A lecture on OVERREACHING for law students who are new to studying land law or are consolidating their understanding to prepare for an assessment. In this lecture I explain which proprietary rights can be overreached and when overreaching occurs.
IMPORTANT NOTE: Overreaching is relevant to both registered and unregistered title. This is Lecture 4 in my lecture series on unregistered title

Thank you for your explanation, you are the only person I am yet to find that can explain these concepts with clarity! I just had a small question: at the end of the video it states that if overreaching does apply then we move to the doctrine of notice for unregistered land? I was under the impression that overreaching applies irrespective of notice. Does this mean if the interest is not overreached, it could still NOT be binding on the purchaser as long as they do not have notice of the right? Thank you!

Thank you for your question and feedback Emy. If overreaching does NOT apply then you should consider the DoN. So, if not overreached, the right is not binding so long as the purchaser is a bfpfv without notice.

Are you able to explain why the trust for the parent are under a constructive trust not a resultant trust? I agree it’s a constructive trust for Boris but not sure why the parents though?

At 17:41, is the authority for the rule s2 LPA 1925, or does it include s27 LPA 1925 as well?

At 16:42, where did the rule mention that the beneficial interest was created under a constructive trust? The conclusion included 'constructive trust', but this wasn't mentioned in the rule. Was there a step that was skipped? Thank you.

if overreach is applicable and the purchaser is not bound by the 3rd party's interests anymore, from whom does the third party seek remedy from then for their equitable rights

Really clear explanation, do you have a video on legal interests (Prescription easement) & overreaching? I am studying this and it seems only SLA 1925 will overreach and only before TOLATA 1996.

Thank you for the feedback. I'm sorry but I don't have any videos on prescriptive easements at present. I do have a video on overreaching (it applies post TOLATA and isn't confined to the SLA 1925). Hope it helps.

I'm a bit confused - in order for overreaching to be triggered, there must be a conveyance of a legal estate (e.g. a freehold or a leasehold), but how then does the grant of a legal charge to a mortgagee who has paid two trustees trigger overreaching, if the legal charge is only a right to take possession of the relevant legal estate and not the conveyance of the actual legal estate? (not sure if this makes sense; I've most likely misunderstood the whole nature of a legal charge) Thank you!

Hi there, The acquisition of a mortgage over the legal estate can trigger overreaching. A 'purchaser' includes a mortgagee.
