Being a single mother is no one’s problem but her own. People need to stop bringing that up. My mom was a single mom of 4 kids, and raised us without having to scam people. She worked hard, with integrity. A lot of single mothers don’t have that anymore. As you can see here.

I worked for Verizon for over 10 years and I'll tell you what it sounds like she did, she added another line to get the phone (or upgraded, which i doubt) and then sold it, it's likely she got a BOGO offer. The sales person was in on it which is why it was not completely blocked, because the sales person activated it first because they had to or they wouldn't have gotten credit for the sale, when I was in customer service we'd consider this commission fraud and many times I'd change the IMEI status to fraud which could shut the device down but not always, it does block the IMEI in the system.

@@michelehemlokhexwhite4310 that's putting it lightly, I did opps, the craziest thing I'd seen was an employee stole my old company phone and i found out when I was doing inventory and it was missing from the reconcile sheet, I scanned the serial number to find it and my number popped up with the serial number on a consumer account, I called the customer and she told me rep gave it to her...for reference, an employee phone number should never show up in the consumer system, our accounts could only be accessed through a special department or human resources unless we were just paying a bill or getting a warranty replacement.

Plus even if he would have stayed with TMobile, he probably wouldn't have got to use the phone for long because they would have shut it off too once they seen payments weren't made. A friend let me use a phone they didn't pay off. I probably had it for a week and a half before they cut it off and I couldn't use it any more.

In these types of internet/Facebook Marketplace/Craigslist deals, it really is on the buyer to make sure the thing they are buying, in this case a cell phone, works. That includes making sure it is not stolen, making sure it turns on, and making sure it works with your current carrier. Buyer beware ALWAYS.

Its YOUR job as the buyer to be aware of what you are buying. Maybe the fault lies with TMobile also for not telling him the phone being transferred to his account (at the time he bought the phone they both had TMobile) was not fully paid off. But I still maintain that he could have (and should have) asked that question to TMobile himself. Thats what being extra vigilant means - especially with these Craigslist/Facebook Marketplace sales. You really need to assume everyone is always trying to scam you, and you need to do ALL the extra side work yourself also to make sure you are buying what you think you are buying.

This happens ALL THE TIME. The easiest and fastest way to check is to insert a sim card from a different carrier. If that carrier doesnt show in the corner than it means the phone is network locked by the original carrier it was purchased from.

I was with the Defendant until the end bc I have outright purchased prepaid phones and had to jump through hoops to switch carriers. I thought that it was one of those situations. But, she admitted in the end that she knew she owed hundreds of dollars before she even sold it to him. She should have sold the phone AFTER she paid it off.

Exactly. I have 4 cricket phones for $120 a month for my family. Phones came free with the sign up, but you could pay a little more for an upgrade. I paid like $50 and got the next android up. Every month I have the same bill price and if I don't pay it shuts off. No contracts or anything. I also have upgrades available so it works out. If I can't afford to buy a 1,000 phone outright then I don't need to have it on a payment plan with a contract. It's planning for failure.

What a ridiculous statement for the plaintiff to make about the defendant, after he had been so very patient with her, saying that she was afraid that she wouldn't get the phone back from him & this is basically the bogus reasoning she attempted to use to keep the plaintiff's money. The defendant was the dishonest person throughout this entire fiasco & I guess she expected the plaintiff, because of his previous patience with her, to hold onto a phone that he couldn't use or enjoy for the next 20 years because it will probably take her that long to pay the phone off being a single mom working at a donut shop. Unbelievable. I'm glad that the plaintiff received his money back, & rightfully so.

The lesson here is - if you are trying to save a buck by buying something that normally costs thousands of dollars off Facebook or Craigslist, make sure you do ALL the proper research ahead of time. You as the buyer need to make sure the phone is not stolen, that it turns on, and that it works with your current service before you hand over $600+ to some random person you literally just met off the internet. She might have been shady, but him just taking 5min to properly look over and evaluate the phone could have avoided all of this.
