As I wrote in the response to blackbeltbarrister is that this law forcing you to comply with the TV licensing officer to aid them in finding out if he was watching television. I have seen videos before where someone was forced to show the license officers potential evidence of him violating that law. But IMO this level of forced complication ought to be seen as a violation of the human rights any person ought to have. If one of these capita goons arrives with the police you have to let them in, fine, but then you have to comply with the capita employees to prove you do not watch TV. Well Fudge that, letting them in, fine, a judge signed off on it but after that it is down to Capita and the police to prove you are able to watch live TV. As a suspect of violating the law, the European human rights state that any suspect has the right to remain silent and does not have to aid in the investigation of the crime he is accused of. So no person who is confronted by these goonish figures should be forced to help them in their investigation but that is approximately what blackbelt barrister stated because of you refuse to comply with the capita goons your penalties go up.

@@petervandervliet640 As I understand it, it is not enough that they prove "you are able to watch live TV". They have to prove that you do or have watched live TV without a licence.

Yeah they would rather arrest people who make edy jokes online than do their actual jobs😤 I'm referring to the scottish youtuber "Count Dankular" who was arrested for making his dog do a nazi salute to piss off his girlfriend. The Scottish police literally went out of their way to find a jewish person who found it offensive just so they could fine him (it took them multiple weeks to find one) not only that but in their court case they stated that they are ALLOWED TO IGNORE CONTEXT despite the fact that he stated it was just to piss off his girlfriend at the beginning of the video 🤬

Funny as buggery, being the police are the criminals of the police, and he wanted, it was plainly evident, to have an excuse to arrest the man. This dirt bag is what we have as a police force, whilst Magistrates, in London daily see officers brought before them.

from other videos I've seen them do a lot of 'assisting' - one solution I saw was put the camera their faces and insist they answer the question: 'can you confirm that you are acting under your oath in this matter/at this time' that scared them off.

@Trixie K Absolutely. TV license warrants are issued under section 366 of the Communications Act 2003 and it only gives the power for "people authorised by OFCOM or the BBC" to enter a property. Police have ZERO rights under this act and if they're actively assisting the goons then they're acting outside their powers and opens them up to a civil claim.

@@user-bo3mp8un6c well considering the officer there, isn't a special crimes officer clearly by uniform, as most burglary investigation teams operate plain clothes or smart attire, so he's a regular patrol officer or probably a neighbour hood officer, so he gets assigned this. All the investigation a regular officer does for a burglary is take a statement and arrange forensics and then write up a report and then pass it onto the other team not much investigation to be done. Only really matters when you know who committed the burglary. Most Police are required (if asked) to attend a call from bailiffs and or TV enforcement agents if they are executing a warrant on behalf of the courts. All I see in this video is a TV enforcement agent, who probably always asks for police to come as he's had a lot of problems (wonder why) a random bloke can't remember why he's actually there and an officer that's literally just standing there. So much force 🤯.

@@TheDangoNinja Why waste police time and budget on what is essentially extortion? Do you have to opt out of Netflix and then allow them to inspect your house with police present? You seem to be struggling with the use of force in this context to describe their presence. The dimwitted and often poorly educated police officers don't know enough about their job to question the BBC abusing it's powers so they just go along with it and only act in protection of the agents' rights, not the tenants. You seem to take things too literally. Do I think those exact officers should be investigating a burglary? No. Do I think the wasted funds should be put towards better use such as actually getting on top of real crime. Definitely yes. Don't be such an aspie about it and try considering the purpose of my argument.

Well done, what evidence did they present to the court to obtain the warrant? They claimed that the court accepted the word of an enforcement officer, but what made him suspect that live TV was been watched. The fact that they backed off makes me very suspicous.

That's the first thing that came to my mind, firstly the homeowner is not going to admit watching a TV, and secondly the licensing goon's would have needed to look through the homeowner's window to observe him watching TV, therefore they would have no legal grounds. I wonder what evidence was put before the court to issue a warrant!!

The BBC do not want to get stories in the news of forcing entry to single mums who can't pay their tv bill (It is mostly single mums who get caught for some reason) and it is bad PR. So they take refusing entry for a warrant as the next best thing. He would be in court. Capita are happy to take refusal of a warrant as a win. They get paid either way.

Australia quit issuing tv licenses over 50 years ago. It is totally ridiculous requiring a license just to watch television.

Be careful what you wish for - ABC is funded by the Australian Govt (i.e. Aussie taxpayers). The same applies to several other countries where there is no TV license, and it has been suggested that such an a pproach be taken here in the UK. This means you pay whether you watch or not, through direct and indirect taxation. Accordingly, you don't have a choice about whether you pay or not. We do, so thanks to Jon I don't watch live TV or iplayer and I don't pay the licence fee.

'I jolly well pay to watch my cricket, Songs Of Praise and re-runs of Dad's Army on the Beeb so why shouldn't this bloody immigrant buy a TV License too?!' Perhaps a better question would be to ask why the police officer was helping execute a warrant that clearly was not legally sound. The Capita goons soon scurried away the moment they realised our hero understood a little bit about the law and therefore that they had absolutely no legal right to enter the man's property. Why are these corporate billionaire privateers like Crapita contracted to execute dodgy warrants on private homes owned/occupied by sovereign citizens anyway?

Very polite and patient. He did well. The TV man struggled to find his 'evidence' and the minder had to leave the property that he had no right to be stood on. 9/10. Should have cut it short with 'Get off my property now and close the gate behind you!'

the policeman had a right to speak. In fact he was asked questions and was expected to answer. Same as you having a right to speak. And yes, police do often assist with search warrants. Sometimes bailiffs. It depends. Nothing unusual about that.

Interesting how the TV license man brought a heavy and a police officer with him, nothing to do with intimidating people into compliance I'm sure. If the TV licence people knock on your door I've heard its a good tactic to say your not the home owner and you are house sitting for them. I've heard that this has worked for many years. There is NO way anyone can say anyone is watching Live TV unless they break the law by being on the property & looking in a window. Nobody in their right mind invites these guys inside. He was doing exactly as I would do & as he said the Warrant isn't valid as it was not signed by a judge. The constable with them should have been more informed than he seems to have been as it takes a Judge NOT a magistrate/Justice of the Peace to sign a warrant like that.

A Justice of the Peace is a "magistrate" when on a bench in the local magd and is empowered to make a lot of orders including a search warrant alone as long as he is independent of the investigation and convinced beyond reasonable suspicion. This disinformation about a Judge needing to sign it in a certain colour of ink blah blah needs to stop. You won't care what's on your committal warrant when you're sentenced to 3 months for obstruction. Also, the point of a warrant is to override your permission to enter a property. The police are only there to prevent a breach of the peace. Nobody ever DIYed an acquittal for TV licensing.

He also drew attention to himself by writing to Capita refuting whatever contract about receiving live TV. They base their suspicion on witnessing him live sport on TV through the window...that's reasonable suspicion. They weren't trespassing when anyone is allowed to seek entry by implied consent such as a door bell and wait a reasonable time to be received and whatever they witnessed in that time on his TV. Giving them an ultimatum about proving him watching live TV there and then is the reason there is an ordered process called a trial. If he wants vigilante justice then the nearest lamppost was just metres away from what I saw. He's the kind of neighbour who follows and insists on the rules when in suits him. He's the tenant who refuses to respond to an eviction notice until default judgement has been given against him despite adequate notification from the courts. He'll bring up things at a tenants' committee that suit him when he's a duck of a neighbour an the first to call the police over a noise complaint (not videoed or any other evidence unless it suits him like this encounter)

overseas they had a TV Detection van driving around taking Radio Frequency readings... your TV gives off very small signals of a certain frequency.... once detected, they would drive around the block, take some more readings and triangulated the source of the signal........ drawing lines on a map and identifying your house as the source of the signals... proving that a TV set was switched on and working. (They couldn't detect whether you were actually watching it). They has the list of all currently licensed addresses. If you were not on that list of paid up license holders, you would get a visit soon after from the TV License Authorities.... but different jurisdictions had different rules, so I can't comment further on the British way of doing things. In my country a JP, or District Court Judge... or a Court Registrar may sign a warrant.

Not once, and this is on record (court records) 2) you don’t need a license in the UK for watching tv, you only need one if you’re watching live content or watch BBC iPlayer; every other streaming service is exempt. The “emission technology” you refer to, if it exists, would never work here because it would only show a tv device was turned on, not what it was transmitting. This is it’s so hard to prove someone is breaking the rules, and unless you have visual documentation to back the allegation up, it’s very hard to take someone to court - hence all these scare tactics before they resort to that.

They have hand held devices that can do the same thing now. 30 years ago I wrote to the BBC saying that I was using a TV monitor to connect to my BBC micro computer but did NOT watch TV and asked them to confirm that I did not need a TV licence. They wrote back to me with a very nice letter saying that I would not need a TV licence because I was not using it to watch TV. Ironically now I have a licence from Ofcom (the communications regulator) that allows me to transmit & receive TV signals within the amateur frequencies and specifically says that I do NOT need a TV licence to do so as it is covered by my amateur radio licence. It's a strange old world.

I think he handled the situation very well. He remained in control and very calm throughout. As I have said before. I think it is tantamount to slander and deformation of character that they can knock at your door and just assume that you must be lieing without a shred of evidence to the contrary. It needs our campaign to take a class action law suite against both capita and the bbc for making these allegations. £2.5K per head in compensation should soon put a stop to them 👍😎👍

He was obviously caught out by the fact that he had come home to find his front door wide open . And under those circumstances he handled the situation extremely well . Makes me laugh because where I live I can watch anything I like and will never be questioned on what I watch or ever get a visit . England must be the only country in the world that forces its citizens to pay for a state TV channel whether they want it or not . If it was made subscription then no one would ever have to worry about this bullshit and it would free up the courts to do something constructive. Love the channel it a great watch when you get fed up with the Repeats on terrestrial TV .

Or should they be told that preventing officers carrying out the business of the court will get them into a worse situation? The right thing to do, if you want to beat them, is to show them that your TV is disconnected. Tell everyone that's what they should do! Unless you want them to lose, that is. Who do you work for that you want them to lose? If you read the comments here you'll see it is a community of losers who think making the "goons" go away is a victory. But they've already got the court involved, and have presented sufficient evidence to get a warrant. This situation cannot be resolved with magic words and a refusal of entry. Nearly everyone in the comments would lose if they got into this situation, because they think the right approach is the same as what is used on a first visit. Only if it is a normal good visit, but not when they have a court warrant. It's obstruction of a warrant and will get you a bigger fine. The goons will have been quite happy with the outcome.

This video is almost ten years old. The householder was not charged with any offence. Almost all Capita TVL search warrants are invalid due to an abuse of process. Gullible JPs issue warrants on false utterances and fabrications. If you are ever unfortunate enough to encounter such an assault with a deadly warrant, refuse them entry. They will try to intimidate you by saying that the penalty for obstructing a warrant is greater than that for no TV licence, but do not be moved. Let them take you to court so you can reveal their fraudulent practice, making the warrant invalid. You cannot obstruct an invalid warrant.

I lived in a third floor flat twenty years ago and received a threatening letter form TV enforcement goons stating I had a television but no licence. Here’s the crazy part… I didn’t have a TV and today in 2023 I still dont have one. I watch everything on an Ipad. So, my advice is like the gentleman said, » Take me to court » . I have yet to be summoned to court.

@@jbclassics wrong watching on a phone , I pad, laptop or any form of streaming does not constitute a "live " because there is a delay. It only comes into affect if you have an aerial hooked up to a device that can receive live broadcasts. I do not have a TV licence or have for years and I have informed the tv licence agency of this and they have never sent me a letter or come to my address.

He was the opposite of knowledgeable. The warrant doesn't have to be sealed. The warrant doesn't need signing in pen. The warrant doesn't need a judge as a magistrate is enough. He has now exposed himself to prosecution for failing to assist in the execution of a court warrant.

I think what happened was that the goon who originally called was miffed that he did not get a result so he made up the evidence. Be interesting to know if this ever went to court and what the result was. That heavy flashing his card so nobody could see it was over the top, he should go back to being a pub bouncer.

@@nigeltrueman6101 Indeed, policeman looked annoyed because he knows he's going to have to do the paperwork on a criminal charge for obstructing a warrant and probably have to turn up at court to testify that the guy refused entry when served with a legal warrant. The 'bloke' is going to end up with a hefty fine for that as well as the TV licence fine. Whether it's fair or not, you can't just break the law because you think it's reasonable. You're not running rings round them you're just getting yourself in even more trouble down the line. Guy was too stupid to realise that he really didn't have any rights to refuse there, and if they didn't follow up on it later he was very very lucky.

In the evidence read out to the homeowner, the goon relays the conversation the homeowner had with the inspector. That is the basis of the evidence. "I don't believe the communications act is a law" so that is the basis for the warrant

The court can't convict him on the word of someone who claims to have been invading his privacy by looking through the window. They need some. Actual evidence, so a video recording or picture with a time stamp that will prove that the sports he was watching was a live broadcast and not on KZbin as the man says. Even the police have to have proof that backs up their statements.

That's not quite true. Anything that can be seen from a publicly accessible place, eg the pavement, can be used in court to prosecute as long as it has a correct date and time stamp on it, but this can be easily added by anyone who has a basic knowledge of video editing.

And someone making money through commission may be happy to lie about things to try and get thay but I doubt they are going as far as to falsefy evidence. As to being seen from the street thst is one thing but listening to what the guy said in the video about blinds it would suggest that whichever TV licence "officer" claimed they had seen him watching live sports would have had to be standing within the property line and pressed up against the window to see through the small gaps between the blinds. I'm pretty sure implied right of access doesn't allow someone to do that, to my knowledge, without being done for invasion of privacy. It is only intended to grant them access to knock on your door.or access utility meters. If a judge or such has signed a warrent to gain access then there isn't enough evidence to charge you and so they can't fine you based on the evidence given to obtain the warrent. The warrent is issues to allow for. The attempt to discover more substantial evidence. But it is scary if they are granting warrents based on what amounts to hearsay. But it could be dofferent woth the TV licence vs something more serious.

I think he handled it expertly, it also seemed clear that the Capita guy backed off rather quickly when he realised the grounds for the warranty request was false as the statement he read from the previous visit did not say what he originally claimed i.e. that the previous visitor from Capita saw the man watching live TV

Right from the outset both the police and the goons seemed to be put off guard by the fact that the homeowner was adamant that he wasn't going to rollover to their wishes to go indoors and discuss it all inside his house. This is an important point, as I believe that letting them into your home immediately gives them an advantage over you.

If they gain access they can see that his TV is disconnected, and then it's all over. If he prevents then carrying out the business of the court then it continues in front of a magistrate. They know what they are doing, they handled this perfectly.

He should have shown them that his TV was disconnected. Elsewhere in the comments people have said that this case did result in a conviction, as is obvious from how he handled the situation and what he did not do.

​@Pooknottin They can't really claim "suspicious activity," in order to obtain a warrant, they need solid evidence that you were watching live broadcasts from the BBC. If you remove their implied access to your property, they cannot get this evidence because it would be illegally obtained on the grounds of trespass. If they threaten to take it to court, the judge would most likely throw out the case, because evidence obtained illegally cannot be accepted by the court. The law doesn't say "if we think you're watching BBC live broadcasts", they have to prove it, and the burden of proof is on the accuser. The problem lies with using iPlayer. Because it's an online website and they need your IP to be able to connect to it, they can record your identifying information, therefore they know what your IP is. However, this doesn't tell them who used that device to access the website. I'm not a lawyer, but the BBC do not have the same rights as a police officer who actually can arrest you on suspicion.

Yeah it doesn't actually need to be sealed. I don't think police or courts have done that in years. Otherwise how would you know I'm handing you a warrant if it's sealed and you refuse to open it 🫠. They are always open so you can read it. Signing a warrant doesn't require it to be in ink either. It's now typed or written. So
