Agreed. If we ever get the NFA repealed, or at least partially rolled back, there's no reason why the ATF shouldn't be done away with, and what small amount of gun enforcement we need can be rolled into the FBI. The problem with the ATF is that it needs to justify its existence, and therefore has to constantly be making noise about issues, I'm sometimes literally creating crimes out of thin air. If Firearms enforcement was simply another department in the FBI, every gun law wouldn't become some kind of existential crisis for 10,000 government employees

tsafa I would say that there is no possible way to utilize and detonate a nuclear weapon without seriously threatening someone's right to life and liberty. I could jump in a m1 Abrams with a few buddies and practice fire without hurting someone. With a Nuke there is nowhere on u.s soil to safely detonate.... A nuke is also a non discriminating weapon where as tanks, artillery, and such are not.... But I also think nukes are the worst weapon humans could have possibly created and I think that no government should even have access to them.
@taestr73486 жыл бұрын
Well the thing is that from your definition, we all have a right to ordinary military equipment. So, tactical rifles and automatic rifles that are given in boot camp would probably be some of the few. A right is something that cannot be given or taken and gives you free will. Need is a relative term to someone's life and describes what is desired or thought to be required.

We technically are all enlisted and contracted( at least able body males) we all sign up for the selective service(draft) and pay our taxes so we are very well regulated. They get confused with the first part right from the get-go! "Well regulated"
@vercingetorix38396 жыл бұрын
Because they emphasize "well regulated Militia" and misinterpret what it means. Well regulated in 1791 meant well armed and well trained. Likewise, if somebody is capable of fighting, then were considered to be a part of the Militia. But people misinterpret "well regulated" with the modern usage of the word, where Congress has the power to "regulate" an industry. And they misinterpret "Militia" as being the National Guard and "the right of the people" as a collective right. Hence why they believe the 2nd Amendment guarantees the right of the States to form a National Guard.

The term "arms" has historically been defined as weapons used by military forces to conduct warfare. That was the going definition at the time the Bill of Rights was signed and adopted. At the beginning of the Revolutionary War, most cannons used by the colonists were owned by militia, and property of private citizens. When General Gage attempted confiscation at Lexington and Concord, they weren't just collecting handguns and muskets; they were coming to take their powder stores and their cannons. So this shouldn't even be an issue of carrying a tiny pistol openly or concealed on my person...WHERE ARE MY CANNONS??

@peaceblessings45126 жыл бұрын
I wish supporters of the 2nd Amendment would get behind this argument, that “Arms” doesn’t just mean small arms- or guns. The “original intent”, to secure s Free State- requires the Militia of the states be exempt from all manner of gun control. Older dictionaries, legislation to regulate state militia, writings- indicate Militia Arms were weapons of war. The people didn’t keep their weapons in an armory, they kept them at home. Original intent today would include what the federal Armed Forces have access to. Full auto firearms, belt fed weapons, tanks, fighter planes, rocket propelled grenades, missle launchers, drones, ect.
@peaceblessings45126 жыл бұрын
Another problem, where is the training of us “unorganized Militia”- which is what the 1903 Dick Act implies we are? Why are the State Legislatures and Governors not doing their job like they use to? Gun Control proponents argue about the 2nd Amendment being for the well regulated Militia- well here we are, the Constitutional Militia- which is a huge reason we have guns. Honor the original intent, so we can secure a Free State.

Is an RV a home ? But an RV can be driven or hauled. Thing is the second amendment is a right. We do not need a permission slip . You have the right to life , liberty and the pursuit of prosperity. Protecting that life , liberty and pursuit is the reason for the second amendment .

You mention a very tricky subject, of course, ya know rights and all it shouldn't matter but day to day it does. This is something many have dealt with in particular truckers. Truckers get robbed a lot and want to be armed when parked for the night. I'm no expert, and it's going to very a lot from state to state but in general my understanding is. When traveling or parked on the roadways it's a vehicle and vehicle rules apply. When parked on private property it's a home and home rules apply, or the rules of the property owner of course.

I didn't buy my first firearm until last year when I turned 34, because before that, I lived in Illinois in both Cook and DuPage counties (Cook is Chicago, DuPage is SW suburbs of Chicago). Getting a gun there legally was so confusing and intrusive that instead I just learned how to make my own black powder and homemade black powder guns, as that was easier and significantly less intrusive. I then moved to South Eastern Washington, and I bought my first firearm (before I-1639 took effect). It was so simple. I applied for a concealed pistol license at the sheriff's office, got it about two weeks later in the mail, then walked into a gun shop, picked out a pistol I liked, filled out the form, showed my CPL and driver's license, had a quick background check, paid them, and walked out the door with my first handgun and a 50 round box of ammo the guy tossed in no extra charge as a "welcome to America" gift (I had told him about living near Chicago). Took about 15 minutes. I haven't bought a suppressor yet for my AR-15, because first, they cost more than my AR-15 (which I had to build over about 8 months to afford), and then there's all this NFA bullshit around them, and I'm finding myself reliving the trauma of living in a communist shit hole like Chicago all over again, and am very tempted to just hand craft my own. I can measure, I know how to use a drill press, and I know how to weld. It would be effortless to build one, but then there's that whole felony shit of doing such a thing, and I feel both trapped and violated. Anyone have any suggestions on how to make buying a suppressor as painless as possible? Like step by step instructions? I may have an I.Q. of 148, but reading legal stuff makes my head hurt and want to strangle whomever wrote it. I just want it in plain English like the Bill of Rights is written. Seriously, taking calculus and maintaining a B average freshman year of high school was easy compared to making heads or tails of gun laws. None of it makes sense, like it was written by a thousand shit-flinging monkeys devoid of all logic and reason.

A "well Regulated" militia is one armed with current weapons appropriate to the task. This means M-16 rifles and the like, large cap magazines, select fire, etc....
@snek93536 жыл бұрын
I completely agree, there's a simply logic that even works with SCOTUS precedent.
@dbod98156 жыл бұрын
Logan Waltz - The term "regulated" as it is written does not mean exactly what you might think it does. "Well regulated" according to constitution.org/cons/wellregu.htm ; "It referred to the property of something being in proper working order". Examples: well regulated appetite, well regulated mind. For a militia to be well-regulated; or "in good working order"; it has to be armed with current weapons that are in common "militia" use for the period such as: muskets originally and M-16s and the like today. The "unorganized" Militia existed prior to the US Constitution. Congress used it's power to organize the militia; that happened later. However; Congress has no power to disarm the unorganized militia that the prefatory clause of the 2A protects specifically. Nor does Congress have the power to restrict the arms of the people; rendering the people useless for militia service; essentially eliminating the unorganized militia. The Anti-Federalist thought that everyone who could handle a gun should have one and that this would be our ultimate safety against invasion and a tyrannical government. The Anti-Federalist were afraid the Federalist would disarm the people; that is why the the 2A has a prefatory clause stating one huge purpose (not the only purpose).

The free states need to rally for the rights of the oppressed states. The popular response has been "move to a free state" and I have previously held that opinion myself but have since realized that these oppressive laws are infectious and can spread(politicians are well aware of this) and metastasize into the free states as well. That is something I would personally like to avoid. Federal law on 2A must be upheld even in the most anti-gun courts

The virus is spreading to free states. Look at Florida for example with the bump stock ban, ban on selling all firearms to persons under 21 and the red flag laws and the out right ban on open carry with the exception of hunting fishing camping.

dress the part and you won't disturb anybody. if you've got a gun dangling from your jeans half covered by a joke-tee shirt, you'll get looks. but if you're carrying in a proper holster, wearing proper clothing, and carrying yourself properly, people will just assume you're supposed to have a gun

Self defense is a right and responsibility for adults. 2A supporters have been on the wrong side of the open carry movement labeling it for nut jobs. Open carry should have been the standard all along. I would much rather open carry then have to stuff an uncomfortable hunk of metal in my pants, let alone worrying about my concealed weapon becoming unconcealed accidentally.

I'm still concerned whether certain states will even acknowledge this. I personally open carry for my own reasons, but I recently learned that we had to have a license to conceal and open carry pistols in Georgia. I was just fired from the Sheriff's Office recently because of Antifa (That's off topic) but still, I didn't even know that and I worked for the Sheriff's Office. I thought we fought a war 150 years ago over States vs Federal laws and rights. I'm pretty sure Federal law trumps State laws. Also, why does any government have the right to tell me what firearms I use to defend myself with? On top of that, why do so many states require that I have a license to carry a pistol?
@codyphillips486 жыл бұрын
howie3601 at least you have the option to open carry. Florida has out right ban on it, unless your hunting camping or fishing.
@bryanw45826 жыл бұрын
howie3601 actually, the foundation of our government is to allow states to govern themselves and the federal government should only step in for extreme circumstances. Governing should always be at the lowest levels, not the highest.

The right to self-defense is a fundamental human right; therefore the ability to possess and carry the weapon(s) of your choosing in order to defend yourself/others is also a human right. The GOV has no legitimate authority to interfere with that right (with VERY few, and extremely specific circumstances). How have we let the GOV have the power to control how long our weapon is, how loud our weapon is, what type of "furniture" we attach to our weapon, the rate of fire of the weapon, caliber, flash signature, magazine capacity, etc? Heck, we have even let the GOV dictate (in some states) whether we are "allowed" to possess or wear body armor! The bottom line....Less GOV = More FREEDOM!
