Defendant is delusional. Not my fault because I hit black ice and lost control. In the meantime, she was fined for driving without a licence (due to speeding), driving without insurance and speeding. What the hell was she doing behind the wheel? In the meantime, the 13 year old daughter is sitting there thinking that mum will win!

​@kyoto32001 New Hampshire does require the minimum coverage of 25/50/25 to legally drive a vehicle. This covers a bare minimum of coverage for the damage you do to others. This coverage does not cover damage to the insured's car or their own injuries.

Lol you need about 4 or 5 speeding tickets to accumulate enough points to have your license suspended. Or you could go like a hundred miles over the speed limit and get it revoked all in one fell swoop. Source: I'm a dipshit that got my DL suspended for 90 days for too many speeding tickets in too short a time. I blame ADHD and the lack of cruise control on my car. But really, I was just awful at time management.

The defendant lacks accountability. There wouldn’t have been an accident had she not been driving without a license and speeding, especially since her license was taken away for speeding. Yet, she wants to blame the city for the black ice and justify speeding by saying everyone does it.

I’m not sure what the law was back then but now in New Hampshire where she was she legally doesn’t require any insurance. Yes she needs the license 28377272%

​@@JessSmith96that is a ridiculous law that is going to end up costing people so much in the end. It's like states that don't require yearly inspections, yes you potentially save money and time but you don't know what could potentially be wrong with your vehicle. Something detrimental could be wrong and you'd never know! It's also going to make insurance rates skyrocket for those that choose to have insurance because of the lack of driver's that chose to have it; the companies see it as a potential financial issue.

​@JessSmith96 look up NH insurance law. There is a minimum of coverage you must carry to cover the damage you do to others. This minimum is probably not going to cover full damages in a serious accident.

C'mon, the city should have got rid of the black ice. 🤣🤣 Most areas here where black ice forms is in low density areas, there are always signs where it is known to occur and it is up to drivers to adjust their driving to the conditions. Black ice is near impossible to see and doesn't require snow to form, we only have the bare minimum of snow here in Melbourne in the hilly areas, so small a fall it looks like frost on the grass.

​@mickm6309 Well, sir Mick, she was driving in snowy conditions and driving a stick-shift, so she should've adjusted her speed for those conditions. You can't go squealing around corners or driving faster than road and traffic conditions warrant (nightime, snowing, possible freezing to black ice, which as you said, you can't see) -- especially when you are driving w/o a license and have no insurance. She took her chances and ended up in a bad wreck. She lucked out not being more severely injured.

And even if she had insurance on the car, the insurance company would not pay because an unlicenced driver was behind the wheel. She'll have the same problem if her passenger sues her for his injuries.

It is the norm here in New Hampshire (where the defendant is)...I see it everyday. The defendants situation is almost a daily occurrence here in the winter

Just a friendly reminder... the posted speed limits are for ideal road & weather conditions (clear weather, free of any inclement and/or non-ideal conditions such as rain, fog, snow, ice, physical roadway hazards. When driving in non-ideal/dangerous conditions, speed limits are reduced from the posted limit. Be safe out there folks! ✌

The Plaintiff should have been awarded punitive damages against the Defendant, in at least some small amount. No license, no insurance, distracted driving, speeding... If anyone should be punished with a fine for punitve damages, it is the Defendant. It doesn't happen often, but I feel this case warrants it.

If you are speeding in bad weather conditions, it is 100% your fault. Also, just because the one and only state that doesn't require insurance where your car is registered, does NOT mean you do not have to have it when driving in other states!

New Hampshire and Virginia do not legally require any kind of insurance and Florida and Jersey do not require bodily insurance.

What I hate about accidents is that even though you do nothing (like this plaintive) wrong you still lose your car and in the end can’t afford to buy a new one with what you get for it. Then you are called greedy for asking for anything extra even though there is no way to make you whole, so you keep getting screwed.

@@k0chana6 forgert about the car, if she injured the plaintiff the plantiff would have a difficult time trying to proove the injuries were sustained in the car accident, car insurance company make sure they do not pay you by telling you your injuries are pre -exisiting injuries or caused by something else when it is 100% caused by the car accident. They play a dirty game and the assholes like the defendant who caused the accident goes on enjoying their life , speeding driving like a POS again, while you the plaintiff loses their job , go bankrupt with medical bills because you cannot work for the rest of your life because of the POS defendant driving like a lunatic with no accountability.

It's the cop's fault for her speeding and losing her license. It's the state of New Hampshire's fault for her not having insurance. It's the city's fault for the bad weather and black ice. It's the car's fault for flipping over (it locked up). It's the hospital's fault for her shoulder and neck pain. It's her daughter's fault for being 13 and telling truth after the verdict.

One day this woman is going to end up killing herself, her daughter and someone else because she fails to see how it is her fault for speeding, because everyone else is speeding. IMO, I think it is unfair to just get the value of the car in the blue book. It should always be at least the value of any loans owed on it. And if no loans it should at least be appraised at immaculate condition and whatever category is higher, private seller, dealer etc. AND if things like speeding, DUI, road rage etc...The value gets doubled.

New cars for a few dollars a more a month carry gap insurance so if you are in an accident and have gap insurance you are covered. NEVER decline gap insurance. If that $10 extra bucks a month is too much, you gotta give something up.

Not everybody speeds! I dont. I make sure I am at the speed limit or a smidge under. I dont drive over but I don't go 5 miles under. I go the speedlimit! It's there to try to help keep your safe!

I went way under the speed limit over a bridge while it was snowing. My wheels locked up and we went into a spin, started going down an embankment and thankfully hit a tree. It was a no-fault accident. You do not have to speed in the snow for this to happen.

I agree. There is nothing you can do when you hit black ice, BUT you can drive cautiously when conditions are bad to minimize damage and injuries which she clearly wasn’t doing.

Anjuelle, it sounds like you did everything you could do in order to prevent your accident. I'm glad you're ok. With that being said, it's still best-practice to drive under the speed limit in any type of non-ideal/inclement weather (snow, ice, fog, rain). Bridges freeze quicker than regular roadways so I understand exactly how scary your situation was. Once again I'm glad you're ok.

Okay, Adrian. This court pays you for your presence. $500 at least, whether you win or lose. Plaintiff isn't losing out on anything, as long as they don't lose a counter suit worth more than that, and only has everything to gain, even if they're missing work.

Speeding does not equal being a lousy driver. It is irresponsible to speed but that doesn't automatically make someone a bad driver

“I definitely speed!” 1. Lost license due to speeding and 2. flipped car due to speeding. How’s that working out for you, so far? And she’s resentful that her daughter wants her to stop speeding.

Totally agree with Judge MM why would the husband go to work being he witnessed the incident. Then leaving his wife to discuss the case and she wasn’t there to actually witness it.

Yeah , I was an apartment manager and it snowed a lot and one of the residents fell ...tried to sue and the judge asked her if she saw the snow did she not have the expectation that it would be slippery ??? . I won !!

I lived in New Hamoshire it's true you don't have to have insurance however you do have to be responsible. And can't drive in Mass

Wow, the defendants daughter gets asked what she thinks and the girl says, “She should slow down,” and the defendant basically implies “She’s thirteen, she’s just saying what you want to hear.” Way to totally disregard your kid’s opinion on national television after you just lost a case because of your speeding 🙄

"First to admit I speed, everybody does" -- But she SHOULDN'T HAVE BEEN DRIVING AT ALL without a license!!! I don't get why people are on the road without a license and consider it no big deal. You have no license, you DON'T DRIVE! You get an uber. You get a friend or a partner to drive. You take the freakin' bus. You DO NOT DRIVE without a license. How hard is that to understand??? How do I see so many people on court tv or in these court cases driving without licenses and just acting like it's nothing?

If anybody deserved to be awarded punitive damages, the plantiff was. Marilyn acts like its her money! Plantiff was *knowingly* driving on a suspended license, and caused all of this. She should've been awarded PDamages. Ughhhh
