Philip DeFranco great job on the extra video today too... Here in SC, they have introduced a bill this year. Now I have an idea of how hard it will be for our local gov to get close to passing it. Since Cal. has 80% extra, it would be nice if the US. gov. could pass a law where Cal.s EXTRA marijuana could be sent to the other states that have it legalized. Great job man!

KZbinrs that can afford it need to start getting legal counsel to hold KZbin responsible when there's no good reason for the loss of revenue/demonetization (sue for lost income) so that KZbin will take this more seriously for all creators and find ways to rectify the situation. They obviously aren't aware that KZbin can get sued regardless of if it's a free platform or not because they are providing us a SERVICE and when money is involved all hands are off the table. There's a reason why places like Facebook and the likes can get sued regardless of if it's free or not. Without creators, KZbin isn't shit. CREATOR *CREATE* the money for KZbin. If not for them, they'd be no videos for KZbin to put ads on and get money. So they better get their shit together quick.

hoosierhiver KZbin makes a deal with these content creators. KZbin pays them because they attract new viewers, and KZbin also makes money from the ads on their videos. I think KZbin is obligated to pay these creators, so they should be held accountable whenever their system malfunctions and creators lose money. I don’t think you understand that KZbin is a JOB for thousands of people, and when those people don’t get paid, they are directly impacted.

It’s the legality of it. KZbin did not gain anything while Shane’s vid was demonetized therefore they don’t need to make him whole for a loss. Since no ads aired in that time KZbin was not paid for the ad time by the companies meaning there’s no money to give Shane. Although I agree it isn’t right and he deserves it but if they had to pay each time someone got demonetized then KZbin would be bankrupt.

Hey Phil! I'm hard of hearing and I often find it difficult to watch your show bc there's a lack of captioning. I find myself rewinding a lot to catch what you say and it, sadly, makes watching the show more of a task rather than a leisure activity-- but I still manage to try and watch nearly every day. Captioning would make my, and so many others in the deaf community's, day so much better. Hope you see this and have a great day!!

why doesn’t youtube “prescreen” videos, aka running them through the algorithm before they actually go live so that incorrect demonization can be dealt with before it hurts the creator?

If the uploader schedules a video to go live at a certain time, and they check the video after the video finished processing but before it's supposed to go live, then they should see any alerts that make the video uneligible for monetization, or any copyright claims by the algorithm. But if you let it go live as soon as it's done processing, you won't have a chance to check. (Since Shane wanted to get the video out on the 30th as promised, and had to make some last-minute edits that already made the video late, I think he wanted the video to go live as soon as possible)

Another issue with this is the enormous amount of content uploaded every minute. I’m not sure if the exact figure, but at one point last year there was over 400 hours of content uploaded every minute globally

I remember thinking about this possibility maybe 10 years ago and realizing the technology would get there soon and the security/truth-verification issues it would pose. Thankfully, even more advanced technology will likely get developed to be able to detect the fakery, though I've no idea what that would entail. It probably already exists in the hands of advanced military applications.

Fancy seeing you here. KZbin relies too heavily on algorithms that are supposed to "learn" what to filter. But they don't correct errors. They just chalk it up to the algorithm "learning" what to do.

With the whole deep fakes thing, I don't see how it can be used for anything good. Besides putting Nick Cage's face on celebrities for _the memes_ , what else did the devs expect from this. I feel like there was a moral decision to just leave this alone and it flew over their heads. Edit: Someone reminded me that it can be used in film if an actor can't make it or has died. Which _is_ useful. But I mean...still... The cons outweigh the pros. I suppose full blame shouldn't be put on the devs because people can take literally anything and make it creepy/harmful.

Cuban here, hi. I know that noise. Cuba has EXTREMELY old infrastructure and i is common of a lot of us (Cuban) kids to have inner ear issues. I myself had surgery as a child in Cuba to repair my inner ear and I hear just fine. I don't know the exact cause of this but it is something what we commonly heard in Cuba usually close to the time that they turn off all the light around Cuba. There is something called "El Apagon" where all electricity was turned off forcefully around the island except in hospital. This noise was and the sudden shutting off of the lights go hand in hand. We always thought it was a result of the electrical surge from heavy machinery. I don't know if it is still a thing as I came to the U.S.A when I was 10 and now im 25, I haven't gone back. hope this gave some insight on an odd mystery.

Suggested solution for youtube, allow creators the option to put their view thru an automated content review before pushing live. That way any automated monetization strikes could be addressed without losing views. Then any video flagged that has passed the pre-content review could still show ads and hold monetization in escrow while it is humanly reviewed. Perhaps, even allow advertisers to have a discounted rate to display ads in this grey area while in a review. So those advertisers are displaying with them with the for knowledge.

I think that’s already an option. You can upload a video as unlisted or private and youtube will automatically check if its eligible for monetization.

@@shannonclark3628 but it's not clear when youtube has completed a check. They should show that it has passed a monetization check and it's safe to go make listed. Additionally, there should be a clear written policy. Content creators rely on monetization, and this current system is just broken. A step further should really be that monetization should be done in categories or levels. So an advertiser can make a decision on what they what level they will be willing to pay for, perhaps there is a premium for a top-level safe video but news or topical related video categories have a standard ad fee? There are so many ways youtube could improve this system, but what they have not is hurting everyone.

I'm not even going into the price of all the stuff they already have like that nice house and other countless things. To us, he is doing very well with the number of funds he makes per video. But it's hard to just brush off the fact that making a video like that is producing a deficit.

Almost like networks pay for a spot like advertising or how KZbin partnered series also get priority or how some videos launch straight too it. Trending is 2/3 pay to play if not more at some points.

I seriously cannot thank you enough for the noise warnings. I suffer from migraine heaches which can be triggered by certain sounds. Without that warning, my day would have been completely ruined and potentially filled with a trip to the urgent care. I wish those warnings were on more media!!

@@oanaalexia Because they're unnecessary. This isn't 2007 and we're not all getting Rick rolled or having the Exorcist or The Ring girls jump out to try to scare us. As someone just getting over back-to-back inner ear infections in the same ear, I never once had an issue on KZbin with overly loud sounds. Network tv is another issue, but most sound devices have audio options to level off the surprisingly loud sounds to that of any other. Something that's very useful if you have any sort of sound sensitivity. Or neighbors.

@@skateranddancer I know homeshooldropout and Andy Rehfeldt are good examples of people using music legally under fair use law to create mashups and are both currently struggling to find a way to keep their channel from getting perma banned let alone remain monotized. Lemaitre is unable to even give people permission to use his music on youtube. The largest problem is just about any auto generated "Topic" channel (eg [Musician] Topic) because that literally takes away *all* control you have and replaces you as the artist... Which is honestly just flat out crazy. From what I understand that is the primary perp. If you shoot Andy an email I'm sure he would be willing to explain it better than I can (after all I'm mostly reacting to videos or complaints they've made about it)

@@NeoStar Phil discussed this with the community ages ago. His concerns varied, but included: 1) Cost. They'd either need to hire a full time individual or they'd have to hire a 3rd party, increasing costs on producing the show significantly. 2) Time (his main point) His show's turnaround time is hours long, and the final video's order of words changes rapidly until it enters processing. It's extensively edited, and his process can edit it multiple times. From my memory, he'd need to bring the party who he hires to do captions in to do them, after or just before it enters processing. In a 15+ minute show, that would delay the show by at least an hour, or several depending on the content of the video. He felt that this delay would hurt views significantly enough that he wasn't in a position to consider it himself. I could be misquoting here, blame my memory. It's been months since he talked about it. However, in short, he said he'd considered it but didn't find he was able to do it in the current stage of his company. TVs and movies have far larger editing teams and writers rooms, with a shorter turnaround time vs amount of content produced, and has a 3rd party who does the captions, which is why so many mistakes are made. Their final product is already finished, and the 3rd party can even write them live as they air. Phil would have to take significant cost on the company, and due to the varied length of production on the PDS. I think it's unfair to compare it to companies who have hundreds of times the audience he does, and see multi billion dollar companies or more who are obligated to provide them under law, but I sympathize with your frustration.

They don't have that many people. They have problems uploading on time all the time because of videos taking too long to edit and upload. The chances of him seeing this comment is almost 0 and the chances of them being able to make the captions for all of his videos is extremely small too. He would probably have to hire another person just for that. Which means he has to pay another person. He may not be able to do that.

DeepFakes are both amazing and terrifying. Amazing that such a feat could be accomplished, terrifying that it is so easy. Definitely in an era of react first fact check later, they could be detrimental to any person. Especially since a large audience will see the outrage story, but a smaller audience will get the update with the real details. No one is safe.

I don't think they should be banned though... I mean, was photoshop banned? This is just the next iteration of it. Back when photoshop became a thing, people were led to lies about pictures of people doing things they didn't do too. Why would simply now having a video be any less of a learning thing? Don't believe everything you see, investigate. To ban the entire tech from many incidents is just fucking stupid, and reeks of a fear based tack on tech, which is not the strategy to be using. Especially when 25 years down the line, this is going to be the least hard thing to do in regards to this, and bans on it will be ineffective. Instead, take an educational approach to this, instead of insane lawmakers who just like dope in the 60s and 70s thinks banning is the way to go.

On the fake university issue, if I was looking to go to college and use a student visa; had I taken time and settled on this fake university, just to find later that there are no actual classes, then I wouldn't necessarily be able to quit and go to another university. Finding our about it's true nature may have occurred after certain deadlines. So for that semester I would have just taken the enrollment to get my student visa and then looked to join a real university next semester. These students may not have known the reality of this school until it was too late for that semester.

Sin Stalker I don’t think so, they wouldn’t have gotten the visa with that university in the first place. They enrolled somewhere else and transferred to that university to work illegally. I’m on F1 and I am completely confused as to why they would pay 10k in tuition just to work a $10-15/hr job. CPT is part time during the year and companies know that. I think it’s more to work multiple jobs outside of the cpt program with their ssn

The thing is, if this had been a non-sting scam the university never would have been on the Department of Homeland Sceutiry website. That fact adds a lot of credence to the entrapment argument because it was way too set up to be a legal way into the country that I believe a lot of well-intending people could have also fallen for it

But by that time, they would already be in the country and would be so deep into it that they would fear being deported or being actually caught for doing something bad, and this then feeling like they have to stay in the program. Thus, they did something that they wouldn’t have if they hadn’t been enticed to by the government. Hence, this most likely falls under the defense of entrapment.

Idk. I’m from Detroit, so I know for a fact that there’s no university of Farmington. In fact, Farmington is about a 30 minute drive from Detroit. So, I was confused as to why there would be a school named after a city that’s not where the school is located. Anyways, for a foreigner, having the city be that close and then being listed as an accredited university, would be incredibly confusing

I think established KZbinrs should be able to run their videos through KZbin's content-flagging systems BEFORE they post them publicly. That way if there are any issues, they can be resolved before income becomes an issue, rather than interrupting their income after the video is live and a significant portion of their audience has already seen the video ad-free.

Yeah, seriously. I may have missed some details it doesn't seem fair to consider what the foreign students did as fraud. I guess it depends on how the fake school went about saying there would be no classes? Either way, if I was a foreign student who saw a good way to get into the US from a seemingly legitimate place I wouldn't turn it down. It's fucked up to trick people like that and then arrest them for fraud after taking their money.

And was there anybody who came across this university looking for an easy degree but was actually U.S. Citizen? Were they allowed the same opportunity to commit fraud? I'm very curious as to how this was handled and how they chose which victims to "accept" at Farmington University. The methodology of a project this big, impacting this many really needs to be looked at in depth... Edit: It's just hard for me to believe they set up a fake University and only had immigrant students apply.

Entrapment or not they only took money from people who were breaking the law. No one applies to a university with no classes or professors without asking a few questions unless they are there for shady reasons.

Someone taking the bait isn't really entrapment... making the only option the trap and directly contacting the person to encourage it, is entrapment. Purposefully going out of your way to be tricking someone into it, or as is defined as in criminal law: "entrapment is a practice whereby a law enforcement agent induces a person to commit a criminal offense that the person would have otherwise been unlikely or unwilling to commit." Note the "would have otherwise been unlikely or unwilling to commit.", individuals taking the steps TO COMMIT IT on one's own volition negates it being entrapment.

I feel like their fatal flaw with this will be the fact that it was listed on the DHS "approved schools" list. Even if the kids had done the research, it would've shown them that the school was certified so there's enough deniability on their part to say they didn't think it was wrong. Like, maybe DHS had this school set up so you could work and make money for a semester and then go back to another school. Interesting story and I'm curious how it turns out. Really feels like entrapment tho.

Lol There is a lot of similarities to deep fakes to back in the early days of commercial photoshop editors. There was a lot of fake nudes of celebrities that popularized them and a lot of fear of people being framed etc. There is a lot of differences though. Video is more substantial than just a photo and deepfakes as of right now are not as user friendly to make.

I think with the deepfakes it should just force the system to include a watermark in a corner of the video because people are going to make them regardless for porn or funny videos etc. And people who make those type of videos won't care if there is a watermark in the corner but people who want to try and pass these videos as fact for malicious reasons the watermark will let everyone who's sees that video will know it's fake. But who knows if a watermark can even be forced on the tech. And you can then put on jail time and fines on deepfake video that don't have a watermark.

Watermarks on pics are already unreliable, and are easily removed in photoshop. It would be nice to include some sort of deep fake watermark, but in reality if someone is dedicated enough to use deepfake they would have the means to remove watermarks or other visual data. It is scary now that our kids will have a difficult time telling true video from faked. Maby you can record a lava lamp in the background to encript a true video mark, and make it more difficult to hide a deepfake against it.

Deep fakes are a bit of a tricky thing. On one hand, knowing about them raises awareness. On the other, it gives more intrigue and traffic to them, mostly (I’d hope) out of morbid curiosity. Now, I’m not with it. It’s beyond creepy. Fandom already makes manips, which can be cool, but also really intrusive at times, ie making a child pictured with said actor with another actor of the ship as the child becomes a prop of their child... or, ships with one actor and their sibling being manipped to the ship. Deep fakes are manips with extra steps.

What you found was some jealous bastards not understanding that when you are fully independent and not shooting in your home office, and not editing your own videos, and having a research team, that that shit costs some coin. They think he's rolling in money already from the SourceFed days, and that he shouldn't be asking us to help pay for the content we're getting. His studio alone probably costs more a month than what he's getting in ad money.

@@devilord3271 that's weird. Was phil talking about ads the entire time on the PDS? No he was giving the news. If Phil was going to take my $5 and make into $50 and talked about it with me I wouldn't have a problem. He's still making PDS every day and has been able to afford to make the deep dives in the morning. Is able to make longer shows on a regular basis. 2 years ago there were no morning shows. The PDS rarely made it past 12 minutes. He's delivering on making it into a network by expanding more little by little. So I don't see the problem here

It's so interesting to hear you talk about the F1 student stuff because I actually just left a job working with F1 students as a DSO (Designated School Official)! I remember one time I asked my PDSO (the head DSO for the school) about what happens if a student goes over their allotted unemployment days and technically violates their status, and she said that they can be caught and punished by DHS at any time after that, but the gov't has to actually find (re: notice) the violation first and (her opinion) that hardly ever happens so why even have that rule if they're not going to enforce it. That's why I'm a little surprised that this much effort went into something like this lol. Regarding entrapment, so it sounds like F1 students that were admitted to an actual school found out about Farmington once they were in the US, found out it would allow them to 'maintain status' without actually being a student anymore and subvert the work authorization process, and /then/ transferred there? I assume none of them came in intending to go to Farmington directly, knowing it was fake school, bc then the school name would most likely be on the visa and ICE could've just arrested them there, and also how would students know it wasn't a real school /before/ they entered the US? So assuming all these students came in on a visa/I-20 from a legit school, with no prior knowledge of Farmington or of it being fake, and THEN found out about and transferred to Farmington, it does seem like ICE was enticing the students hard to break the law because, again, from what I'm hearing it sounds like these students did demonstrate an intent to follow the rules - if they didn't check into their original school and maintain their status there, I doubt a DSO would even be able to transfer them to another school (F1 students have an electronic SEVIS record that has to be transferred in the government system from one school to another, and I'm pretty sure to even transfer the record the student has to be in Active status, which it wouldn't be if they never checked in or shouldn't be if they weren't maintaining status already). There's 1 or 2 unlikely scenarios I could imagine them maybe getting around that but I doubt anyone's reading this anyways lol. If Farmington hadn't existed, those students probably would've continued to maintain their F1 requirements or go AWOL purely of their own will and be subject to deportation anyway. It's a good way to catch those supplying the documents, but it seems like misdirection of effort (at best) to catch bad-actor students imo.

The website piece is the one I can't wrap my head around. I'm kind of wondering how stupid someone could be since those sites are such a pain to get on in the first place since they started cracking down on the fraud. I feel like if anything is going to sink their case, it's going to be that because someone who's already in the country on an F-1 would actually have the knowledge that checking it might be a good idea.. I know there have been several big visa mills in HE, but didn't they all go the unaccredited/crappy-accredited, but enough to get DOE authorized way? I've been amazed at how long some of the diploma mills have lasted and they seem to use similar setups. There was the big (for a visa mill) Christian one that I think managed to do both new issue and transfers. To me, this seems like it's really targeted towards those students who came in viewing an F-1 as a gateway visa from the get-go. That could simply by my jaded by working in HE opinion though.

Yeah students are supposed to understand what their responsibilities as an F1 nonimmigrant are and eventually I would think that they were aware of what they were doing. I'm totally empathetic to not being an expert at a foreign country's immigration rules, but they' are responsible for their status and at a certain point it's hard to believe someone wouldn't understand what the school was offering them was illegal. Oh wow I've never heard of visa/diploma mills, but that totally makes sense. (I was only a DSO for about a year, I actually left to get a grad degree to work more in higher ed.) I didn't think about it before but I totally agree that the whole thing seems targeted at those students, and I can totally see students seeing it as a gateway. It's ultimately the student's decision to go with the scam once they're cognizant of it, but it feels weird to me because of the targeting. Like my green new to HE thought was that if ICE had just posed as students to the recruiters and hadn't 'tested' or involved the students by actually admitting and enrolling them, the students might have just sucked it up and put in the time to get OPT to get STEM to get H1B, but also maybe they would've just found another fake university.

As an international student on F-1 visa, I can say with fair confidence that people applying to those universities knew exactly what they were doing. Though I don't have any concrete proof, I've heard plenty of stories of people who use these "loophole" (for lack of a better word) methods to stay in the U.S. and get employed. Also I'm pretty sure that there are plenty of fake universities that do this stuff still out there.

That is an Auditory attack, it can cause permanent hearing loss. It messes up your inner ear which can cause vertigo, sickness (throwing up), inhibit Ballance, hearing damage. This tech is a weapon of war and used for crowd control (not in the US, it is too dangerous/unethical) this is targeted and malicious. Wouldn't be surprised if they knew exactly what it was and kept quiet about it to smooth things over. It is Canada after all.
