@bunnielynn777 I never said either parent does not love this child, but they are putting their own wants and desires ahead of his actual needs. The mother is pushing so hard against the father (not sure she doesn't have legitimate reasons), but she did so to the point that she ended up setting "the system" against her, worsening the situation for the child. In law, she had no more "rights" toward the child than the father. It is awful, but parents put their children in harms way for substance issues every day. Our system does not allow the other parent to keep the child from that parent of their own volition.

Something that bothers me is that the father clearly smoked weed behind the wheel in the parking lot. There’s nothing to suggest that he walked home which means that he was driving high. He clearly has no sense of good judgment and can’t be trusted to put the health and safety of others above his need to be high. This court is definitely punishing the mom for her complaints about the judges and the court should be held to account for that. Also, I don’t see dad being overly eager to plead his case or change his ways which makes me think he is a pawn in someone’s else’s strategy- probably his mother. I will bet money that grandma wants custody of the child and is using the dad to make that happen. If I were a citizen of this town/county I would be watching Josh carefully- watch for him to leave a bar for instance and then call him in as a possible drunk driver. If he goes to jail the mom can then petition the court for custody again. Regardless, this whole thing seems punitive against the child’s mother

I have an idea, be a real father and not just a sperm donor. Put your son first and lay-off the drugs and alcohol. Two rehabs, DWI as a highway Truck Driver, 3 failed court ordered drug tests and 5 open domestic violence and assault charges. Anyone interested, please check out Mr. DiCillis career, this guy has already had his law license suspended by the State of North Carolina. These two clowns are meant for each other. This case has been handled by complete morons that cover each other and focus on the issues that don’t matter. This new judge has an opportunity to finally make things right, but based on the skill level of her coworkers, I have zero confidence it will be done. This is only the 2nd comment I have posted in 3 years, but enough is enough and this organization needs to be held accountable. Lastly, a request has been made for Elizabeth Trosch, Head Judge in Charge, to attend the next hearing to see it for herself. No response to date. Everyone is responsible for their actions and her hiding behind her robe and team members is the wrong move. First and foremost, Trosch, do the right thing for the child because he is responsibility #1. Tighten up your team and make the accountable for their actions. Judge Smith showing up at the last hearing was not only wrong, but a conflict of interest. He should be fired on Monday morning. Using drugs in the state of North Carolina is ILLEGAL, pretty simple and easy to understand. Now to have any child test positive for drugs at this level and you and your team to just brush it under the table, should cost you your career. Run this by the Sunday dinner table filled with your family lawyers and see what response you get. This is against the law, and was outlined by the lab expert, but yet nothing. Don’t be the dumbest person in the room, step up and be the smartest like your voters expect.

Need more info. How long did the mom keep child from father? That seems to be the issue. She should have gone back to court. She never once said….he needs help to be a good father….she only wants sole custody. Sole custody should be the last option….joint physical custody should be the standard. Yes, he should lay off the weed. Yes, they all need drug testing and counseling on how to coparent. But it seems like her biggest error was alienation. And I’m glad the courts are not tolerating that. And I hate courts! I hope he is a good father and they can learn to work together for their child.

I understand the desire to protect your child from harm. He's so little and defenseless. It's understandable. However, pointing fingers at each other won't ever bring a peaceful resolution. When you decide to forgive and work together, each of you can benefit. I understand things of addictions and some addictions are quite honestly, less threatening than others. Some substances invoke a more angry behavior. But There might be a possibility for healing when you show compassion and love rather than hatred. @jamesdrake; this country is driven by honest and accurate data and policies. Just wanted to highlight a couple of things; 1.) Nothing is hidden and not shared 2.) The death penalty - Some states have it and some states don’t. If a person murders 3 people, the outcome in one state may be death and another state make be life in prison. 3.) Now to the matter at hand, in the state of North Carolina, marijuana is illegal and definitely unacceptable to be at that level in a child, come on man. 4.) Furthermore, if you fail a drug test at work in this state, you get terminated immediately. 5.) In North Carolina, if you get caught with a pot pipe and zero dope, you get arrested on the spot. 6.) Lastly, and again, for dope to be detected at any level in a child, you should be hung by your balls and whipped in the town square. Come on James, this isn’t a 12 year old, a 15 year old, he is 3.5 years old. That is pathetic and unacceptable anywhere in the world. Thank you sir.

There is much more to this case and it’s in the previous two reports. I’ve linked them below. As far as hair tests being junk science, they are relied upon daily by courts, DSS, drug rehabs, for example, to establish use. Courts recognize them as valid still today. The arson determinations made by many arson experts have been revisited and overturned on appeal. The bullet lead fragment matching, the footprint matching, the blood spatter analysis all have been debunked. The amount of discredited physical evidence techniques is disturbing. Winning it seems is more important than justice in many instances. What I can't understand in this case is why in heavens name the custody of this child cannot be sorted out like so many others. This child is a victim of sorts in my estimation. I have been following your work since your days in Texas and like your work. Thanks
