The term "officer safety" is one that I dislike the most. I believe my life/safety is just as important as anyone else's, including police. When police come in hot and do what they "feel" based on officer safety, it becomes a case of the cops life is more important then others.

It's an all around dangerous situation. How many law abiiding gun owners would first arm themselves before checking their door at 2am? I know I do. What are the chances they say they are police officers and instead are home invaders. I don't approach my door at 2am defenseless Not a bad idea to dial 911, and verify that there are real officers outside.

That is an excellent point. I always go to arms and confirm everyone’s (wife, kids, guests) location. If they truly are law enforcement, I t would be worth the quick 911 call to confirm it. They would be in the know.

Through the door, acknowledge their presence and that way they know you're there and they have someone to speak to. Ask their identification, badges, names, and uniform. If your door has a peep hole then cool. Then let them know you will be calling dispatch to confirm if they would patiently wait for a moment while your call is on speaker phone. Then once confirmed politely apologize for the time taken if they don't give you a reason why they are there. Then proceed with caution and common sense.

This happened to me and my husband about 30 years ago. They woke us up at 2am with a phone call and asked my husband to step outside. There was a line of police cars out front. Each car had armed officers leaning over the hood with rifles aimed at our home. My husband went out shirtless with his hands up and learned that someone reported 40 rounds fired inside our home. It was snowing and there were no lights to be seen in our community. The officers kept insisting they wanted to come in and check things out, but my husband refused and asked for a warrant. It took quite a bit of talking to convince them it was a false report and we weren’t letting them in.

I know a guy who used to be a cop. They lie and engineer "exigent circumstances" all the time. He told me a story about a time when he and his partner looked at each other and said "do you smell gas?" "yeah I smell gas let's go in." They kicked in the door and had their way with the guy inside. No granted according to the story they found exactly what they were expecting to find which was somebody called a "chicken hawk?" (Apparently that somebody that likes to torture children to death.) He also told me that the guy "fell" out of their squad car 32 times on what should have been a two block ride. (I think that meant that they killed him.) So they violated the guys rights by entering without a warrant after pretending to smell of gas leak, then they pretty much murdered the guy. Now granted the guy was guilty of precisely what they thought that he was guilty of. But somehow I just don't feel that makes what they did right. What's this person a monster who needed to be put down? Maybe. Did these guys as police officers have the right to do so or the right to do so in the way that they did? Absolutely not. The law enforcement can't do their jobs without breaking the law then they're no better than the criminals that they're supposed to protect us from. (And in many cases they're worse) Society has rules for a reason. Secondly start allowing certain "select" members of society to live by a different set of rules then we destroy the very fabric of society and so the seeds of tyranny.

The frustrating thing about this topic/conversations is that it is a ONE WAY STREET. As a civilian, I'm the one that has to be careful with abundance of caution with the possibility of losing my freedom or life. The police have far more power and therefore should have far greater responsibility and accountability. Their lawyers are paid for by my tax dollars and I have to pay for my own representation on top of that. I think you guys really missed the boat on this. I have been disrespected and threatened by law enforcement and assumed to be a criminal on my way home from college - which is in a really horrible hood. I have had my door pounded on even in decent area - demanding I allow access without a warrant. This is NOT how it's supposed to be. I'm happy to cooperate when dealt with in a PROFESSIONAL manner. Even after all this I do support the police and all they do for us, but come on, we need to expect better conduct - there's SO MANY examples of cops acting unprofessionally all over youtube. Body worn cameras are finally exposing what's really going on yet we still see bad conduct or worse - cameras that are erased or turned off.

Good comments. We must keep in mind the fact that, more than ever, governance officials are hiring thugs. And they are pushing out men and women with "Peace Officer" thinking. This needs to stop. I believe good people are being pushed against the wall, and something's going to give. Good people, the ones who don't riot and burn, must have the opportunity to live a life that is reasonably safe. Even in good times, there was always "The 1%" to be concerned about. I had this situation happen about 12 years ago. My local PD was looking for someone that my neighbor saw run down my driveway. But when they arrived all they did was knock on the door and shine their flashlights into my house. Mind you it was the middle of July and 80 degrees out. It was 01:10 in the morning. They proceeded to go from the front of the house, to the back of the house and then back to the front. When they were at the back of the house they slowly opened a door, then realized it was a Bad idea. They slowly closed it and headed to the front. Not once did they announce who they were. Upon the second time coming to the front of the house I got there first with my 460 S&W. I stood just out of sight by the front door. They knocked again and "asked if anyone was home and to come to the door". I said nothing. They them announced..."If no one answers we are coming in!!". I then told them "I will Blow your Asses away come on!!" At that moment they QUICKLY....announced "Holly PD....HOLD YOUR FIRE!! I told them to "prove it and step into the light slowly to be identified". They step slowly forward so I could see badges and uniforms. Then they asked "Do you always answer your door with a gun"? I told them when Yes, when 2 Dumb Asses are beating on my doors and shinning lights in windows at 1 am.....I do!! Then they started back pedaling and explaining their actions. They stated that "they were checking to see if the individual "may" have entered my house". I told them "next time You need to identify yourselves to people or you may not have a good out come"!! I also told them "that how they did it was not smart or safe for them or me"!! The next day I went to the Station and had a discussion with the Sergeant and chief. They apologized and told me "they would look into it and next time they have them Identify themselves". I don't think anything came from it as I mentioned it several months later to another officer and they never heard about the situation.

It happens a lot. That's why if anyone comes banging on my door, and I didn't personally invite them to come, I'm not answering the door. I'm not talking to them through the door. I'm getting a rifle and going to a defensible location in my home in case whoever that is outside commits the crime of breaking and entering. If there's a warrant for my arrest, they will arrest me when I go outside to get my mail. That would be reasonable in a free society of laws, where the cops are interested in minimizing the risk to themselves and the public. I choose to believe that's what I'm living in. I'm not harming anyone so I don't know why there would be any arrest warrants or search warrants out on me, however. And if the police need to speak to me for some reason, I can't imagine why as I've not witnessed anything that needs their attention, they can speak to my lawyer instead. There is nothing at all that I have to say to the police in response, so my default position is to decline to speak.

Pretty common incident. Always politely ask for full name + badge number, directly call your local PD and verify. If they won't let you do that legally you can tream them as any citivilian criminal trying to break and enter into your home.

My best friend, a 59 years old salesman at the time, was approached on his front porch by 2 Lakeland, Florida officers after he mowed his overgrown neighbors yard. The neighbor said that he had trespassed. My friend tried to explain the situation that he had mowed this yard before, with no complaints. When seeing that the officers did not comprehend, he attempted to retreat into his house. They tased and clubbed him, fracturing his jaw and eye socket. He was eventually awarded damages. All for mowing a lawn.

Yeah, there is no advantage to talking to the cops in any circumstance. Even through a door. There's nothing special about sound waves going through a door that makes you immune to legal jeopardy. There is nothing a cop can tell you that he can't tell your lawyer. I've had two similar negative experiences with police knocking at my door. I made the mistake of answering the first time and one of them forced their way into my house. I couldn't get rid of them for nearly an hour. Never again, I will NEVER open the door for police again. The 2nd time they were at my door I walked to it and told them I will not speak with them without a warrant and told them to leave my property. They stayed there banging for another hour, what a great use of tax dollars. 🙄

Unfortunately the situation described in this video has occurred when LEs have rushed in and killed an innocent homeowner. Examples are examples where acting on 🚩 where the person who claimed it was actually trying to get revenge on the other person. They violated “due process”. LE has actually went to the wrong address in the middle of the night and rushing the door. There are arguments on both sides of the coin. One is officer safety. On the other is the safety of the innocent homeowner who was woken up to some breaking in their door. The homeowner has a right to defend themselves and their family. My life is as equally valuable as the LE’s life. I do believe in supporting LE. But it has to be MUTUAL RESPECT between all parties involved. Treat me good and I will treat you the same, but many times the LE has an attitude and they act like a jerks.

Actually, officers aren't even responsible for civilian safety. The Supreme Court ruled that officers do not have legal obligation to protect citizens. I've been thinking about that. I might just put one of those security chains on the door. It only allows the door to open a few inches. Cop could put his foot in, but the chain can't be taken off until the door is properly closed.... Cop MUST take his foot out in order remove the chain, OR they have to fetch bolt cutters to destroy my property in order to enter.

@@ralphm6901 Better solution is not to open the door at all, and don't even say anything to them through the door. Just pretend they aren't there. There's nothing they can do to you unless they were coming in anyway, with a warrant, and then you're going through an expensive legal battle regardless. Answering the door is 100% downside, 0% upside. Not answering the door preserves all of your legal options for criminal defense and civil action against the department.

Best thing to do is ,If a cop comes to your door at 2am is to let him know you will be calling the station to find out if they have an officer at your location. Let the Officer know what you are doing before opening the door. I have done this on one occasion when my dog stepped on the panic button of my alarm system. It protects you from a possible intruder and the officer/s will understand.

A broken door costs a lot less than the legal fees of getting out of whatever mess you accidentally put yourself in by even so much as talking to the police through the door. If anyone comes to your home without prior notification or your express invitation, just don't hear the knocking. They can't prove you heard anything. Especially with all the earbuds people use now to listen to music or whatever. Whatever happens, keep your mouth shut and let your lawyer tell your story.

Be careful about opening the door right away. Make sure they actually are cops, I’ve seen plenty of Ring doorbell videos where the people outside say they are police, just to rob or harm you. Make sure they can prove who they are.

@@lasherdj I have had an experience like that. The easiest way to verify if it’s an officer or not is to call your county dispatch. Say “Hi, my name is (x), my address is (y), and there’s a guy pounding on my door claiming to be a police officer. Do you show an officer at my location?” They can verify or deny, and hopefully if it is a cop they called in their run.

Why even ask them if they have a warrant? They shouldn't be serving warrants at 2 AM, and I assume you don't think you've done anything worth getting a warrant over. Grab your shotgun, sure, but don't say anything to the police at all, and don't give them any reason to think you're home. If they have something they need to say to you, they can say it to your lawyer instead, during business hours.

Remember ya'll started off by saying yelling at the end of the hall of apartment. Apartment are high areas of home invasion because people open the door to people claiming to be police. Should of started with identifying the person at the door before opening it. If the squad is in the home owners driveway with lights flashing that's s different story. Remember you stated several times hallway of apartments. I appreciate your videos and am a USCCA member, but situational awareness dictates identify the person at the door without doubt.

I personally witnessed a situation similar to this. I was at a backyard cookout/pool party of a close friend on a Friday night and it was getting late. The police were called by a neighbor (another story) for loud music. There was no music at that point but people were being loud. Everyone was having a good time, no fights/arguments or anything, just too many people in too small a space. When the police came, they said it was after midnight and we needed to keep it down and implied that it would probably be best if we wrapped it up. The police were polite, but they made it clear that if they had to come back, they wouldn't be so accommodating. My friend called for "last call" and asked everyone to head out and have a safe night. We had just finished packing it up and we were inside cleaning and wrapping up leftovers and whatnot about an hour, perhaps 90 min. later and the police were back. The police ordered my friend to step outside and speak to them, the moment he stepped out the police arrested him on the spot (on his front patio) for public intoxication and disorderly conduct. When we asked the police to chill they told us that if we stepped outside or interfered in any way, we'd get the same treatment or worse. The police were very rude this time. They kept saying "you were warned" etc. It was quiet when the police arrived and everyone except those of us who where helping clean up had left. I always believed he should never have answered the door. The judge dismissed the public intox but made him pay for the disorderly, there was also a fine from the HOA. Last cookout he ever threw. Damn shame too, as he was a chef and aside from the ending, one of the best parties I had ever been at.

They can not legally arrest you on your own property for intoxication. I have had that tried on me years ago. I was sitting on my front porch drinking a beer with a couple of friends and an officer tried to arrest us for public intoxication and drinking in public. After arguing with him he was going to charge me also for obstruction. His Sergeant happened to drive by and saw us and stopped. After telling him what the situation was, he told the officer to back off that he has no authority there and it isn't illegal to be drunk on your own property or drinking on your porch. The Sergeant apologized and said have a nice day guys.

Unless an officer can reasonably articulate what exact law was broken, how it was broken, and why they believe it was you, or happend/happening in your home, they have ZERO authority to enter your home, without your explicit permission without a warrant SPECIFICALLY stating exactly who or what they are looking for, and specifically what room(s) they intend to search. "Suing the Department" doesn't do much to correct behavior of individual cops that f&#$ up. The money for that suit comes from taxpayers, not the cops, not the police union. The cops and their union don't feel the pain of the fines and fees. It's also worth mention that ANYBODY can yell that they are cops. Someone trying to break into my house probably isn't going to care about "impersonating an officer" charges. This is one reason that "no-knock" raids are such a bad idea for all involved. I don't care WHAT is being yelled by the person breaking down my door. If they're breaking down my door, I figure that's reason enough to assume that they mean me harm and defend myself accordingly. Yeah, it's only downside to help the cops. There is nothing to be gained. If you have valuable information for the police, it can be relayed through your lawyer during normal business hours, without you even needing to be present until such time as you might have to show up in court as a witness. Perhaps all you'll have to do is dictate an affidavit which your lawyer can review, and sign it. There's essentially no reason at all to talk to the police or get involved with anything with the police directly.

I had this happen. A neighbor thought it suspicious that I took my dog out late at night. (She gave me the "must go now " cry) Two hours later, there is a pounding on the door to wake the dead, screaming "Sheriff department". My concern was whether it was really a deputy, or was it an imposter. I needed to make a decision, whether to go armed to the door. I chose to talk to them from my balcony. I wish I had made a better decision and called 911 to verify their identity, but sleepy decisions aren't always well conceived. But we ended with a successful ID, and they declined my offer to make coffee.

Best to not respond to the door at all, but be ready for violence in case whoever's at your door means you harm. There's no advantage at all to talking to police, even through a door. Nor is there advantage to talking to a criminal pretending to be police (or anything else), even through a door. It's always 100% downside. And ultimately your case for self-defense is going to be a lot better if you only seemed to become aware of the presence of people breaking in after they broke in. Your lawyer can explain that all you heard was some loud banging, or didn't hear anything at all until they burst into whatever room you're in after breaking down your door. People have gotten off because police didn't properly announce themselves, or because they didn't actually have a proper warrant, or didn't actually have exigent circumstances. Police are just intruders at that point. Just don't say anything that can contradict whatever story your lawyer says later. Again, just don't ever talk to cops. Not even through a door. Leave every possible legal strategy open to you at all times. I'm sure they've even tried the fake "your kid's been in an accident" notification ploy in order to execute a warrantless search or trick people into saying something that can be construed as incriminating in court later. Wouldn't surprise me at all. I've heard many stories about so many despicable lies. And frankly, I don't care if it's my own mom coming for an unannounced visit. My door doesn't open unless I'm expecting somebody. Call ahead. Write a letter. Make some kind of effort to make your wish to visit me known before you come and knock. Twenty years ago my 17 year old son had a 2am visit from the police while he was home alone. Apparently my old ground line phone number, which had been changed several years earlier because it was 1 digit off from the probation office phone number, was used to call a suicide hotline. I don't know why the records weren't changed over that period of time. The police insisted they look through the house to see if anyone else was home. I was working. My other son and my daughter were spending the weekend with their mom. I did go to the police station after I got home from work and got an apology from the shift supervisor for having the officers enter my home with only a minor present. I never did get an explanation why the phone number was still registered to my home address.

I’ve been on both sides. Cops came to the back door of a second floor apartment I lived in demanding entry due to the report of a domestic violence situation. I tried to tell him several times that it was not us but the couple downstairs. He was so laser focused on getting inside he wasn’t listening to a word I said. If it's cops, there is nothing you can say or do that will help your situation, and there's no information they could give you that they can't give to your lawyer during normal business hours. The only thing you can do by going to the door, or saying anything to the cops, day or night, is hurt yourself. If they have a warrant they're coming in regardless. Good, let them break your door down. Don't help them at all by opening it, or answering it. Hopefully they mess up somehow and breaking your door down and serving that warrant right then and there is the reason all the evidence (real or planted) is not admitted into court during your trial and you get off. The best Officer Safety there is is to not kick in someone's door in the middle of the night. Lets add to that: Be courteous and respectful at all times, ALWAYS be the first to de escalate a situation, respect private property rights and curtilage, properly present yourself as a sworn officer of the court (and if you AREN'T a sworn officer of the court, stick to writing up civil code violations, and keep your sidearm where it belongs). Criminals kick in doors in the middle of the night. Often they yell "Police" to throw homeowners off balance. The best self defense option a homeowner has in these situations is to use defensive force against the home invader, immediately. Any person that engages in the initiation of violence has got to have the expectation going in that they will not be going home at the end of the day. Does this mean that some homeowners will be murdered by police? Certainly .. many unarmed and innocent people are murdered by police every year already. A few might even survive the assault, and wind up being sentenced to prison for defending themselves .. but it is a big ask for people to forgo self defense on the off chance that the criminal breaking and entering into their house might be a 'police officer'.

Had a similar situation where my wife and I were living in a new apartment with our newborn in the room close to the main door. The police showed up about 2am and were asking to come in because a hit and run was reported for a car registered at our apartment. I made the mistake saying they could come inside with a moment of panic and instead closed the door and stepped outside to talk to them. Situational awareness is very important but bad things can happen quickly so this discussion is much needed.

After they announce themselves, politely tell them you are calling 911 to verify for the safety of yourself and your family (and officer safety) and that you are armed and will remain so until their identity is verified. After that you will talk to them through the open/cracked door which is not an invitation to enter and the encounter will be on video (or even livestreamed to give them no reason to destroy your phone). Be polite and clearly state your actions and reasoning. Good protection against fake cops and to make sure the good ones play by the book.

I think the problem is many people have had negative interactions with Leo’s who didn’t know the law, threatened them, and if they feel disrespected in some way may get vindictive. Bottom line is once you let them in, they can search around. I had a issue like this back in the 1980's were there was a pounding and door bell ringing at my front door. I had exterior rolling shutters on all doors and windows of my house. I opened the front door and raised the shutter just enough to see out. Three guys wearing suits told me to open my shuttered front door that they were detectives with a search warrant for a friend of mine. I told them he wasn't here in my house. They said they have a search warrant and I must open my door and allow them to search my house for him. I opened the shutter just enough for them to pass the warrant under the shutter to me. I looked at it real quick and did notice there wasn't a Judges name or signature. NOW! Up to this point I had a legally owned USI 9 m/m submachine gun in my hands that they couldn't see so I tossed it under a chair cushion next to the door and opened the shutter. They all three rushed in with guns drawn. The first one in grabbed me by the neck and slammed me against the wall and pointed his pistol in my face and told me note to move. The other two ran through my house, each taking different rooms...taking way to long in each room to look for a man in there ( a bed, a dresser , a night stand and a closet in all three rooms. Then they ran through the family room, kitchen and living room and out the front door with the one guy holding me. They parked their car out on the street, to far for me to see the license plate number. I closed up the door and called the police. While waiting for the police to arrive I called a friend of mine that was a major and incharge of special investors and operations for the police department here. He said there was no warrant issued for my friend or my address. Since then I don't and won't opened my door to anyone who says they have a search warrant unless there is a uniformed police officer there and I see the warrant first. And ever since then I always answer the door with a gun in my hand.

When somebody beats on my door at 2 am, I might already be in "fight " mode. However, I have very little regard for the safety of jack-booted thugs making demands in the middle of the night. A dog adds another element to the incident. I would be inclined to call 911 and tell them to call off the cavalry. Too often cops overstep their authority because of their huge egos and simply will not take "NO" for an answer. Just for the record, I think your attorney friend hasn't ever given a straight answer on any of your videos. He also uses too many yuppie buzzwords. That "end of the day" thing gets tiresome after a while.

Police knock, I ask then why they are here and then I ask if they are at the right address. If they actually are, I'd still talk to them through the door, not even opening it. I know people can hear my on the otherside

Had this exact situation happen to me. Police asked me to open up, they were investigating a shooting. I said no thank you through the door and they left. If they have a warrant they wouldn’t be asking to come in. Then I went out through the side door that went out to the gated patio ask them what was going on. They said they were investigating a shooting and wanted to know if I heard anything and I said I was sleeping This happened in Houston TX
