I am almost 59. I had a massive heart attack almost a year ago. Three stents at the time, another one month later and then a fifth stent six months later. I just retired early from my job because I couldn’t do it anymore without chest pain. I have 100% permanent disability with the VA. So I now plan to apply for SSDI.

I found this video very hopeful. I am 61 and have just filed for disability. I have worked for the same company for 30 years. I have underwent spinal fusion in 2017, and have been on work disability since 8/1/2023 for total right knee replacement. I did have a sitting standing desk type job until they eliminated my position, and they put me back to the factory floor doing production work. I went back to work on 1/8/2024 and only lasted till 2/2. I bulged a disk because I could not push and pull the 200lb rack I was required to work with. I could not bend over to pick up pipe i worked with. I cannot stand for more than an hour before the pain is too hard to deal with. This was the easiest job in the factory. They do not have light duty positions where I work. My orthor doctor has since pulled me back out till 6/3/2024 to give my knee more time to heal. I do have an old associates degree, 1990, but I can no longer sit for long before my arms get pins and needles and I can no longer stand for more than an hour before my legs and feet get pins and needles. Grid rules. In a lot of cases, you only need a light RFC at age 55. That catch is that if you have light or sedentary work in your past 15 years, SSA can still deny you saying you can do your past work. For example, an accountant might have a problem since their past work is sedentary. This is where having a moderate mental RFC can help you. A moderate mental will eliminate all skilled and semi skilled work such as accounting work.

This is not true. You can still be found disabled for physical issues if you worked a sedentary job only. If the accountant has hand and wrist issues possibly from her long career of sedentary work she could still be found disabled if she can no longer do that past relevant work. Also she could have back problems and or knee problems that will not let her sit for a length of time to be able to do SGA. Anything can happen during everyday life. Even to a office worker. A car accident could mess her up and make her disabled enough that she can no longer do office work.

I been getting steroid shots in my back for sciatica. pain running down my leg and lower back. I've been a laborer all my life with a high school diploma. Construction, Trucks, Warehouse, Stocking etc. A combat veteran also, been blown up. My back and knees are shot out now and I live in pain. Small tasks are now difficult. I also suffer from ptsd and paranoia that takes over my mind. Can get plenty of letters from co worker's about how I'm a mental case. I've been homeless off and on for many years now. I just didn't have any choice or die and have been losing jobs for years now. I'm over 55 now and am mystified when it comes to paperwork or this proceedings lawyer stuff no matter how much I study it online I'll be sure to screw it up on my own. If I get ahold of you officially do you think you might take on my case?

Due to my physical disabilities I had to resign from my full time good paying job to apply for ssdi then got denied, 5 moths later I got a job for 3 hours a day ,it is split to 1.5 in the morning and 1.5 in the afternoon and I cannot stand more then 10 minutes at a time due to many spine problems that are very painful and I cannot stand straight up anymore I have to lean forward because of the pain that shoots down my legs, my cervical and thoracic and lumbar all have problems as well as artists, oh man it's so debilitating ,it hurts to try and carry a gallon of milk ,it send pain through me ,so I would rather be working a full time job making good money then to suffer these disabilities and pain

I just turned 54 today. Have been out of work for 18 months. One bad shoulder from work injury. Still have ongoing workmen’s comp case. Now my other shoulder is shot. And I’m gonna see an orthopedic surgeon next month. Pretty sure I need surgery on that as well. If I apply soon I assume my case wouldn’t be looked at until 2025 when I will be 55. I have been a carpenter and a stationary engineer my whole working life. Have a GED education. Would I be a good candidate to file?

im 58 spondylolisthesis, stenosis, arthrosis, ddd,radiculopathy, neuropathy, sciatica, nerve root impingement, diabetes, ptsd with major depression, just had my sych evaluation jan 19th,lawyer is going on grid rules and original onset date,was denied 2 times until i hired a lawyer,the ssa blew the dust off my paper work,now im waiting hoping on a favorable decision, god bless

I was told you always get denied the first time you apply. Then hire an attorney. Mine got a third of my back pay as his fee. If i was turned down again, no fee. I was awarded my ssdi and back pay within 6 weeks of my court date.

I recently just got my disability approved, but when I looked at what my benefit is and the reason for my approval, it is not for what I intentionally filed for in the first place. I am blind in my right eye and only have 5% of my optic nerve in my left, but when they okayed my disability they put it under depression, pay me the least amount I can get. Who, or where, do I turn to to get this injustice corrected. My benefit is only about 40% of what my previous income was. And now they are paying me on a low end for depression instead of for blind/low vision. I have 47 years of work experience documented.

I have seen a few denials like that. I still think that the odds are in your favor if you are over 55. One thing to consider - is the DOT title for computer programmer consistent with what computer programmers do today. More and more appeals arise from inconsistencies in the DOT and real life.

No if you are getting both (presumably because your SSDI amount is lower than SSI) they will not "combine" in the future. When you reach retirement age, however, you will get only one check.

So they will deny A person with A reduced range of light work who can't do any past work with A high school diploma with no transferrable skills at age 52 but at 55 A person with this RFC would Grid out and be found disabled. So why would SSA not approve such A person? The time that it takes for all of the appeals they would be close to age 55 so why not approve them at 52?

A reduced range of light work isn't sedentary. Between 50 and 54, you need to be limited to sedentary to Grid out, unless your past work includes sedentary. If you can return to any past work at sedentary, then not disabled.

Does your primary care physician decide when or if it's time for you to quit working or is that a decision that can be made by the individual? Also, if a person gave notice to their employer before they quit and seek ssdi, would it help or hurt your case?

SSA does not monitor your bank accounts. If you have an SSI case and they want to determine assets they may ask you for copies of bank statements. But there is no on-going monitoring.

So situational depression is considered a disability? I was told that my mental health wasn't severe enough by disability determination when I have been getting treatment for years with a mental health specialist. It comes from my back pain and lumbar radiculopathy. I can't work with conditions and have MRI results to show it. Apparently it's because I'm not over age 55 that's why I get treated this way. I even have some arthritis and mild spinal stenosis that was on the last MRI I got 2 weeks ago.

If you look at the grid rules for light (gridrules.net/light-grids/), you can get approved if you limited to light but have limited education or no transferrable skills. If you have no physical limitations at all then the grid rules won't help you. You would have to argue for disability under a functional capacity theory.

Thats always'the elephant in the room' no one wants to discuss. So, how does the SSA adjudacators process what has more weight?

Hi Social Security Disability Channel This is from an attorney's website "Can You Apply for Social Security Disability After Retirement? If you file for early retirement benefits between ages 62 and 65 and then you become disabled, yes, you can apply for SSDI benefits. If the SSA approves you, the agency will switch your payments from retirement benefits to disability benefits (since you can't receive Social Security and disability at the same time)." It doesn't. You are eligible for SSDI if you have worked and paid into the system. Receiving SSI does not generate work credits.

If I can give one good piece of advice…hire Jonathan or similar attorney whose only job is SSDI or SSI. They know what you need to win. Going on your own is foolish and then an attorney hired after has to try to clean up your mistakes. Good luck

ALJ says i dont visit the doctor enough, not that there is anything they can actually do for me. But i cant afford the 50 dollar co-pay every time i have pain which is every day all day. Is not being able to afford the insurance co-pay a potential defense as to why i do not cry to the dr about pain every week ?

I see this issue all the time - if you can't work you won't have money to pay for doctor's visits or insurance, but when you get to a hearing the judge denies you because you have not been to the doctor.

This guy is good. I'm in reconsideration going on for a year now. I just had a DVT and PE and on blood thinners and thats a new developmet that happened. Origionally my disability has been palpitations of various sorts and afib and a couple of anxiety disorders and I'm on zanax and prozac and now blood thinners. I got my fingers crossed. But I'm 591/2 so if I'm denied I will be about 62 before I see a judge the way things have been going. So I don't expect reconsideration will be approved but I'm hoping but I figure turning 62 will be when I start getting money. Anyone have any informed opinions or experience? Do you think I may get approved but starting date from when the DVT and Lung clot?

No matter what advice your given or who you have representing you Social security will treat you the same no matter what. You could have letters from 3 different doctors saying you cannot work indefinitely and they will still deny you. They change rules every year also. Social security is a complete joke and so are the people that work for them. Have a great day.

Generally speaking if the ALJ has a serious medical condition they tend to be more sympathetic. But, of course, there are some exceptions to this rule.
