He got an estimate and diagnosis from a shop that didn't even see the van. Does his own "oil consumption test" then tries to sue on an engine he has a warranty on. Don't understand why the plaintiff is even there.

The plaintiff came to court with hear-say as his only evidence. (ha ha ha). And if he has managed to drive such long distances (being a commercial vehicle), that his tyres are bald, then no wonder he is consuming oil. The plaintiff is too intense, I don't think this is over for him, if I was the defendant I would get a restraining order against him. The judge should have awarded the defendant something or else at least given a warning to the plaintiff about staying away from the defendant...

Oil consumption can kill a catalytic converter so if it was still good before the engine was replaced it's very possible that it does have excessive consumption, unfortunately, proving consumpton can be difficult. As for the warrantee, if he can't find a shop that will take it he needs to contact the warrantee company and if they can't find him a service provider they're the ones he needs to sue.

Codes for a cat can indeed be linked to oil issues. Could also be the reason for the smoke out of the tailpipe. There is alot more to oil issues than snap on and consumption tests. Nothing beats good old fashioned "just have a look".

those "extended warranties" are actually service contracts. they dictate how the repair will be handled. a mechanic has to agree to the terms before any work is done. the mechanic has to do extactly what they tell them or not get paid. what the mechanic is told may not even fix the problem.

I used to own a 98 Dodge Caravan, biggest piece of shit I ever owned. If the transmission wasn't giving me issues the engine was. I ended up selling the van to the state of California for 1000.00 a few years ago. Happiest day of my life.

As a dealership we can choose to turn down warranty companies because it IS a big hassel and whatever the warranty doesn't Pay the customer owes. And then the customer is pissed at us because they think we charge too much and no, it's your extended stupid car shield you bought off the TV or flyer. ONLY PURCHASE MANUFACTUERER WARRANTY. THATS THE ONLY WARRANTY THAT WONT SCREW YOU OVER!!! The outside companies are stupid. Yes they are cheaper but you get what you pay for then

He needs to document. It could be many things including valves. If it's RINGS he needs to do a COMPRESSION TEST which he did. Mechanic seemed reasonable. Customer seems angry and trying to get over on this professional. If vehicle was being used as a commercial vehicle, all bets are OFF. Guy has no proof at all that there is anything wrong with the car. Some customers are just difficult- seems to be the case here. That said, I don't trust most mechanics...at all. Recent one never rotated tires- I took pics before and after- not rotated. They lied to me to my face and charged me. Most are very dishonest. If you find a good one- value him/her. Judge got this right.

The plaintiffs issues isn't the work that he had done on the van its the make and model of the van that's the issue. Unless both the transmission and engine were both brand new, if they are rebuilt he will forever have issues with this van. Dodge Caravans are notorious for tranny issues and their engines are just as bad.

An engine is going to burn oil until the rings are broken in and seal properly also if you baby the engine too much the rings won't seat properly you need to accelerate so the rings are forced against the cylinder walls if you lug the engine too much the rings will never seat. My new motorcycle used up a quart of oil in 300 miles I had to check and add oil every 2 days now that it's broken in no problem

The defendant says he's not going to say anything about the plaintiff using his vehicle for commercial purposes but that's exactly what he did he blurted it out on National television, obviously if the plaintiff is doing that and hiding it it's wrong you're committing fraud, but don't act like you blurted that out by accident that was completely intentional and on purpose, also the plaintiff comes into court claiming that there was something still wrong with his vehicle after the defendant worked on it but comes in with not one ounce of evidence, he thinks the judge is just going to rule based on what he's saying and no evidence whatsoever? How hard would it have been to go and get something in writing from a reputable shop? And if none of the shops want to deal with your warranty that's a personal problem you need to buy a better warranty or come out of pocket, people absolutely blow my mind these days!

my first thought was 'he has a warrantee but says he wont deal with the guy who supplied and fitted the motor' alarm bells start ringing seems the motor was fine for 6 months other wise he would have complained sooner, normal people want things sorted as soon as possible if the motor is going through that much oil id say the plaintiff abused it somehow
