Mine are the sweetest except if my son is walking them in our yard and a stranger passes near. Then they switch personalities. Once you're in our home and they know you, you will be slobbered to death and stood on. They are protective.

I agree. The mom probably didn't. Too bad there wasn't a lease that stated "all dogs must be on a short leash and in the owners control in all common areas". This might have prevented the tragedy. Very sad they both have cancer and lost a chance to become friends with it in common and walk their dogs on a leash together a few times then the dogs smell each other and become friends. I'd bet a grand that neither one of them ever watched Cesar Millan on TV before.

Yes! Medical marijuana is a huge help to people suffering with cancer. It eases the pain like no pharmaceutical can, & has no harmful side effects like all pharmaceuticals have. There are tens of thousands of cancer patients who have legal prescriptions for medical marijuana for a reason. The state that the defendant lives in is still living in the 50's & denying that help to its citizens, while more & more states across the US are legalizing even recreational use. Citizens of states like his have to either suffer the intense & constant pain or resort to illegal marijuana use. The plaintiff had such a rehearsed speech, using weasel words like "vicious" and "frantic", etc, then she insinuates he's some kind of drughead because he smokes weed for cancer. I don't blame him for being upset.

I used to be a landlord and all my tenants had to have dog insurance or I would not rent to them as my homeowners insurance would not insure me. This is exactly why, but when you have 3 tenants and a shared yard probably all the insurance companies would say it is the other persons insurance that has to pay then they would all be out of luck.

The one thing that pisses me off, is it supposedly happened more than once. It would only take one time for me to put a stop to something like this. Either keep your dog inside, or don't take your dog outside around another dog that will attack it. How hard is it for most to use common sense??

This is a rental property. The yard is supposed to be for all three tenants. The woman who has the daughter Olivia needs to be protective of Olivia's dog if it is there, not the neighbors responsibility.

If the mother was watching her dog, it was the mothers responsibility to make sure that gate was closed. That dog shouldn't have been let out without her checking the gate, because that dog doesn't live there. It sounds as if she just forgot to check it or she was just too lazy, or maybe she just wasn't feeling good, maybe the daughter shouldn't have asked her I'll mother to watch her dog.

The plaintiff’s spiel about “some people should just not own pets”. Yeah, you lady. You kept taking your dog to a place it gets attacked. Multiple times! What. His story on “if the gate is closed her dog is out there, if it’s open it’s cool to let his dog in.” Makes perfect sense to me. That sounds like the type of agreement people would have. Maybe the mom just wasn’t feeling well and didn’t check. All the more reason not to leave that dog with her. She’s going through a lot. As is he. Yet she had no sympathy for his cancer treatment it seems. I’m no fan of drugs however if pot helps elevate pain from cancer or other disease who cares? I would actually smoke it if it would help any issues I may find myself with in the future and I don’t like drugs. But I’d rather smoke that then take tons of pain killers or something

Based on the layout of the house, it definitely appears as if all the yard is "shared" property. Unless the mother can prove the yard in front of her entrance is hers and only hers...the plaintiff was always gonna lose. Also...its kinda bullshit that he cant use the backyard whenever the plaintiff decides she wants her mom to dogsit. That dude....plus is dog...live there. They pay rent. The plaintiff does not.

Once I heard about his chemo I understood why he was so annoying and he ceased being annoying to me. I get it I’ve seen how it affects people. It’s truly sad. My brother in law’s mother is currently dealing with cancer treatment and it’s effects on her and she just seems so over everything. It breaks my heart she’s a nice lady.

When the judge calls it is because there is some ambiguity in what is written down (either the bill or affidavit) and it is to clarify what was meant. This case would have called to cross examine what the mother says, and as Judge Milian said, "when I cross examine for credibility I need to see the whites of their eyes." On the phone somebody can still get away with lying because you don't see the physical nuances when people lie. It is not up to the judge to make or break a plaintiff or defendant's case. Now what she should have done is phoned the landlord regarding the property and who has access to what part of the property.

Hold on the defendants math and mathin... He said he gets 240 oxycodone a month. Then says he takes 6 a day🤔🤔... 6 times 30 is 180... 6 times 31(for the months that have 31 days) is 186... If he's getting 240 that's taking 8 a day on 30 day months and taking 7.74 on months with 31 days!

So they are given a certain amount each month and told to take anywhere from x amount to y amount a day depending how they are feeling that day. His max daily is most likely 8 however he doesn't feel he needs to take the max daily amount. They don't have to take the same amount everyday. Most people do. Some days pain is worse than others. I'm a nurse, and worked in pain management for awhile. Hope that helps. ☺️

Any dog that attacks other dogs and causes serious injuries leaves its owner liable for damages. The fact it happened twice proves the labrador is a vicious animal. The fact it happened twice also shows the plaintiff's mother did not take proper precautions when dealing with a neighbor who owned a vicious animal. If anything, the vet bills should have been evenly split between the plaintiff and defendant. The fact the plaintiff's mother had no way to show up in person, due to a serious medical condition, could have been mitigated by contacting her via phone, but that was not even entertained. Not impressed.

Yet the defendant’s dog never once attacked her mother’s dog or any other known dog? We know of two incidents and the only common denominator is her pitbull. I agree. I think it was their responsibility to protect their own pet, knowing their dog is not normally there, and doesn't get along with the defendant's dog.

I agree. The whole tragedy could have been prevented if there was a lease that stated "dogs must be on a leash in the common areas and the dog owner is responsible for an off leash violation (fine) and/or damages from a dog bite to people or pets". An even better solution is to socialize the dogs together via the Cesar Millan Dog Whisperer methods.

I have a different take on it. I think the aggressive dog owner should be liable. How long until that dog attacks a human? Different States Different Laws. My state the dog would be put down by Animal Control. This mans dog is a very aggressive dog we need the dog whisper Cesar to get this aggressive behavior out of this dog. lol... In the mean time I'll wait until we see him back in court for the next attack.. because nothing has changed except now he feels more untitled to let his dog be aggressive.

The plaintiff did NOT "provide more than enough evidence". It was all dependent on the rules of the house. The plaintiff's mother said her lease stated the back lawn was all hers, but they provided no lease. The defendant said there were no leases for the house. What she needed was an affidavit from the landlord confirming that what she said was true. This case was all she said he said because there was no proof..

this guy is a jerk BUT I also take pain meds, have taken them for over 15 years for my back. Unfortunately we're still in opioid hysteria even after the CDC had to amend their guidelines because it was being misconstrued & abused. My husband has cancer, it's a pain unlike any other, THAT is the only thing I'm on his side about.

Is your husband a jerk? Meds or not, he is a jerk. I've lived with and had people in my family die of cancer, guess what, they were still the same person all through their treatments. Sure they were in pain and had bad days, but their personalities stayed the same. A jerk is a jerk, no matter what...Also I am truly sorry for what you are having to go through with your husband. I understand how hard it is being a caregiver for someone with cancer.

She should've had her get her mother on the phone, and the landlord. This was such a miscarriage of justice. Had it been her "pitbull" that did the attack , everyone would be blaming her and her dog. But lo and fucking behold, because it's a "sweet" BLACK LAB, no one bats an eyelash. This is disgusting. She should've won the case.

The plaintiff needs to stop blaming others. One attack you can stand by "I didn't know" but after that it's owner negligence. It's simple... stop taking your dog to a house where it has been attacked! Poor dog

Her dog wasn't part of the household, if it were attacked once, then find someone else to look after it while your away, and not leave it to a very ill person who cannot be held responsible for events. In other words, pay to protect your pet from injury rather having to pay huge vet bills after the fact.

Judges him for smoking pot but says nothing about him taking 6 Oxycodone a day. The legal method is wreaking havoc on his liver, kidneys, and heart but the method that is better for his health is illegal. At least his pot isn't killing him while giving him a natural pain relief. That's why I smoke pot and live my life unapologetically. Human beings are a trip!
