I feel bad for the defendents. They didn't know what they were doing, that's why they relied on an agent to do it for them and he dropped the ball. I know this was awhile ago but I hope they try and sue their lawyer and I hope they found a nice new home eventually.

I work in the mortgage industry and it sounded like the realtors failed on their side. They are the ones that figure out what the buyer and the seller needs to write up the contract. There should have been a earnest money deposit put down so that if the defendants did back out, that would go back to the seller. Also, there would have been a purchase agreement addendum to reflect the next closing date that the realtor would have done up. Which shocks me that there wasn't one cause realtors want their commission money! In terms of the defendants not qualifying at first, this happens on a daily basis because there are so many factors that can cause their debt to income (DTI) to exceed the qualifications. Which is why he had to go get a part time job. Underwriting can find the most smallest things that can cause the loan to fail, but it's all government guidelines.

This same scenario happened to me where in my relocation from New York to Miami to buy a home, the owners waited for me to get all the money necessary to complete the sale. Took a week longer but because he liked me he waited even though he had plenty more offers at higher prices also. Thankfully he waited because he didn't have to.

He was more than kind to the defendants and didn't have to give them an opportunity to get their financing in place. And they weren't "called out" on anything. If you've ever dealt with a bank for a mortgage, you would know they ask for all kinds of things you don't expect them to.🙄

This happened to my parents many years ago. Not all lawyers are good people. My parents were scammed out of thousands by this lawyer that in the end didn't even wind up helping them at all. Lawyers will see a naive person and take advantage instead of genuinely helping and informing them. I hope they sue their lawyer and find a nice place to live with their kids. I mean they really wanted that house, the guy even got a second job to be able to qualify for the income. P.S. After everything went south for my parents because of this lawyer, they found out that he had scammed almost all his clients. A couple years later, he died. Karma.

Homebuyers need to own the home buying process. Too many abdicate all responsibility to their real estate agent, attorney, etc. it is your purchase. Take a homebuyers course. Even if you aren’t a first time homebuyer. Speak to several realtors and know their role in the process. The attorney, bank, realtors all have their best interests at heart and they aren’t always yours

I was selling property back in '08'. The buyers had till a certain date to finish their inspections and back out. If they backed out afterwards I was to get the deposit. My realtor recieved the notification that they were backing out 2 weeks after that date. The catch was that the paperwork was back dated to before the date they had to back out. My realtor said i could 5ake them to court and probably win but it would loose all the deposit money to any lawyer i hired.

I think it was the right result. As there was no closing date whomever pulled out first is responsible for breaching the contract. The plaintiffs were willing to wait for the defendants on getting the loan but the defendants only gave the plaintiffs two weeks to get the CO before they bailed. That was not really fair. They were even throwing in a car. They should have waited a bit longer but more importantly their lawyer should have arranged the closing date. I guess their next option would be to sue the lawyer.

@@meekthegreek1623 Certificate of Occupancy. It a document saying a building is fit for purpose and meets all legal requirements of building regulations at the time it issued. Generally a mortgage holder wants to know if the asset they potentially have to realise on if the loan falls through can be sold reasonably quickly to recoup the loan amount. Reasons for delay are many but can be is that there's a legal dispute about what needs to be inspected and approved, laws/regs on what needs to up to standard aren't clear, there's a delay in getting an suitably qualified inspector to physically check and then write their report, the applicant doesn't hurry in organising any part of the process. It can involve substantial sums of money - pay for the inspection and report, pay for any fixes required (also add time delay) and then pay the local authority(s) a processing fee. Then you've got good old bureaucratic delay at all levels of the process. Older properties in areas without good record keeping by local authorities are especially problematic as you can get disputes about what was allowed and when, plus disputes what alterations were previously notified which no record of exists. Really a good professional real estate agent plus any lawyer doing the conveyancing should have sorted all out the CO well before any party gets to putting a date of settlement down, but far to many 'professionals' involved in the process who are supposed to do this want to get their fees without doing the actual full work involved and end up leaving the clients in the lurch.

Please get pre-approved financing as to how much you could qualify for property. Look for property for that price range and then go from there. And the real estate broker should have known all of what was required for selling the house including the CO. That's why you get a broker.

Unfortunately the defendants didn’t have a good lawyer at all! A competent lawyer would have known what needed to be done, and would have taken appropriate action. We’ve been through similar situations earlier in our my, and thankfully we’ve learned from them. Still out the money though.

There's something we are not be told by the defendants, if this was their dream house and they were getting all these extras for free and they obtained their finance, then why would they pull out so fast when there was no reason to, it can only be that they hadn't obtained the finance, (in which case they should get back their deposit) or that they couldn't afford the repayments, (and they lose their deposit)...

Sounds like this was not an FHA mortgage. Those are wonderful to have, they do all the inspecting work for you so that the homeowner doesn't spend all their money on repairs, removal of lead paint, etc. If you had to go conventional & you missed something it's on you. But in this case, everything is done to the letter by FHA. Again they don't want to foreclose on you so that's another reason why it was best that the denial happened the way that they did. He doesn't qualify yet, can't put the minimal of earnest money and then 2% I believe no more than 3%. So, he had a problem for sure and it's best to find out before going anywhere going any farther.
