Nintendo don’t own the mount patent. All games have it, even final fantasy mmorpg games. My mom and brother still think Palworld is a ripoff. But I do hope Palworld wins. When they do, I will try not to rub it in on their face.

I'm really sad to see what Pokèmon have become especially with bullying other monster franchises to remain dominant in the monster taming genre. I'm glad that Digimon and other monster franchises made the right choice by supporting Palworld and hoping that Palworld would win the lawsuit because creativity and imagination as well as their right of existence would be in danger if Pokèmon wins the lawsuit. Despite me liking Pokèmon, I hope that Pokèmon lose the lawsuit or settle the lawsuit because if Pokèmon wins the lawsuit, we would have to say goodbye to Digimon, Monster Rancher, Yu-Gi-Oh, Neopets, Yo-Kai Watch, Bakugan, Palworld, Monster Hunter, Monsuno, Moshi Monsters, Monster Sanctuary, TemTem, Nexomon, Chaotic, Monster Crown, Cassette Beasts and other monster franchises especially potential new monster franchises. Another worst case scenario if Pokèmon wins the lawsuit, we would have no choice but to play or buy Pokèmon as well as supporting the franchise because Pokèmon would be only option since Digimon and other monster franchises are gone from existence. Pokèmon should be ashamed of themselves for their actions such as bullying other monster franchises as well as wanting to monopolize the monster taming genre.

How many times do I have to tell you clifford, digimon isn't in trouble, its not a pokemon ripoff, digimon is a tamagotchi spinoff brand, vpets, came out the same year as pokemon but hit the west first in 1997, its manga came first too, then both animes dropped the same year. And digimon you don't capture monsters, you have a partner digimon and you save both worlds from destruction fighting for survival. And the games are like persona/shin megam tensei, not pokemon. Pokemon is a ripoff of dragon quest and shin megami tensei, pokemon has no case against digimon. Stop the fake fearmongering on digimon.

I would not feel bad for Pocket Pair. If the way they advertise Palworld on their steam page, and their previous game: Craftopia, is anything to go by, then they're anti-environment/zoosadists who deserve to be shut down. I can only imagine they only added the ability to fight poachers just to save face, because instead of advertising that, they advertise all the colorful ways you can kill and abuse pals, instead.

Pokemon wasn't even the first one either, as I believe Shin Megami Tensei predated Pokemon Red and Green by around 3 and a half years. Shin Megami Tensei is still going strong right now too I think, and is not too obscure of a series to have been overlooked especially in Japan.

I'll always be a pokemon fan through and through until the end. And normally, i would stand by the side of pokemon, but i am on palworld side. Apart from the "inspiration" of much of the pal monsters looks. The game isn't anything like arceus, and it's dumb to try and claim ownership of real-time open world combat.

Nintendo sued Sega at the end of the last century because Sonic is a platformer and has a scrolling screen which Nintendo had patented, but they finally settled. So it may be that in order to respect the so-called Code of Honor, they won't sue them again because of that case. Or maybe Nintendo just doesn't want to break up with Sega again.

Remember that Square Enix game that came out in 2010 that let the player summon a chocobo to fight in combat in an open field, as well as mount. Then later it was able to fly and go underwater. Also a small company called Capcom made a game called monster hunter 3tri that I watch back in 2010 where the player in a 3d field could throw tranquilizers at monsters to catch them. Of course those monsters joined the players team by becoming part of the equipment of said player.

A lot of people feel that the worst that will happen is the game won't be available for sale in Japan. Which if that happens, I hope it bites Nintendo in the butt elsewhere. Where future Palworld products and games BEAT Pokemon in other countries. Basically what happens to certain anime and such in Japan. Where those are more popular in Japan, but dead in others.

FINALLY someone who brings up craftopia and its capture system! And uses the older footage of the game! Craftopia came out before legends and already had capture and ride mechanics! Like legends you can catch the creatures without battling them but like in palworld punching them in the face first does make it easier to catch them. Nintendo is just salt that "pokemon with guns" became palworlds call to action when in reality if ANYONE could go after palworld it would be ARK as it has more similaritys with that than pokemon

@baalfgames5318 We can then say that Pokemon is luckily just a human-sadist and they wrote several Pokedex entries about how many Pokemon hunt, prey, stalk, lure and kill people. And then they send children to catch and train these creatures. Like, for example, the Moon Pokedex entry says that if you see Gengar, give up because your life is over. And its other entries talk about how Gengar sucks the life out of its victims, laughs at the shadows and you only feel the air getting colder until you are lifeless. And then, we're not talking about carnivorous mushrooms, Foongus and Amoonguss, that mimic Pokeballs to lure other Pokemon and trainers only to spray poisonous spores on them and spread their kindred that can grow anywhere. And these two examples are just scratching the surface.

the mount patent is EXACTLY the same mount system that existed in Ark:SE(a game from 2015) down to the key-functions and mount class specifications. I'm not talking about "it's sort of similar and is just different in tiny areas" I am talking exact copy down to the specification of a button presses to switch between fly-mode and walk-mode for flying mount, the land-sea-flyer classes, the specific characteristics of each class, etc. ark did take its mount system from other games, but they didn't patent this, they also were somewhat different in functionality in some areas to many other games of the era, nintendo not only copied it to a T, they patented that system and are using it to sue another company that copied from the same source - Ark(stated as a major inspiration for palworld, and evident by its gameplay).

😅 Just realised how palworld brakes the battle patent: battles can happen without you being involved. Pokemon has a battle radius, palworld doesn't. You don't throw a pal to start a fight, you throw a pal to indicate its task. Dose palworld allow for easy switching??? Depends on how you word it. In palworld you need a saddles and you need to mount (you can't simpley switch like in pokemon). I presume there taking about pokemon ride, which was introduced in sun/moon.

My guess was that either it has to do with them trying to do proxy war with sony, or palworld is first real competitor in the space that shown world how stale and bad modern pokemons are. Also it did not help that pocketpair is small company that was ripe for legal bullying, something Nintendo legal department does constantly toward fans and content creators. But they overplayed their hand with this one.

Moon Channel did a fairly in depth discussion about this, and the conclusion that this is 100% a proxy fight against Sony, and that Sony is the main aggressor here by trying to find a way to monetise Pokemon-like designs and destroy the brand image of Pokemon via Palworld. It's a frivolous lawsuit, but following the logic there are some fairly catastrophic losses for Nintendo if they don't try to stop Palworld in some way.

Other big games may secretly cross-license with Nintendo in Japan. Maybe palworld is being sued because they didn't do that. We don't know which games have patent licenses with which companies because they don't make them public. There are countless game mechanic patents in Japan, so no matter what game you make, you're likely to infringe on one of them. This is already unreasonable. Not all game creators can keep track of patents. They don't have the funds, effort, or knowledge to look them up. But patents are a world where you can't get away with "I didn't know." If you infringe, you'll be sued. And it's advantageous to have patents. Large companies can nip new buds in the bud when they feel like it. The Japanese game industry is airless.

Ark Survival Evolved - June 2nd 2015 (LONG before the 2021 patent) Any fishing game in a 3d space, since throwing a net would absolutely qualify, and there's several hundred of those, ESPECIALLY if you count survival games. Almost every MMO since Everquest 1 has had mount systems, many of which with you throwing out an object to summon the mount. Even the pokeball system itself is a direct ripoff of Capsule captures from Robotrek, Dragonquest, and Megami Tensei. Heck, the original basis for Pokemon was off capturing bugs with nets, a real world action that far predates Pokemon by well over a thousand years. Fishing itself using Nets is several thousand years old. It is, quite frankly, patently absurd.

When did they file the applications though? There's a reason 'patent pending' labels are a thing, it's so that inventors can pre-emptively protect inventions they've filed a patent for but haven't been registered yet due to long processing times. It can take years to register a patent, but a 'patent pending' label notifies competitors that a legal process to protect the invention is underway and copying the invention can be deemed a patent infringement. Also, Google's AI tool is absolute not reliable as it just copies some rando it finds somewhere on the internet, and recently there have been a lot of randos making hot legal takes about Japan's patent system.

The prior art also needs to contain *all* of the elements to either be prior art or infringing -- which is why divisional patents even matter. If there isn't a catch rate display (for example) it isn't relevant, unless you add another element to the defense, such as the difference not being eligible for protection under a utility patent (the arbitrary catch rate exists whether or not it's displayed) or the invention lacking an inventive step (anyone with ordinary skill in the art of game development could do it)

Ark Survival Evolved had all of those things in it before Palworld came out too. I mean you can use Cryopods to "capture" your creatures(after taming/breeding of course), you can mount a large portion of creatures in the game, and obviously you can't fight other creatures with your own. So Nintendo's case should be thrown out because they are not unique to Pokemon.

Claiming that multiple should mean "more than 3" is beyond stupid as the literal definition of multiple is simplly, "more than 1". Even 1.5 is technically, "multiple". Nintendo sued Palworld not specifically because of the patent infringements but because a lot of the pal designs took some heavy "inspiration" from pokemon. They are just using the patents as an excuse to sue Pocketpair. You know why Nintendo haven't sued World of Warcraft / Craftopia for having "open field with summon-able mounts"? cuz they didn't copy any pokemon's designs. Honestly, Pocketpair could've just avoided all of this if they had just used their own creatures.

Heavy Inspiration still isn't copying, they aren't 1 for 1 and are different enough to pass. They're suing Pocket pair because they are an actual threat to the pokemon brand as competition, especially since they are teaming up with Nintendo's arch nemesis Sony to broaden the franchise of Palworld. And they haven't Sued World of Warcraft or Craftopia because they wouldn't win the suit. People are pointing out Craftopia because the parent patent still came after Craftopia which used all of those mechanics before they were patented which means Nintendo really doesn't have a leg to stand on legally and if they actually win the case it's because of the heavy bias the Japanese people have in favor of Nintendo, meaning it's most likely not a fair trial for PocketPair. Honestly it's super petty and stupid to be this hung over a few designs that are similar, as if Pokemon didn't do the same thing with Dragon Quest when it came out.

Pokemon choosing the copyright lawsuit route is literally even dumber since in that case they will definitely not win and look even more dumb, literally alot of online lawyer already said this. that's why they go with the more vague patent lawsuit cause they hoping it can "stick" more

@Kakachi07 Yeah, essentially what this video says, it's a "lose lose" situation for nintendo now. well, they definitely deserve it tbh, if the would just i dunno use those legal fee and time to actually make a good modern pokemon game, then they could ya know actually out match the competition but i guess it's too big of a task for them huh

@@MichaMundy That's the dumbest part of this entire thing. If Gamefreak actually put in effort they wouldn't need to resort to this BS. It's not even a time issue anymore, the quality of work they put out even under crunch time is still novice levels in Game development. The only reason it's stayed like this is they've had no competition biting their heels. Pokemon was a Fluke for Gamefreak because of how popular it got, now years later their inabilty to make basic level game design choices is showing more and more with each new release. I can't wait to see the dumpster fire that is Legends ZA. I Ain't buying it at all, especially if I see no actual improvement on the effort part.

@@Kakachi07 idk man i would be pretty pissed if someone just took my hard work, changed it enough so it can avoid a copystrike from the original creator and made thousands of dollar from it. If they hadn't copy the designs, I think palworld wouldn't have gotten so popular, after all it's known as "pokemon but with guns"
