Apartment complexes will come up with ANYTHING to keep your security deposit. The routine maintenance that they do in between tenants they now charge it against your security deposit.

im a painter in california and the law here is if u live there over 2 years then u dont have to pay for repainting and the landlord should have had at least the empty paint can of paint last used so it could be easily touched up in a few minutes. most landlord tenant law is always in favor of the landlords since most lawmakers and judges own income properties , thats the dirty secret about this stuff.

I'm a landlord & I don't see any major damages and the apartment was clean. I would've kept some of the security to repair the walls & moved on. After 3 years an apartment with kids will need carpet replaced & painting so the landlord is being unreasonable there.

Are you serious? The top of the refrigerator and the ceiling fan were disgusting and the carpet, walls, and window were destroyed, yet she did NOTHING wrong? I also find it interesting how she had screens to block the view of her house. She obviously didn't want us to see how messy her house is.

It lost some of its softness over the years, but it would be CRAZY to think it needs replaced already. And I have a 9 year old and 3 cats. 3 years is insane to be needing new carpet unless you're a slob 😂

As a cleaner, I’m pretty sure he was looking for carpet lines from vacuuming (essentially looking for a professional clean) and that’s not something a regular tenant would know to do or know how to do. He should state in his lease his expectations or include a move-out clean fee upon signing the lease. That aside, she’s an idiot for thinking she can just patch holes and not finish the job and it would be ok. And YES you CAN match paint. Any paint. Just take a box cutter and take out maybe like a 2”x2” piece of the paper part of the drywall, take it to a hardware or paint store, patch all damages including what you had to cut out, prime for consistent texture, and paint.

I expected the place to look far worse than it did. I agree with her on the paint job I would concede it wear and tear also with the exception of the holes which would need to be sanded. The only thing I saw on the landlord's video was a dirty ceiling fan and a phone book and dust on the fridge. That being said I know everything does not always show up on camera.

There were small globs of black stuff in the carpets that was all over the place, they show it at 12:37. The judge even knew she was a hairdresser without asking because those are common when using chemicals like a hairdresser on carpets. Then there's the broken glass..

When I'm staying somewhere, I know when there's a broken window because it's where I'm living. If she had said "Yea, I knew about it and I contacted the landlord", then it'd be reasonable. When she denied the gunk in carpets, and whatever was in the ceiling fan, her case of "I had no idea" stops holding weight.

When I rented and decided to leave I went above and beyond. Painted all the walls with the Sherwin Williams paint. I replaced everything from lowes becuse that is where they go to replace things. I got everything back and was told I can come back anytime. I will never go back because they were petty. I was taught if you are using someone’s stuff or renting it take care of it and replace whatever was my mess.

If you take a small piece of the paint to Lowe's or home Depot they can match the color exactly with a machine. It's really cool. I learned that through a contractor.

Hear me out. If I was renting to someone, I personally wouldn't want them to fix anything unless I've seen their work. It's extremely cheap and easy to patch holes unless they are huge. But I'd rather do it myself so it will be done properly. And the carpet needs to be replaced for the new tenant. You just don't know how they lived on it.

Cheap skate landlord. Not repainting after 3yrs means the next tenant has to inherit the 'normal wear and tear' (fading/flaking/chips etc) of the previous tenant and run the risk of having their security deposit withheld for accumulated wear and tear that preceded them. And looking for costs to evict a tenant that had already vacated is just nuts!

I didn't really understand this case. I felt they could have met halfway. The apartment did not really look that bad and landlords do need to make some effort to get things ready for the next tenant. That is part of their responsibility. They cannot lay all of their charges on the previous tenant.

What is wrong with JM here? Professional cleaning of carpet is normal and expected... you have to have it done otherwise the carpet isn't in a sanitary condition for the next tenant! Nobody wants to move in with dirty carpet-- the landlords certainly don't pay for it. (That is the only thing all of my landlords took money out of my deposit for.) And it seems to me, after 3 years and with kids, the place looked exceptionally good! I saw nothing filthy. "Filthy" is a word he over uses! And taking a picture of the fan from that bizarre angle was a dead giveaway that he *is* money hungry!

The place didn't look that bad from what the l.lord showed. If she was that bad of a tenant, he Should've, Would've, Could've tossed her out after year #1. Or, he could done his due-diligence to get her removed from his property *before* the end of year #2. L.lord should keep all walls white or egg-shell in color; this way, the tenant nor the l.lord won't need to go on "color-matching" hunts. Less headaches for all imho.

Where I live its a law that if a tenant lives in a rented establishment over one years time.... the landlord is responsible for repainting their unit. Thank God bcuz I have lived in the same place exactly 7 years as of yesterday and if I chose to move out tomorrow aint no way I should have to repaint this place out of my own pocket. That is normal wear and tear.

Some walls just can't be cleaned, and need to be repainted entirely. That's not the tenant's fault, that's on the landlord for using cheaper-'n-fuck paint that comes off if you even _look_ at it wrong. Not saying that's the case here, but trust me. Every house I've rented had that, including the one I'm in now. The walls are covered in a random assortment of bug splatter, and not only can I not physically clean them I'm not even allowed to paint.

The landlord might be a little unreasonable thinking after 3 years, an apartment's walls can just be wiped down, but she was petty talking about he's 'money hungry' and all. Landlords often have to pay out of pocket for things that tenants leave behind or damage. You don't want them raising the rent or keeping a portion of your security deposit, but they have to be making money being a landlord.

The way this landlord was, i honestly think HE put the gunk on the carpet, took a picture and said she did it just to keep her deposit. Out of all the landlord tenant shows I've seen on here, hers was one of the best kept places, and he himself said he uses semi-gloss paint because its easy to wipe down so why couldn't he just do that himself? Petty, ignorant and greedy asf. JM definitely got this one wrong.
