Anna GC Yung iba po kasi colorum broker (meaning hindi wala silang qualification at hindi accredited with PRC) so mas habol lang talaga nila kita at ma-reach sales quota para hindi matanggalan ng allowance. Hopefully, sa paggawa ko ng videos na ganito, ang mga buyer ay maging mas mapanuri sa mga taong makaka-transact nila at suriin din ang mga inaalok sa kanila 😊

First time to hear this type of condo Buying tips as I usually don't watch it. Interestingly enough, I did not know this MACEDA LAW and was not correctly discuss during my first shot in the Summer of 2018 of buying a condo with Robinson The Radiance in Roxas Blvd. We made a DP of P50K and paid the first payment of CD$350.00, and then we suddenly cancel at the time for reasons that I won't be able to buy it for personal use. At the time as well, the money is not much for us, as I can get it back in my work quickly. I guess I regret it now, but I am far more on buying it in cash for personal use. My timeline is for another year and uses it as a retirement condo while on vacation during winter in Canada and back to Canada during summer days. I will surely be in touch when things come around to finally. Unfortunately, COVID-19 ruined our vacation and was supposed to be in Manila this month. Cheers and more power to your channel and has been a learning experience as always in life.

Jose Carlos Normally, those who are employed by real estate developers are accredited salespersons or colorum brokers (not qualified to be a real estate service practitioner). They didn’t have an in-depth study of the pertinent laws so they’re not knowledgeable to discuss this. So if you want your questions answered, it’s better to transact with a licensed real estate broker working in-house or a licensed real estate broker accredited by the real estate developer. Indeed, it’s better to buy in cash, you can get discounts from real estate developers or if you’re buying from owners, you can negotiate the price. When you’re buying from owner’s, it’s best to use a licensed real estate broker for a safer and smooth transaction. The title will be verified if it’s clean and you’ll be guided accordingly with the process. It’s saddening to hear that your vacation got ruined with the covid-19 pandemic. @@OwnPropertyPH Actually the salespersons ( 3 ) are all from Robinsons Land. They came to Calgary, Alberta, Canada, during the Filipino Festival in downtown Calgary, to do the sales. Maybe it was not just discussed because I was looking for personal. But then again as you said they should have been advised us on this Maceda Law. We will definitely get one for personal use ( max. 5 M) and will buy it in cash. Thanks for your response. Cheers and more power to your KZbin channel.

Thank you - your subject is very informative By the way, you mention about Maceda Law - I bought a condo in April 2016 - after 2 years of payment I tried going to the bank but BDO and PNB will not financed and said they stop dealing with the developer due to delays on issuing title. So, when I noticed that I will have a hard time to finance it - I decided to cancel my purchase. - I lost about 541,000 pesos - and on Final Notice of Cancellation - there is a paragraph stating that : " Please be informed that under Reservation Agreement which you have signed with us, it was stipulated that upon cancellation or termination of the purchase, all payments made by buyer shall be forfeited. Since I am a Canadian Citizen and don't live in the Philippines and not aware and no time to find out where I stand so I just when ahead and cancelled - and only this time I find out from you about Maceda Law - do you think this one can help me get at least 50% of what I paid. Do you think I can still go back to Empire East to put a claim for a refund? Yes I paid my monthly payment for exactly 2 years and a month.

Before anything else, I would like to say that what happened to you saddens me. No matter what the amount was, the payment that you chose to forgo is your hard-earned money. Anyway, to answer your question, despite the stipulation in the Reservation Agreement that "all payments made by buyer shall be forfeited" by Empire East, you are still eligible for a refund of half of the payments you made. This is because such stipulation in their reservation agreement is null and void as per section 7 of the RA 6552 of the Maceda Law. What you need to do is send a demand letter to the real estate developer. If they didn't respond to the refund request, the complaint should be filed to HLURB (now DHSUD). I understand that you are a Canadian Citizen and you can't stay too long in the Philippines in order to undergo the complaint process. What you may do is issue a Special Power of Attorney so that attorney-in-fact may file the complaint and do the requirements on your behalf. Now that it's 2020, I'm not sure if HLURB can still assist you with your case that dates back to 2018 but you may try. There is no harm in trying. Hope this answers your questions :)

Danilo Bartolome HLURB stands for Housing and Land Use Regulatory Board. However, it has been consolidated with HUDCC so now it’s called Department of Human Settlements and Urban Development (DHSUD). Sorry, I’m just used to it being HLURB so I still said HLURB when it’s supposedly DHSUD already. I keep on forgetting since I’m still waiting for my new ID from them 😂

Great advices dear! But i think Maceda law is not applicable if you’re still paying the down payment monthly. If you cannot pay the required down payment before execution of contract, developers will forfeit all of your payments. Usually maceda law is already applicable to inhouse financing when contract to sell is executed and full dp is paid. That’s the time you start paying the 80%-90% balance through inhouse financing. When you dont want to continue the contract due to financial constraint then you’re entitled to 50% refund of all of your payments if you’re already paying between 2-5 years and 5% every year in excess of 5 years but refund should not exceed 90% of total payments made. If after full dp and loan application is rejected then that’s a problem coz the buyer cannot refund the reservation fee and down payment from the developers. That’s why brokers should also assess buyers’ financial capacity first before accepting reservations and before buyers make monthly payment for down payment.

The Maceda Law is very much applicable because the 20% downpayment (or 30% downpayment) depending on the developer is spread over X no. of months/years so the buyer can do installment payments. This means that the monthly payment done is what constitutes the downpayment. "If you cannot pay the required down payment before execution of contract" You don't have to completely pay the developer in order to recover the money. You just need to pay at least 2 years of installment payments. RA 6522 was created "to protect buyers of real estate on installment payments against onerous and oppressive conditions." The monthly installment payment scheme is funded by the real estate developers so it's a form of in-house financing. Such a payment scheme was done so that after some time has passed, buyers will be eligible for a housing loan. This is the reason why the prices between (1) cash payment and (2) downpayment spread over certain a period of time with the balance via bank financing are different. The real estate developer factors in the interest they lent over the years. Most buyers aren't aware that there is a law that protects them. Other developers like the one where I bought my condominium made the installment payment 18 months to pay (less than 2 years) so that if I can't pay the balance, I can't recover any money anymore. Ma'm, in reference to your last paragraph, it's not just real estate brokers who must do a good job. Most of the people who are into project selling are the accredited salesperson/ sales agents so they must be properly trained. They, at times, don't assess the buyer's financial capacity when they are pressured with the sales quota. As real estate brokers, a lot of us do general brokerage and so general brokerage is actually my main job. I just do project selling on the side po. Thank you for sharing your thoughts 💕

I wish I had seen this earlier pero kahit siguro napanood ko to, I still would have bought a preselling unit in Victoria by New San Jose Builders. Nabasa ko sa replies mo na hindi mo recommended ung developer kaso yun lang talaga ung pasok sa financial capacity, required income, saka petfriendliness. Daming murang condo pero sa income at petfriendliness talaga nadali. Hahaha. 4th month ko pa lang sa pagbayad pero alam ko nang male-late sila sa turnover. Nakikita ko ang sarili kong ibebenta lang din ung unit tapos hanap ng iba. So much for my adult millennial decision. Will watch your other videos sis. Very helpful sila :)

Minsan kung iyon lang talaga pasok sa budget, pwede naman na talagang pagtiyagaan 😊 Anong pet m? 😁 Anyway, yes, pwede mo naman benta yung unit eventually though medyo mahirap lang honestly ibenta yung condo projects ni New San Jose Builder kasi yung bumibili ng units diyan, hindi cash buyers. I forgot how I ended up with NSJBI. tapos hanggang ngayon chinachat pa rin ako nung agent sa River Park 😅 No developer is perfect naman pero what are your thoughts on this? Kasi kahit ung big names like SMDC may complaints rin. Nagsisi ako bigla hahahahaha

don manluyao If you bought a condo in Ubelt, hoping its property management of it is good. May iba po kasing condo, madaling lumuma because of poor maintenance kaya later on mahirap i-flip. Yes po, gagawa ako ng video for rental or flipping sometime in the future po 😊

Under MACEDA law, dapat naka-at least two years worth of installments ka para makuha ang cash surrender value na equivalent sa 50% ng buong nahulog niyo. May record pa naman ang developer at may copy ka naman po ng contract kaya may habol ka pa rin po 🙂

Yung parking rent depende po sa location. Usually parking price starts at P 4 k monthly. If you have a good paying job, your job requires you to go around, and your condo is not in a prime location, the additional expense is ok. Pero kung prime location kadalasan may kamahalan yung parking fee and walking distance naman na lahat so kahit financially capable ka para sa kin hindi na need yung additional expense to rent parking 😊 One of the advantages of living in a condominium is the convenience and accessibility.

Para sa kin, mas gusto ko sariling construction kasi may control sa materials na ginamit pero mas madaling magbayad kapag developer ang gagawa. So depende nalang po talaga sa priority niyo po 😊

For the RFO, kailangan niyo munang magbayad sa real estate developer po. Iba't iba ang payment scheme ng mga real estate developers. Gaya ng sabi ni kuya Rommel, merong mga real estate developer na merong early move-in promo 5% (for ex. 5% spot then yung remaining 10% pwedeng payable in x no. of months) 😊 At least 15% DP kasi po bago mag-bank financing.

If kamag-anak, you use consularized SPA or SPA given before your relative left the Philippines. But you are not allowed to use Authority to Sell po which is the contract whereby you get a commission for the property sold because it can only be used by legal real estate service practitioners 😊

Ang alam ko lang yung founder nung real estate company kuya ng HS batchmate ko po at real estate broker siya na naging real estate developer 😊 Teka lang po sa part 2 ah. OC kasi ako. And the officers of association slso the developer. Tapos nung turnover i pay for meralco deposit, membership fee and 3 months association due na non refundable at hindi either advance payment. Tspos turnover ng unit ko is dec 28 then i was charged with December Association Due. Tama ba to?

I'm not sure why you were charged for 3 months assoc due that is not considered for advanced payment po. Ang alam ko pagkaturnover sa inyo, saka lang po kayo magstart magbayad ng assoc dues tapos prorated pa po dapat yan.
