergies, because its impossible to control everything in the kitchen - even if they have a 100% sanitation rate.

It would be ideal for servers to know the ingredients in their dishes, but if they don't, they can ask the chef. I and my partner have some difficult to avoid food intolerances and allergies, so we always have to ask. I've never had a server who wasn't at least willing to go into the kitchen and double check with the cooks. In terms of not expecting them to do even this...that's ridiculous. Should they not do this basic courtesy and take things lightly and then, something disastrous like this happens, then they deserve a lawsuit and legal repercussions.

I'm 35 now and taking my kids too! My sister went for the 1st time ever in 2018 with her 3 kids and she loved, she then went again in 2022. She now wants to live in Orlando only because of Disney. She always say Disney is her happy place. She's been to other states and had a horrible experience unlike at WDW. No wonder WDW is the most visited park in the whole world. ✨💫

I feel a strong thing within me saying her husband did this to collect insurance money and he is trying to put it on the restaurant. She was a doctor. Something doesn’t add up here, and that it happened 45 minutes later, I read in another report. Strong feelings come over me that her husband is involved. I am sorry if I am wrong!

If you’re that allergic, you should carry two epipens at all times. I had an allergic reaction and they gave me an epipen dose, 50 mg of Benadryl and a bunch of prednisone at urgent care. I was also sent to the ER to be observed overnight. They said the symptoms can come back and if they do, they are worse the second time around.

If it’s life or death on what do you eat? You Should never eat out. Most cooks and servers are just trying to get through their day and not worry about the minutia every ingredient. Even certain ingredients you don’t even know if it has byproducts of wheat, nuts, crawfish, etc..

Something doesn’t add up here, why would a highly educated doctor, who had such severe allergies, potentially put herself at risk by eating in a public restaurant in a theme park. Surely she was aware of cross-contamination, that waiters are very poorly paid employees, and sometimes things happen in kitchens without people being aware of them. Haven’t you ever just even plainly been served a wrong dish or had something go wrong with your order. It’s more common than we think.

@@TruthFiction It is pretty easy as long as you clean properly and don't reuse. You never use something you just dirtied, ever. I do not know if you've seen an open kitchen setup in a very fancy restaurant but you'll notice how well the stations are set apart and although it obviously isn't 100% avoidable it is at the very least manageable. IMO I think it is a lot harder to manage a produce allergy than a meat / seafood allergy as you know we're supposed to take extra steps to prevent cross contam in the first place...

You can prepare your own food if you think that. It's not a matter of q clean kitchen or dirty kitchen. It's a matter of handling different ingredients and constantly cleaning surfaces. Some people make mistakes too or are rushed.

@@crescentcrab At the end of the day I'll still contend a great restaurant with a good kitchen system is a lot safer to eat at than any old diner. If you're going to eat out with an allergy make sure you go somewhere accredited and bring two epipens. I am simply saying that the level of unavoidable cross-contamination is not quite as large as what is completely avoidable. I typically trust sushi chefs a lot with allergies as many here are extremely accomodating to shellfish allergies and through this system of good organization and discipline it would be truly bizarre to see a mistake. Maybe American cuisine is just different and that I would not really be aware of, but there is a lot to be said for perfectionism.

I heard a Disney waitress who was also a classmate in my college class say that the most annoying thing about working there were the customers who had allergies. She then went on to say that they shouldn't dine out or just pack lunches because they're inconveniencing the workers. Fair enough to say that most waiters and waitresses don't take our allergies seriously, so it truly is a risk when dining out. I have tried many times myself to convey the severity of my allergies and still got a few allergic reactions that resulted in an immediate visit to the emergency room. Now I mostly eat at vegan places to be sure I won't get an allergic reaction. Truly sad to hear what happened to this lady.

As tragic as this story is, there’s no way to ensure the food has not been contaminated at all unless the server, food preparer, cook, and dishwasher are all one person. And even then, it’s not guaranteed. Every plate would be need to be scrutinized underneath a microscope to guarantee that kind of quality.

Disney is being sued because they're big. The restaurant isn't even owned or operated by Disney. They just have an outdoor mall where this restaurant lives, which is owned and operated by another company. Exactly what I was thinking, she was a medical doctor, she knew what to do and how to avoid things. If she used her EpiPen, and it buys time, why didn't they get her immediate help?!?

they were from NY on vacation in Florida, it's pretty hard not to eat out when you're on vacation and its really not a high expectation for a restaurant to be conscious about allergens, if anything that's bare minimum customer service

Having that anti allergen in her possession suggests the seriousness of her allergy. They should have not dined out but prepared their food. Restaurants can't for sure guarantee the allergens in the meals prepared....prepared using same kitchenware to prepare all entrees. Wait staff have no control in the food preparations..just my opinion With deep sympathy to her family.

​@yungphame I agree to some extent. It is hard to eat out while on vacation but, some hotels/resorts do have kitchens where you can cook meals so you don't have to eat out. If someone has severe allergic reactions to food, they should take extra precautions and book accommodations for hotels with a kitchen. I believe Disney has them at their cabins.

My first thought as well but then there's that report about the wife having ELEVATED levels of dairy and nut in her system. I took that to mean that the allergens really were incorporated into the dish and not added afterwards by the husband.

I have severe allergies to fish. If I mistakenly eat it the reaction is almost immediate. I can't understand how a reaction could be delayed for 45 minutes.

So she didn't eat the food at the restaurant? Was it takeout? Because if you're that allergic ,you usually go into shock immediately after eating something, not forty five minutes later. Thats exactly what happened to me when the nurse gave me my chemo. Literally in seconds. I couldnt even tell herbecause my throat swelled up that quick.i had to hit her with my hand to get her attention..Or did the husband do something and they are the scapegoat.

Her husband has a very suspicious face. 🤔 He is definitely not a doctor. You can tell straight away. I’m not sure how she’s ended up with him?! I hope the restaurant has many cameras near their table and police will be investigating. Too many strange things, elevated level of allergic ingredients in her wood, EpiPen which didn’t work, etc. Husband looks like that person who may enjoy some insurance money and the benefits from Disney lawsuit!

He gave to her something before they arrived at the restaurant -perhaps just before they left home (*her unsuspecting him*), is why there was a delay of 45mins. He organised & pre-meditated this.

A lot of waitresses and servers are lazy. They will not check to see what’s in the foods. They usually say they’re not sure and then don’t ever check to confirm for you. Restaurants do not train their servers and waitresses on things like this.

It's horrible for this to happen. However, that level of responsibility should not be put upon the waiter. Anything can happen in the kitchen that can make food come into contact with nuts or whatever else the doctor was allergic to. Signs should be put out that "every effort is being made to ensure that such and such food is not in the meals, however the restaurant does not bear responsibility". She could have been allergic to another food that she was just then experiencing an allergic reaction to. The waiter should not have said guarantee. I would have made the manager come over and tell the customers about the existence of certain foods in the restaurant. My son has a life-and-death allergy to peanuts. He will ask restaurant personnel about meal contents. However, he realizes that, in the end, it's his responsibility. I feel the same way. She was also a doctor. Her elevated level of intelligence should have made her aware of the potential for such foods in her meals. It's terrible she died, but that accountability should not fall upon others.

May she rest in peace. But I don’t understand people with these severe allergies, in which they could die going to restaurants. Yes, enjoy life and that’s the risk you take, but I wouldn’t trust someone with my life if I had a severe allergy. Unless you’re in the kitchen, seeing how they handle utensils, how they prepare the area, how they have the food stored I would not trust anyone to prepare my meal. Especially employees at an amusement park which are probably being paid minimum wage and are not skilled chefs/cooks.

Now that I’m allergic to everything, I understand how this must feel for people living with what I call this disability. Not trying to be a snob. Just wanting to eat like a normal person with what limited things I can have. Sucks to try to eat with loved ones and friends. Really, the worst kind of underrated disability

Allergen reactions can be so scary, especially when they affect your ability to breathe. If you know that you have severe allergic reactions to certain foods, you have to be extremely cautious about where you eat. Even the most careful kitchens cannot completely avoid cross-contamination, so it can be difficult to predict if you will have a reaction. I hope that Disney will consider posting a warning about this issue in the future.

The best thing to do when you have this problem is just don't eat out, sometimes you may get tired of cooking at home all the time, but unfortunately you may just have to eat home to be on the safe side, or go to a restaurant you know u can trust if that is even possible..

They cause an adrenaline response which reduces the symptoms especially closed airway, but sometimes the anaphylaxis can target the heart then you are screwed

I’m sure there will be a full investigation including the husband, and all staff. The waiter transports the food and delivers the questions to the chefs/cooks who provide them with an answer. It came from somewhere and such a sad story. My prayers are with her family and loved ones, I hope they get the answers they deserve.

I'm confused as to which allergens they identified. There is no way to say the food has NO allergens, but they can tell you if there are particular allergens that might be at risk.

I've been in shock 6 times ( 2 foods,/ 4 meds,) and I used an EPI pen and called 911. Each time I was given a drip. It's more than frightening when you have 20 minutes to live if not treated. I've never gone into shock after using an EPI pen and going to the ER.

No it doesn't. Within a few minutes of shock after eating something, a rash appears on the chin, upper lip and above. Not 45 minutes later.

As a former waiter, allergies are to be taken extremely seriously! I would ask multiple times if a table was sure they had no allergies. So negligent of the waiter and that restaurant

@@Sochi314 shockingly, people would often not tell us. I worked at a sushi place and the amount of people I asked the first time if they had allergies said no, then the second time I asked for confirmation would be like “wait! I have a shellfish allergy”. It is alarming that people don’t have the presence of mind sometimes to prioritize their own well-being, so at my establishment we took that on as a part of our role. We also had Benadryl in the office just in case someone had an allergic reaction. This however, wasn’t the case with this dr. She asked multiple times if allergens were present in the food she was consuming. If a waiter says “no” and doesn’t confirm with the kitchen, the culpability is the waiter’s. If the waiter DOES double check with the kitchen and the kitchen denies the presence of allergens when they are in fact present, then it’s the kitchen’s responsibility.

My kid has nut allergies and it’s a health risk also. Restaurants need to disclose what’s in the food. We had to go to ER after one restaurant still put nuts in the food. Can’t trust the food.

This is absolutely tragic and I feel for the family. That being said she was an highly educated Dr and knowing the severity of her condition I’m surprised she didn’t carry her own food. I have 2 grand nephews that have a very rare genetic disease to fats and their mom has to make everything for them. Not worth the risk to put your trust in someone else. What a loss.

I work at restaurants and it always stresses me when they have allergies because there is no guarantee especially how severe the allergy is. We try our best and as a server I do express my concerns. I pray her family finds peace

you can't be 100% sure if you eat out. People use the same cutting boards to cut cheese or vegetables and people dont' wash hands after touching one food at a time. I sure don't when I cook at home, why do you expect restaurant workers to especially when they are so busy. Use common sense people. Bring your own damn food if you have a life threatening allergy. this is ridiculous.

I think her death is little suspicious. 1. Does this restaurant at Disney World serve other many other dishes containing dairy and nut? what are the likely chances of the dish she ordered getting contaminated severely? 2. What was her relationship like with her husband? I'm only speculating but IF her husband didn't love her anymore and was cheating on her, then it's possible that he contaminated her drink with dairy. i.e. people's done much worse like the Australian mushroom killer lady(Erin Patterson) from last year.

Worked in the res. Industry for 10+ years. Whenever someone mentioned an allergy, I would relay to the manager on shift + chef in kitchen & line cooks as well. Manager would make sure to stop by table to clarify proper precautions and all that were taken… But also if it was a serious life threatening allergy like this, I would not risk eating out
