CORRECTION: The law will take effect on June 13, 2022, but in July as mentioned in the video.
Ohio Senate Bill 215, otherwise known as Constitutional Carry, has been signed into law by Governor Mike DeWine. Ohio now takes its place as the 23rd state to pass Constitutional Carry, which allows Ohio citizens to carry a concealed handgun without a license.

@@drowization the whole 3-4 hours of “class” wasn’t training. It was far from any kind of training. People can learn more in one 20 minute KZbin video than they could in the 3-4 hours of classroom reading of the nra pistol book. The most beneficial thing to the required class was having a lawyer explain what would happen if you did use your firearm in self defense. If you don’t like it, don’t carry. Plain and simple

Congratulations Ohio! While you may be tardy to the party - your presence among the guild of Constitutional Carry States is welcomed nonetheless. Arizona joined this growing movement back in 2010. We continue to protect and even expand our Second Amendment Rights as more and more people start to recognize firearm ownership as an inalienable Right. I grew up in Arizona. IIRC, you can't carry onto school property under your so-called "constitutional" provisions. Did that change? Oh, so I guess it's really just permitless carry but with infringements. Yes, we are still a long way from Constitutional carry anywhere in this country. Nice try, though...

After this law takes effect the first question a cop will ask is are you carrying a firearm. Ohio just joined 23+ states with constitutional carry and if you elect to renew your existing license it allows you to carry in states that have reciprocity agreements with Ohio. It’s all good for the law abiding citizen. The thugs don’t give a damn.

So I’ll ask as I’ve heard and read conflicting things. Previously we could open carry, but you couldn’t have a loaded firearm in a vehicle. With a chl you could. Sb215 makes mention of no loaded firearms in vessels. I assume that vessel to be a car, and the bill states the same rights as those with a chl permit. So what’s the verdict. Do I need to renew my chl or not to legally carry concealed (and loaded) in a vehicle?

The crazy thing is, even with this new bill passed, you cannot have a loaded firearm in your car unless you have an actual CHL. Unless I'm reading it wrong? Can anyone clarify?

Also having a license allows you to do things like having a handgun in your car in a school zone, correct? For picking up your child, or getting pulled over in a school zone. As federal law requires an actual license to be issued.

For now, handguns only. When people carry AR pistols, and if enough cops are on board with supporting the constitution and enough people peacefully don't comply, that should change soon. Maybe not even with all that it will change soon. You can't have a functional milita if you can't have a loaded rifle in your car.

I read H.B.-215 & to summarize as I understood it, What was legal with a permit is now legal for lawful gun owners though, my question is, With a C.H.L. One can carry within a vehicle though I am hearing horror stories! Is it not legal to carry concealed within a automobile? I was hopeful that H.B. 215 Would allow us to travel concealed without a permit but, I do not think that is legal even still?

What's the law, on Constitutional carrry/CCW on having a firearm (handgun) in the motor vehical while in motion? Does it still need to be stowed away the same as the old law or current, with the magazine taken out and put in a different container the driver can't have access to?

Question: How does this effect carrying a handgun in a vehicle. From what I remember in the past, a person in a vehicle (without a CHL), had to have the handgun in an immediate inaccessibility part of the vehicle AND have the ammo stored in a separately. Can a person have a loaded handgun readily accessible in a vehicle?

Hi I work at a group home as a care giver, I was very excited about the constitutional carry bill passing etc. Bit since a bout two weeks ago the company I work for has been giving us forms to read that company policy prohibits any staff from storing fire arms in our vehicles at work. I believe Ohio Senate Bill 199 back in 2019 is still in effect correct? Where it protects employees to be able to store firearms in vehicles on work property.

I would assume so. Provided that the gun stays in a car in the parking lot, it’s perfectly legal to the best of my knowledge Edit: you cannot store firearms in a company vehicle if the company prohibit it

So after this goes into effect, if I as a non permit holding Ohio resident have a concealed firearm on me in my vehicle and I am about to cross the state line into Kentucky, where as I understand I only have the right to open carry as a non state resident, would I have to pull off and unload and separate the firearm in my vehicle before crossing the state line?

No, you don't. Open carry was legal. But if you got in a car the gun had to be empty and stored in certain conditions. With a CHL you could legally carry loaded in the car. If there are no requirements to have a CHL to carry concealed in public, there's clearly no requirement for in the car otherwise this law does literally nothing. Previously to be legal I'd start by putting my gun in my holster, loaded, as i carry and as one should. I get to the car. Empty the chamber, drop the mag, glove box and center console for them. Before I get out to go in a store, reload it. Of course it looks suspicious to be loading and clambering your gun at the gas pump in your car before you go in. So now I'm doing it while driving which is dostravted driving, and having a loaded gun in the car. You had to do all this even if you open carry. As soon as you get in the car, same process. If you want to carry in a tactically sound way, and legal, this is what you have to do every time you get in and out. Meanwhile, the criminal doesn't care about these laws.

@@Sheridantank I think because it’s being compared to having a CHL and no one is talking about that you can’t carry it a vehicle still loaded. That is going to be a huge problem for people because they didn’t read it or knew that there’s a difference. No one ever leaves their house without getting into some type of vehicle.

Pretty sure its same as it is now with a license,its same deal,just dont have to do training or need a license.....the only reason you would need an actual license in a car is when you cross state lines,from what ive looked up other states that are ohio license friendly,will still want to see an actual license,they wont accept constitutional carry,you would be breaking the law without a license

@@hydrocutty you need to read it again. When they are talking about cars they are calling it a vessel. And then it will tell you that you cannot have a loaded firearm in a vessel. This is exactly what I’m talking about of it being a problem because people think it is going to be the same as having a CHL, and it’s not.

I live in Ohio but will be traveling to Tennessee I know that Tennessee and Kentucky are constitutional carry states me being an Ohio resident will I be able to carry in those states without a CCW?

No you can not. If you read it it says you cannot carry in a vessel. They’re using the definition of vessel for any moving vehicle.

@@homelanddefender So, are you saying that under this new Ohio law, a person can only carry a concealed firearm 'at' a location, not 'to' a location? That makes no sense at all. For most people, that would mean they may only carry a concealed weapon at their residence. Please clarify. I'm not sold on your interpretation, if that's what you're saying.

@@InnerCircleUS and look it up and read it for yourself that way you can see what I’m talking about. You’ll see where it says that you can’t carry in a vessel. Thursday second part of the document towards the end, it says you’re not allowed to carry a loaded gun in a automobile. With a CHL/CCW you can carry in any type of vehicle. They’re using the word vessel for any type of vehicle. There is talk that that is getting removed before it goes into law. The major problem is the wording is still there. (2) Divisions (C) and (D) of this section do not apply to a person who transports or possesses a handgun in a vessel and who has been issued a concealed handgun license that is valid at the time of that transportation or possession

Yes train. But also yes carry. Firearm safey is easy enough for a child to learn as far as handling goes. If you can hit a dinner plate from 10 feet every shot, and know firearm safety well, you're proficient enough to hopefully never have to defend your life. Imagine leaving your gun at home because you can't shoot a mile away just to have someone take you out with a knife when realistically you're going to shoot 3-6 times, or more, miss half or more, and hopefully drop the thread. People get decent at shooting and think they're pros or are so goof at things that the only way someone can be as good as you is trsin train train. When you don't need to be a marksman to defend yourself. It helps, absolutely. But take it down is all I'm saying.

A responsible gun owner who is going to carry in public should know what ever they are carrying inside and out. A lot of people are looking to play cowboy and that could get them or other people hurt

I had a question, a general question and when I reached out to ask I was quoted 500 dollars to have my question answered. Ill go ahead and ask it again in hopes to have it answered as it seems pretty simple and I wouldn't need representation for it like I keep being told when I emailed about the question. I live in Columbus Ohio and dont have a criminal background, I only have a minor misdemeanor possession of marijuana charge and possession of drug paraphernalia charge I received when I was 17. I was charged as a adult, completely probation and paid my dues. Will this prevent me from OWNING a firearm if I bought one privately from a retired marine. I don't have a felony or any other charges especially no violent crimes. I'm just curious as to if I can buy a firearm to keep at home for self defense is all. Pretty simple question but I can't find the answer no matter how hard I look. None of the definitions or outlines adhere to my situation. Thanks again for your time

And that's the information I was gathering was saying but I just wanted to be a thousand percent sure because I didn't know for sure.. so again thank you so much for clearifying this for me. So I can lawfully "purchase" a firearm or "own one I purchased from a private seller" but couldn't concealed carry it correct? The marijuana charge WOULD give me a disability as far as concealed carrying was what I was reading? Does that mean I can "open carry"? As long as it's not "consealed carry"?? And they passed and just signed constitutional carry in my state as well.. so with the new laws going into effect as of Monday does that mean I still can't cousealed carry from now on? I was confused on that as well because it says 21 and up with no felony or violent crimes.. basically if you can lawfully own a firearm you can conseal carry it now.. would that apply to me now too? Or am I limited to just owning at my home, or even open carrying?

My reasoning is based on a general knowledge of implied consent and voluntary agreement in advance, and that is essentially what made the prior duty to inform requirement lawful; because CHL holders did agree to abide by those requirements in advance when voluntarily obtaining their CHL. But now that the "qualified individual" standard exists, how does this compelled speech obligation impact individuals who might not have provided informed consent by obtaining a CHL? In a simple scenario, a driver is stopped for a nominal traffic infraction and during the course of the interaction, invokes their right to remain silent; declining to respond to any further question beyond Name, Address, DOB, or a request for required operating documents. If the individual does not possess a CHL and is carrying what is otherwise a lawfully concealed firearm, what lawful obligation might they have in contrast to their individual rights to be compelled to answer or potentially incriminate themselves?

A Prohibition against “dangerous ordnances” cannot rightly be called “constitutional carry”. It’s a joke that this is even called constitutional carry. If anything it confuses people or convinces them that constitutional carry means that they can carry a pistol for personal self defense without a permit. That’s some stupid shit right there. The 2nd amendment has nothing whatsoever to do with personal self defense.

I'm in Ohio and my CCW license will expire at the end of the year... My question is should I spend the money to renew it since I don't need it to conceal carry anymore..?

Yes you should, that was you can still carry in you car. (2) Divisions (C) and (D) of this section do not apply to a person who transports or possesses a handgun in a vessel and who has been issued a concealed handgun license that is valid at the time of that transportation or possession

It can't be. If so, the law changes nothing for anyone who drives and this entire bill is an insult. Under the previous law, the gun must be empty and and mag in a separate compartment. The compartments must have separate accesses and some closure method (velcro, snaps, zipper, etc,). Most do handgun glove box, magazine center console. Technically the gun can be in a pencil box and magazine in your pocket because it's not a firearm. They can be in separate parts of the same backpack. You could open carry under previous law without a permit. But as soon as you get in your car you need to unload the gun and put it away. You should carry chambered for many reasons (I'll get into if you're not sure). So that means every time you get in you're unchambering a round and dropping the mag. If you're going to carry, carry always. So when you get to the store you're going to want to reload it and reholster it. Do you do that in the parking lot? That looks suspicious in your car. While you're driving on the way there? That's distracted driving and looks suspicious. Under previous law there was no practical way to carry, open or concealed, without this ridiculous unnecessary burden that makes your ability to defend yourself less, but also increases the chance of a ND by pure odds of times handling the gun, and chances causing problems with the round being chambered again and again. So in my opinion there is no way they can keep the vehicle law and the new law. Theyre in direct conflict with each other. Sorry for the paragraphs

It goes into effect *June 13th* it takes 91 days for laws to take effect due to the 1day is statutory. Constitutional carry done away with the need to get a license its now optional but you must still follow the ohio concealed carry laws. When entering premises, school zones. Liquor establishments, ect. My understanding of the law is you can carry in a vehicle with a loaded firearm as long as your a qualifying adult, you must notify if asked if your carrying at all stops by law enforcement. Anyone who will be carrying should still go get a book from the sheriffs or download it from the Ohio Attorney Generals website its not the full law or orcs text, but has some great information thats useful. Still a good idea to get a license if you travel outta state and know there laws before you go. In ohio we don't worry about different city laws concerning concealed carry or open carry. But Very aware other states have different laws like PA, SC, and city laws for some reasons restricts zones or mag cap ect its complex other places and a mess so do your homework or call a sheriffs office there or Attorney before ya carry. *ohioccw.org/* *www.ohiocarry.org/* has some great information *always double check the information is up to date* I'm not sure but would guess the constitutional carry in ohio would only apply to current residents of ohio which means if outta state to carry you would need a CHL but I haven't dug thru the whole bill signed into law yet and I'm not a lawer someone like Derek would be the best person to email or call.

So if you have a valid CCW license you don't have to get the standard background check? I've asked a few gunshops about this as I've heard this before and they all said they still had to run checks regardless

Heard it depends on the shop. Some do some don’t. For instance my Rural King always runs background but my LGS just uses License. Asked Rural King about this and said they had few instances where people used they’re License, but had actually done something wrong after it was issued.

They run the background check to cover their butts. There is only one shop in my area that does not do the background check if you have a CCW.

Thats the chl license holder issue and sheriffs issue not a business. *READ THE LAW* the sheriff shall have the power to confiscate, suspend, revoke, issue, all chl license if deemed appropriate. And in the law there is a you must surrender clause for a reason. If someone presents a valid license for purchase of a firearm the seller is granted immunity from prosecution under the law if they follow the orc on using a chl for firearm purchases. Does anyone not read anymore or research anything....

That`s because the ATF when visiting FFL`s has been telling them them to disregard the law and run a check any way. Most are going to run the check to avoid the invisible hand of the law.

No you can not. If you read it it says you cannot carry in a vessel. They’re using the definition of vessel for any moving vehicle.

As far as notifying, I have not been asked about guns specifically. I have only ever been asked "do you have any illegal weapons" I've never had anything to hide, but per the new constitutional carry law how would you view this wording?

Before this law and up until it officially goes into effect in June, it has been a requirement that you must "promptly notify immediately upon any lawful stop." If you weren't doing that, you are breaking the law. But, to answer your question, I would say, "No, I don't. But, I am currently in legal possession of a firearm. "Of course I am only speaking for the state of Ohio.

So what if I was in a scenario, where I got pulled over for my windows being to dark with a unloaded firearm in my center console with a loaded magazine in the driver side door when the officer asked me if I had any firearms in the vehicle or anything in general he should know about, I said yes sir I have a firearm in the center console and it is not loaded then he tells me to step out of the vehicle and puts me in the back of his car and searches my car and finds the magazine in the door he gives me a warning on my tinted windows and confiscated my firearm. Without a chl keep in mind I had an appointment 2 days later at the sheriffs office to get my chl what could I do to prevent getting a felony because of this situation? I also have a clean record
