@compadan when Polly and Esme had an agreement, it only means that the joint tenancy changes into tenancy in common. But it is not stated that it is bought yet, so Polly still owns it until the Esme buys it, which is not the case. So that in the table, Polly and Esme still have the same share (3/8)
@bitesizelaw91633 ай бұрын
Correct. They had 6/8 as joint tenants so the severance gives them 3/8 each. I believe that is what the table indicates.

Hi, would the case of Gore and Snell v Carpenter not be the authority for 'immediate and unequivocal intention to sever' instead of Harris v Goddard?

Will this apply to multiple problem questions? Where would be the case where there will be differences? Can you please make more videos on this topic? please is in my exam and I am so scared

Amazing video and playlist! Helping me perform much better! Just a question at 17:37. Why would it matter if Boris had an interest anyways, would she have to pay that £10,000 to him if she wasn’t a bona fide? How does Boris get his £10,000 back? From Victoria?

This video is very helpful thank you. I do have a question though: - after Polly severs, how come Esme does not remain a joint tenant and Polly and Grace are the tenancy in common. So basically, why do PEG all become tenancy in common? Thanks in advance

At 17:41, is the authority for the rule s2 LPA 1925, or does it include s27 LPA 1925 as well?
@hathawayamato Жыл бұрын
At 16:42, where did the rule mention that the beneficial interest was created under a constructive trust? The conclusion included 'constructive trust', but this wasn't mentioned in the rule. Was there a step that was skipped? Thank you.
