As soon as the Sgt talked to his supervisor, I suspect he realized that this was a civil matter. As such, he could NOT back the bailiffs nor use force to remove the tenants. Nor can he allow those baliffs to attempt using force.

@@danadezza including the one that held back 2 terrorists with knives using a baton when he had a knife sticking out of his leg.. They are heroes, even more so than our military, because they have harsher laws to follow during their duties and everyone hates them. Where as our military are free to do almost anything that is necessary and have even been proven to assault and rape people of the enemy side.

No, he IS trampling all over the law, so are the banks. I recently found documents PROVING collusion between the banks, the judiciary, the law firm's and the FCA. They're ALL IN IT. An agreement exists whereby the banks won't be prosecuted.

The Police get a hard time from both people below them and people ‘above’ them. Without the Police we would be doomed. Sadly the public only gets to hear about the odd ‘bad egg’ because it makes ‘a better news story’. The arduous, skilled, dangerous and essential work 99.99% of the offices do goes upraised. What a gem this video is in highlighting the high quality of people that make up the ‘back bone’ of the profession. Oh! And thank you for your previous service before you retired. Bring back Bobbies on the beat and a ‘clip round the ear’ for naught kids too - that’s what I say! Kind regards from an old man who remembers when things were better...

Stephen Robinson I agree 100%, only problem is Britain has renters that are not paying rent for many many months and even in some instances re-renting the property whole collecting the rent themselves. They also rent an expensive home under one name them rent out beds to 15-20+ single occupancy beds. Very sad very disgusting and very intimidating.

@@christopherchapman9505 even people who have a mortgage rent out the property even though the bank is trying to evict them for ownership back. Had that happen in the past. My mother rented a place that the mortgage owner wasn't paying the bank for, and they threatened to come take all of our stuff even though she was paying the rent.

Trespass is actually a civil matter. Not criminal. The police was just trying to keep the peace. Breaking an entering is a criminal matter but if the bailiffs have a court order they are legally allowed to break the lock to gain entry hence why they take a locksmith. That dude is just lucky he wasn't dealing with competent bailiffs.

@@ouiouipiggy4390 the bailiff wasn't being menacing he was simply carrying out his duty. It is actually the defendant that is being both menacing and insulting. His tone of voice. His attitude. Any decent bailiff would have ensured the paperwork was all above board and had a copy to hand over to the defendant at which point the police would have had no choice but to arrest the defendant for obstructing a court officer or officer performing his duties on behalf of the court.

Higgs and his colleagues each exhibited menacing and threatening behaviour at various points during the incident, they were also disrespectful to those protecting the property AND to the attending officers, which didn't help their cause. Conscientious bailiffs do exist but these were not they, Higgs in particular is just a thug with a badge...

It was a fair call by the officer. He weighed up the relevant legal points from each side and then stuck around to make sure a breach of the peace didn't occur. Even when it did he didn't order any arrests but instead restored the peace by some simple instructions. If every high street on a Saturday night had a Sgt Mo there would be s lot less problems.

All I can say is thank you in taking this action you are making more people aware of the criminal acts that are committed against people everyday in this country . You have made people aware of their legal rights and the fact they aren't alone, the fact banks constantly get away with using bailifs of this intelligence and moral fibre again is criminal and the more light that is shed upon these gutter criminals, the better it is for every person who has fallen on hard times at some point .

They are, but officers doing their jobs don't get plastered over social media, people don't want to see it, so only the bad apples get plastered everywhere giving the whole force bad pr. Notice there is only this or that officer mentioned every now and again yet there are thousands of officers making hundreds of arrests every single day.

Jerkyyyyy Regardless of your personal views of "mr bird", and his alleged hygiene issues, the police behaved impeccably, and I doubt they'd have received an "earful" from the judge; at all times, the "bailiffs" in this situation showed aggression with menaces, so however "nasty" mr bird is, according to you, these "bailiffs" needed putting in their place - oh, and for the record, I thank God I don't have you as a neighbour, had you been in Stalins Russia, you'd have been one of these scumbags who, having taken a dislike of their neighbour, for whatever reason, would have contacted the authorities, and denounced them, causing a truckload of Secret Police to come in the dead of night to take them away, never to be seen again. All because you don't like something they do, or more likely who they are. The Jews had that problem in the 1930s. Jerkyyyyy I don’t know the circumstances but the bailiff could at least act mannerly or professionally I think it’s rare I’ve seem the majority of them act civilized in many cases of eviction or repossession it’s a sad thing losing your life property no matter who you are . If they were less aggressive and patronizing it would make it better.

Hey Ed, he’s not a total timewaster as you put it, he’s simply ensuring the law is being adhered to correctly. If anything, it’s the bailiff team who were wasting everyone’s time with their incomplete paperwork. They know the law and should adhere to it during its application. The pathetic bully bailiff crew were the lucky not to have been arrested for assault and assault and battery, and that would’ve been a lawful arrest and subsequent charge.

@@ednash3571 I hate to tell you something, but most baliffs rely upon intimidation knowing full well that the paperwork that they have is open to challenges where by the court orders have been obtained in a manner designed to deny the other party a chance to respond. It is well known that debt collection agencies will routinely schedule the hearings in a county court that will not allow the other party any chance of a response as they chose ones that they know the other party is simply unable to reach. People living in Cornwall will be told that the warrant has been issued by Northampton County Court which is actually a business center where claims are processed electronically without the use of "wet ink " warrants and the agency do so to prevent any flaws in their argument being exposed as in the case of the debts they are seeking to collect may have been contested and thus are not within the remit of a CCJ. I have seen baliffs blatantly lie about what they can or can't do, even to the point of turning up on days when the court if unavailable to make out that they have a warrant to execute, when the reality is they have no paperwork worth a damn. In the case of the guy who you insulted, he knew the powers under which the baliffs can work and he also pointed out correctly that the vital piece of paperwork that was their basis for eviction, the EX96 was lapsed. Thus it was invalid and any baliff carrying out an evicition on that basis should not be licensed by the courts as they are supposed to know the law which they are attempting to enforce and certainly not to make threats of assault.

@@petechambers541 Bailiffs are rarely about that. The BBC believe they have the authority to send Bailiffs to you home concerning a TV licence. If the bailiff has a lawful warrant they will be backed by police. You missed the point. They think they have authorities that they do not. They employ thugs and bullies. That brought a very large smile to my face. I have watched some videos on here called i think, Cant pay we take it away and it always feels so fu~king wrong. @@ericsarason9099 you do realize that some of these people owe over 10,000 lb rent yes? Landlords have served notices County Court judgements have been made against them they don't appear when they're supposed to in court. So it gets moved to the high court and there is no notice with that but they have known a good six to 12 months that they had to get out and just sat there. Property owners are losing billions of pounds over people who are effectively squatting because they stay up to a year. I am not from that country, however, I like how the Police officers took all necessary steps to ensure that they looked out not only for the citizens but gave audience to the Bailiffs. Then the Sgt. encouraged the Bailiffs to walk off or face consequences. Great job and thanks for the video.

This is very refreshing. I was expecting the usual ‘freeman on the land’ pseudo-legal nonsense, but this was very well researched, well articulated, specific, peaceful, professional resistance in accordance with the rule of law and property rights. True Brits. A small victory, but the video being on here makes it a bigger one. Kudos to you all, a very impressive act of resistance.

I don't understand how people are berating the beneficiary. He is upholding the law and following the rules its irrelevant if they go back and get the proper paperwork and the result is an eviction the point is it followed the rules of law. Nobody was bullied out of their house. I think they done a fantastic job and the more people we have like that scouse guy the better off we would be.

This was so satisfying to watch. In the end when they where told to walk away and started behaving like stubborn kids. Hope they get prosecuted for their actions and all their past cases are reviewed.

Watched this 15th of December 2019 and the best viewing I've seen, wish I'd had the information when bailiffs called on me on two occasions I subsequently got retribution but it was horrible and scary and certainly intimidating at the time not to mention the embarrassment. But these bully tactics still continue today ...sadly

seems like a remote area, cops in inner city wont have the time for any of this. They'd just arrest the homeowner and allow the bailiffs to go in.

Sadly in this day and age bailiffs or their equivalent are necessary evil as so many take advantage of situations. How often do we hear of landlords who have £1000's in rent arrears? In my experience my bank has been very helpful when I needed it If the correctly authorised, signed and sealed paperwork is presented by professional bailiffs then sadly I believe that it should be executed. However in this situation, wrong paperwork, some of the most unprofessional bailiffs in the country and what seems to have been incorrect legal proceedings then the possession was rightly stopped. The sergeant was brilliant

Why do they put people in debt? Tenants pay to use the property what’s wrong with that? The landlord has bought it and paid and maintains it, if the tenants notify it they’d pay and also maintain it... either way, someone is pays, how else could it be?

You’re right, Correct legal procedure should be followed but these occupiers are still in the wrong and they’re exploiting errors in legal procedure for personal gain as tenets do, rather than simply being in the right. Really what should Ultimately matter is who is right and who is wrong and this is a flaw in the British Legal system

@tea and biscuits no I'm not a landlord. But I ended up being scammed for £9k, my own fault I suppose because I trusted someone to pay at the end of a job rather than stage payments. My solicitor advised that it would be highly unlikely I'd win the full amount back and the associated costs would not be recovered. So, yes I'm biased, niave even, expecting people to act honourably. Yes, there are unscrupulous landlords but in the vast majority of cases are folk trying to invest in their future by letting property only to find they end up with arrears and horrendous costs to repair damaged property. The "bailiff" in this film knew he was wrong, why hide the paperwork, the police were absolutely correct in the way they handled the situation. Our court system is by and large fit for purpose, the presumption that innocent until proven guilty leads to people gaming the system which is why I was advised it would be difficult and expensive for me to win. I was told that I would have to produce all my accounts, bank statements, quotes, delivery notes and so on for my whole trading year.. Anything done on a handshake or verbal agreement wouldn't count. It changed the way I did business, I stopped trusting people. Very sad.

I see loads of these videos criticizing bailiffs in the UK. Also loads of TV license ones and whatnot. The bailiffs bay have been in the wrong here and of course there will always be such instances, but for the most bailiffs are there lawfully and because someone didn't pay what the owe. I see there's clearly a lot of people in the UK who like to borrow money and buy shit on credit and they don't think they have any obligation to pay it back as if banks, stores, landlords and just society in general owed their chavy entitled arses anything. What I say to these people who have so many problems with bailiffs is that I've never had any knocking on my door, but then again I pay my bills, maybe you should try that.

@@BigUriel not sure where you get the idea that I don't pay my bills, I have always paid my way and have never defaulted on any financial agreement. The problem in many cases is that credit is too readily given to people who don't understand the implications of credit cards or buy now and pay later. With regard to bailiffs, since the system was privatised there is pressure to rush through as many cases as possible to maximize profits. This has led to unscrupulous businesses sidestepping the rules and too many people have unjustly been victims of this. However the vast majority of cases are right, too many people owing money that they won't or can't pay back. There are no easy answers to this huge problem

@Advanced Driving to be fair, the documents are written deliberately to be as awkward as possible to follow, so that people miss loopholes. Many others get shafted illegal by balifs without realising it. And make no mistake, this is by design.

I have to say. This video was the first video that taught me a lot of the rights the public has. I actually dealt with a similar situation over council tax knowing I didn't owe a penny. In fact they owed me £7,500 I got £5,000. I'm still in dispute. At this time my health was affected as a result however iwill be fileing compensation and the rest of my money. Thanks to this video you have a massive thank you for the education gained and not just from myself 🙏❤️. Well-done and THANK YOU.

As law abiding citizens we all feel that law is not on our side, as most companies, insurance, utilities, banks, don’t treat public right. Their rules and terms design in such a way that it’s always public pays and they always right. It is good to see that law is on public side for a change.
