It depends upon the sentence and the verbs that you use. Consider the following examples, Hence, I humbly pray that the accused be convicted as per law and be given the highest possible punishment Or it is humbly prayed that this Hon’ble Court may be pleased to take into consideration the written arguments filed in this case and convict the accused A1 to A4 first sentence is in subjunctive mood and the second one is not. I have never seen any arguments at court before, so My knowledge in this matter is limited. I'll read few more written arguments and come back to you.
