The problem they are going to have is that he is NOT paraplegic and it was obvious to anybody that knows what to look for. Like, handicap plates, sticker, or tag. None. Wheel chair.. None. Handicap driver's license.. Nope. Driving equipment on the steering wheel for a paraplegic..None. inability to move his legs... Nope, he moved them at the stop while in the car, without his hands. Plus, he was driving with his legs and feet. Long and short of it, he Lied. He is Not paraplegic. That means, he refused to comply. He can walk. Being drug out was his choice. They didnt drop him on his face, or abuse him. They took him out of the car. He could have stood up. He chose not to and he chose not to comply. They video shows him moving his legs in the car. Plus, he can walk. His attorney let that out in his press conference. He may have a harder time with the "lawsuit" that people think. The lie alone.. claiming to be paraplegic, when he is not, may be all it takes for him to lose.

I and two others were kidnapped by officers when I was younger walking to a friend's house. We did have one know drug street to walk by, and the officers used that as an excuse to unlawfully detain/ kidnap us for nearly 2 hours. During this time, harassing us. Then unlawfully charged us with a curfew violation even though we were nowhere near curfew when taken. So, actually, they unlawfully forced us past curfew and kidnapped. They were actually committing the violations of our rights. This is nothing new for many officers.

6 months in the academy and the continue to train on us citizens and make mistakes on us and destroy people lives , people have to take time off to fight the mistakes and spend money on courts! I was stopped once after I got my license for going through yellow almost red and two cops in the car seen it and they stopped me . I knew I was getting a ticket I knew I made a mistake I had all the paperwork so I have her everything , looked like one of them was a training offices and the other was a rookie ! She came back with two tickets one for light and one was for expired insurance!!! She handed me them and I said what you mean expired she showed me fast the insurance card and the date was like from the past , they left in hurry while I was looking at the ins card and found out that the date was the date it was issued !!!!!! Of course I had to take time off to go to court because you have to go for that to show them you had insurance at that time ! She didn’t know what she was looking at and I was a young driver not knowing how to look at stuff fast and after I realized she made a mistake they were gone !!! I can just imagine how many tickets she issued like this !!!! They are not there for us but to fine us and take our money every time you talk to them and in the best way they can ! Lol sorry for the long story!

The dog questions are indeed relevant as it happened during the stop in which the man is at court for. Was the dog needed to determine if window tinting violated one of the many laws against freedom? My husbands a paraplegic and no one had better help him unless they know how. Spinal cord injuries are no joke. The cops should have allowed him to stay seated in his car and requested an ambo so paramedics that have training could've helped him out of car. The way the two pigs did it, could have done more serious injuries. Only an uneducated mind would consider this resisting arrest. This was 100% racial profiling. Tinted windows equals black ppl to cops. Following him for five blocks gave them enough time to have run his plate, saw his priors from 14 yrs ago and went with the drug bullshit.

Excellent use of public funds. Dayton must be flush with taxpayer dollars. That's gonna come in handy when this man wins his lawsuit. If his tint was too dark they should have pulled him over, given him a ticket and sent him on his way. It's illegal to hold somebody longer than it takes to write a ticket in order to wait for a K9 to arrive arrive. Never mind dragging a paraplegic man out of the car by his hair.. Didn't she the "judge" say that she was only there to hear about the traffic violations but then just like a hypocrite start trying to question the defendant about the on going case that does not pertain to her court ; you can immediately observe the hostile tone the wittness took with the defence attorney and disrespectfully got up during his questioning. Two points are apparent there is without much thought racism involved with the profiling ... Lots of people live in area's that have drugs sold and unfortunately those communities are usually neglected and below poverty level predominantly people of color . #2 so at this time it's a no brainer that the real reason he was pulled over was because he was driving while black and he knew who he was before they stopped him ... Why because he followed him 5 bloocks before the stop so you know they ran his plate and the priors came up. Can anyone say bull💩 cause I can smell it from here.

@linda not in the case in question the judge stated that she was only hearing the traffic portion of the case not the aggressive attack that was against the defendant as was told to his attorney... But then tried to get the defendant to speak about past records that was not relevant to the actual case in her court room also any questions should have posed to his lawyer as we all have the right to remain silent as not to incriminate yourself.

That's the damndest shit I ever heard from a judge!!! How she gonna ask him about his prior convictions which had nothing to do with the case in hand ! And second of all she said I guess you learned your lesson about window tint ! So dark tint on a traffic stop is reason enough for a cop to snatch a paralyzed person from a car by their hair and drag them down a street ? WOW!!!! Not surprised the whole damn system is a joke and that judge after seeing that video and talking to that man like that needs to be fired. If that was a white man or a dog being treated like that and drag down the street those cop's would have been in jail that day ! Sad that we as black people are not seen as human anywhere on this planet. Why should we abide by any laws when the system doesn't work for us ?

That's really silly comment. When sentencing the prior history of the accused with similar offences is clearly relevant. You get less punishment for first offences than if you are a habitual offender so the fact that the guy had tinted window o fences previously was relevant and it was correct for the judge to consider. I can see from the proceedings that there was a lot going on that did not come in to play and the judge was right not to let it come into play because all she was deciding was the window tinting and the child restraint. The defendant will certainly have his day in court what I expect is an accusation of brutality, and it looks as if he might have a good case. His lawyer was a crafty old man and really knew this stuff. I would love to see him working on a jury. The defence lawyer was gathering material for the lawsuit. There was clearly no defence to the charges.

@@lewismiller9281 The driver is a businessman that owns many rental properties in the area. He should've received his tickets and set free since that was the initial reason for the stop. They never stated any smell of drugs so what was the need for the K-9? Also after the fact the took his 20K saying the K-9 reacted to a small scent of drugs in which none nor any weapons were in the car.

Far as him having a criminal record from the past has no bearing on what happened that day. He complied in every way, how a tint & unrestrained child violations result into needing a K-9? Remember they admitted no smell of drugs, also the officer admitted to profiling in that area.

This is a case of profiling just because I make travel through an area doesn't mean that I belong in that area and if I live in that area doesn't mean that I condone what my neighbors are doing I may have lived in the area for 40 years and my neighbors came in and have been there only 5 years and they start doing some of the things in the area there may be drug dealers passing through the area that you happen to stop that doesn't mean the area is a high crime area clear and cut case of profiling

Those charges should have been dismissed the failure to have child in a car seat being as though I'm quite sure a ticket was never written up for that yet it was brought up in court only to cover the cops tracts and the ticket for the tint because having tint no matter how dark the tint is not committing a crib being as though Noone is being harmed neither is there anyone's property being destroyed come on this needs to stop let's not forget the 3 year old in the car watching all of this blessed that poor little heart I have not yet hear any apologies from the cops that was involved in this incident or their police depart# Again after watching this it leaves me with one question What ever happened to Justice For All and not just Justice For Yall that makes yall statues that overrides Common Law

This is some bull, so he determined even though he wasn't sure that there was drugs in the car or didn't even suspect that there were drugs actually in the car that he could call for a police dog because it's a high drug and crime area that doesn't even make sense you don't call for a canine police dog I wouldn't think unless you suspect that there's drug paraphernalia in the car why would you call for a police dog if you're not even sure if there are actually drugs in the car and you don't smell any drugs guns or anything of that sort in the car? That whole line of thinking doesn't make any sense to me and if you ask me this officer is on some bullshit!

Basically they knew who this guy was and they knew he would not give consent to search his car. They ran his plate and saw he had prior convictions and that was the reason for the stop. I was pulled over one week prior to the driver/passenger window tint law changing. The officer offered me a razor blade to remove it immediately or a ticket. I accepted the ticket to go to court and beat it because the officer didn't show up. Strange huh 🤔

window tint violations while cop cars mostly have privacy tint and that is somehow legal but woe betide civilians having slightly darker tint on their windows (only cops can have the comfort of cooler cars) which helps reduce the heat transfer into the car

I own rentals and the way the courts have given rights to renters creates a big problem trying to evict someone who is abusing your properties. That's like saying anyone who goes into a bar is an alcoholic, regardless of the reason for being there. Because he went to his apartment complex, that a unit known for drug sales, that was the only reason that he could possibly be there. Also if its a known issue with drugs, why haven't they shut it down already. In this situation, it would take a lot of explaining to ever justify such inhumane and disrespectful treatment of another person, especially if you cant prove that there was any threat of bodily harm.

Happens all the time,first judge said we are here only for the traffic violations,however as soon as the defendant spoke up she mentioned his prior drug offense. The system will always slap you down when up speak up. As for the officer,he said he makes a drug arrest everyday. I find that very hard to beleave,and because that door was opened the defense should have been able to walk right on in. This entire trial was a disaster and so was the judge

If he was pulled over for suspicion of window tint being too dark and in the process of testing the tint a child restraint charge was discovered. At that time the ticket should have been issued and Mr. Owensby should be allowed to leave. At what point is a K9 required too test window tint? He stated he requested the K9 bc it was a high crime area. Is that probable cause? I think not! I certainly hope the COMPLETE traffic stop will be presented to the court and all of the wrong doings of these officers and numerous violations of Mr. Owensby's rights will be addressed.
