On Triple Talaq Bill, Government, Opposition Clash Again

A fresh bill to make instant Muslim divorce or "triple talaq" illegal, which got stalled in the upper house of parliament and lapsed, was introduced in the Lok Sabha today. The government countered the opposition's claim that it was a "discriminatory" bill by pointing out that the Supreme Court's order banning the controversial Islamic practice needs to be followed up with a strong law. "...There have been triple talaqs since 2017 even after the judgement. What should the women do? Hang the judgement on the wall?" Union Law Minister Ravi Shankar Prasad said after introducing the bill in the Lok Sabha. The Muslim Women (Protection of Rights on Marriage) Bill, 2019 will replace an ordinance issued in February by the previous BJP-led National Democratic Alliance government. The bill had failed to clear the Rajya Sabha test earlier.

really ? there's no concept of Divorce in Hindu faith, yet they are forced to follow Anglo-Saxon divorce laws. Hindus support it because it's fair. No regard for hindu personal laws eh ? If a hindu women complaints about a husband leaving her, it is perfectly trialed in courts. Now muslim divorce laws do not allow that, they need to be tried in islamic courts or whatever they are called. So the state is taking the victim side of an uneven play field. TTalak law will be repealed the minute UCC goes into effect nationwide. This is a stop-gap.

Hari R. Hope u study the conviction rate in dowry harassment cases. Almost 85 Percent cases are leading in acquittal due to false implications after a lengthy trial of minimum 5-6 yrs. Who will get their time back. Lakhs of cases ended in acquittal since Dowry prohibition enactment. This laws are enacted on a wrong notion that Men is always a criminal.. society has changed women are so empowered today. At least, they would have addressed the misuse of it. So husband leaving his wife by saying Talak is mere act of desertion. Now! Act of Desertion is a civil offense, punishable by law upto 1 year. If anyone deserts his wife he can land into jail. This bill will make saying talak a criminal offense, punishable upto 3 years. That means desertion by a muslim guy will land him to jail for 3 years, where as desertion by a hindu or Christian will land him into jail for 1 year. So is it equal? Isn’t it discriminatory? Law only act in case of dispute and if there is no dispute then whats there to worry. Supreme court only called it void when dispute come to court but what about personal law. If one is interacting with personal law board only then court decision is of no use.

My personal perception/interpretation (It may be wrong or may be partially correct)-- Bjp exactly knows that few of the bill clauses are too much biased. They are deliberately creating a debate and ultimately they want this bill to pave way for uniform civil code. Just like shashi tharoor said universal law for deserting wife,BJP is smartly playing to bring UCC on table. Few years back before SC judgment Muslim personal law board never objected publicly to instant triple talaq which now it's calling unislamic. We can see the change in course of debate from shaira bano case to 2017 and now in 2019. Thts wht they are trying.Put a biased clause when debate starts as a compromise bring on uniform law..It's win win for both govt and opposition. --Opinions are personal not to be taken for absolute fact --

Mr Ravi you are given authority to make law doesn't mean you make anything not consistent with the constitution. You should have given rebuttal for each point raised by opposition. Discussion of each point of the bill is the part and parcel of making the law..you can't just type anything and just said let the court decide the constitutionality of the bill. I think India has more important issues than talaq.. children are dying, water scarcity, doctor's security, etc.
