It's possible that Sherbourne has encouraged this, but I wouldn't be at all surprised if it's simply another instance of Harry going against advice. He seems to have a bit of a track record in that direction. I can't remember his exact words but he did say that this court case wasn't about the money or about winning but about highlighting the negative practices of the press. A KZbinr called Pluto, who is herself a lawyer, has said that lawyers do advise their clients against acting but cannot prevent them from doing so. If they continue to represent the client they protect themselves by drafting a document stating that they have cautioned him or her that they are unlikely to win. If Harry is determined and won't take advice then perhaps Sherbourne thinks that if it's not him, Harry will just get another lawyer anyway.

He/she must also be able to pass physical and mental tests. Harry clearly has mental issues and if the pilot became incapacitated I think he would panic. When the captain can no longer fly the first officer acts as P-I-C. Since Harry was unable to pass the qualifying tests he was not rated as a pilot. Sugar coat it anyway you like--Harry just could not pass muster. Ergo-he is not qualified to be a pilot unlike his brother, William who is an actual copter pilot. The difference between the two brothers is comparing a ginger whinger, whiney spoiled, self entitled idiot, Harry, to a true man with excellent character like William, POW and future king. Sitting in the copilots seat does not make you qualified to fly a plane or a helicopter.

@tonmarinaxxzz Harry's a British gunner for an Apache helicopter. They have very strict regulations on what actions the gunner can take & no he doesn't have to be a pilot. I'm not trying to sugar coat anything. He never passed his test .
