Something I learned in a class is that even if the other person/persons attack you first, if you instigated the altercation then you cannot use lethal force or even brandish your firearm (like he did). The woman slapping your phone is also not even close to something that would legally allow you to draw your firearm, furthermore if the threat against you stops (which it already had since she slapped his phone a few times then stopped) then you cannot legally draw your gun as there is no longer an active threat against you (there never really was one in this case).

Potential charges: 1. Assault with a deadly weapon (+1 for each person threatened) 2. Unlawful brandishing of a firearm. 3. Possession of a firearm while committing a felony. 4. Disturbing the peace. 5. Resisting a peace officer. 6. Simple assault (+1 for each laid hands) If he does not have a concealed carrier's permit, he will get charged with illegal possession of a firearm. If the gun was stolen, he will get charged with possession of a stolen firearm. Some of these scary long prison sentences. I would estimate he has about a minimum of 10 years, hanging over his head over this incident.
