Taking the license from the evidence room should be a stay in prison. Each incident of driving through a toll with a stolen plate should be good for a stay in prison. Because there is no excuse for any of this, the prison terms should be served consecutively.

He's not _"stealing plates."_ Undercover COPS are allowed to use tags from the evidence room on their cars, so the tags don't come back to the COP. That lets them stay undercover. While he *_DIDN'T_* steal the tags, he most certainly *_DID_* commit Fraud by running them through toll booths without paying the tolls. He should 1) be forced to pay all the tolls acquired while in his possession. 2) be convicted of Fraud and/or Theft. 3 ) not necessarily be fired, but be demoted and removed from any special units he might be on (i.e. narcotics). 4) be demoted to Patrol Officer for a period of two years, and assigned to the worst beat in the city.

Letters to both your federal and state representatives and at least tell them that cops shouldn't be allowed to lie , do you allow your children to lie and why not. Didn’t do SHIT to the guy who did it, and this wasn’t even his first ride on the dishonesty merry-go-round… According to motor biscuit, the STATE covered the fines because of the bad PR. Not the city, and not the police, who had told HER to pay the fines.

They covered this up and it was only when the press got involved that suddenly SOMEONE ELSE stepped in to pay her fines. And since the government is the government, you damned well better believe she'd better report this "gift" on HER taxes or she's committing the crime of tax fraud. Betting she doesn't know that, either.

Here is why you are correct: the police are not using the license plates in an official manner such as undercover police work but instead to commit fraud by using the license plates to evade tolls. Colorado law provides as follows. “any person convicted of a Class 1 or Class 2 Misdemeanor Traffic Offense - such as Displaying Fictitious Plates - shall be required to pay restitution” to the person who incurred damages as a result of the violation. There you have it !

Looks like he intentionally put a “defunct” plate to hide his activities. At best, it was not paying tolls when police cars all probably have those automatic pay toll or an exemption. At worst, it was to hide some illegal shenanigans that involved high traffic through tolls, like smuggling or drug running.

It is possible that he was indeed hiding his activity. It is conceivable that he was investigating someone that would have had access to the police plates and wanted to do so in an undercover way. We will probably never know.

Well, there is some paperwork to fill out at the registration office to remove your name from your old license plate number when you sell a vehicle. Filling it out "should" help point them in the right direction (away from you) if that number gets charged a toll or is used in some crime at a later point in time. If you don't do that, then things like those described in this story are what could happen to you. I always fill the form out and keep my old plate when I sell a vehicle.

chris cheehan You apparently didn't understand what I wrote the first time around. We have a form to fill out that goes in the DPS computer saying you no longer own the vehicle you filled out the form for and the license plate for that vehicle is no longer associated with you after the date on the form. That form is supposed to be filled out within 30 days of the sale if I remember right. I also keep the plate so the new owner is forced to register it in their own name which further removes ownership from you. The plate in the story was not stolen from the vehicle, it was removed from it and kept by the seller at the time the vehicle was sold and stolen from his storage sometime later. In my case with the form having been filled out, the state knows immediately something is up because I'm no longer responsible for that vehicle or the plate associated with it. Also, nobody steals plates here because the actual registration is on the windshield sticker inside the car. The cops eyeball the sticker for the expiration date as they meet you on the road. When they run your plate they know everything right down to the color of the vehicle and whether or not you have current insurance before they ever stop you.

@@ralfie8801 I read your post. In the clip they were talking about a compromised license plate which wasn't in the control of the owner. The police should have either surrendered the plate to the owner, or surrendered it to DMV. NOT put it in their evidence locker. Your post didn't even address the wrong caused by the police from their actions, so I wrote another post. In CA, holding your plates and causing the new owner to pay for new plates($350) could be a deal breaker for some buyers. We do have the release of liability form as well, that needs to be completed within 30 days of transfer, but with the other allowed delays to register a car into a new owners name, there are large windows of opportunity for abuse in CA. Your State seems more thought through

Since the officer was presumably off the clock when he went through the toll lanes, he’s not subject to police immunity. The victim should sue him personally for the $1600. It’s the only way he’ll ever be held accountable in any way.

I used to live in Longmont Co. Longmont has a large police station and have the doors closed on Saturday and I was their to file a complaint. It took numerous calls to the non emergency number with them hanging up on me and being extremely rude before an officer would come out. He gave me a form and I left. After looking at the form I realized it was not a citizens complaint form, but an internal form an officer had to fill out. I returned and was once again hung up on and treated poorly before an officer came out and told me they do not have citizen complaint forms. I went to the next city council meeting to speak on this. They ignored the upset citizens their and made a statement that the officer was a good man and no one in the department would be facing any disciplinary action. Unfortunately this is typical behavior I have experienced from the LPD

Well, this is the reason why autorities hate social media so much! In the past, they would get away with this because the victim has no way to find publicity. They could have told it to a local newspaper but it would get limited coverage, if any. Now today, people ALL OVER THE WORLD hear about this. And there is nothing they can do anymore, any attempt to get it removed or classify it as "fake news" will only make things worse. Clear and nearly perfect example of official misconduct. The plate was inventoried by the police. The state should have voided the toll charges and contacted IAD. Furthermore, that the car was being used for undercover operations, they were placing an uninvolved civilian in harms way. No one hates people like this more than legitimate officers. Additionally, that the evidence room appears to not be secure, the chain of custody is now compromised for every conviction that was based upon physical evidence from that facility.

@@LambentLark while I agree with you, the fact is it used to be much better in America. Between qualified immunity and adverse possession there has been a gradual worsening of police activity over the last few decades. America used to ranked first in economic freedom and now it ranks pretty low, as an example. The point here is that if it used to be better that means we could end up in a worse position than those other countries. Now an obvious difference is that in some countries it's not just the abuse of police. Saudi Arabia, for example, runs as a theocracy and certain belief systems are still a capital offense in that country. People are still arrested purely for what they believe in and executed purely for what they believe in. Still, without accountability, what is the difference between a police officer killing you and a judge ordering you killed? Either way you end up dead. Personally, I have experience with ongoing loss of freedom in America. Before I was born my mother was given an illegal drug without her informed consent as part of an illegal medical study conducted by the u.s. military. As far as she knew she was just seeing the Doctor as usual since my dad was a Marine. There was a class action lawsuit attempted around 10 years later and the US government responded by moving all of the victim's medical records to the military service database in St Louis. That database is supposed to be for military personnel and civil servants. Even though I have worked for the government and passed a government background check I still don't have the clearance to access my own medical records. Even the CDC which is required by law to have access to vaccination records do not have access to my vaccination records. It's actually really easy to verify that my records are there, but actually seeing them is another matter altogether. And because I don't have access to those records there are some ongoing medical issues that are harder for doctors to deal with because they really need those records and aren't allowed to see them. And even that is mild in comparison to some of the other illegal medical studies that the US government has conducted through every generation in its history. So even though America used to be better it was never perfect, although it could have been if only we had accountability.

Authority/power that isn't held responsible for its actions is an often repeated predicament in human history. We keep acting like we have outgrown it as it coils around and chokes our people and communities. Now they want every man, woman and child to get vaccinated. There are no grounds to charge him with anything, especially since it appears the use policy was vague, particulary when it came to civil liabilty stemming from the use of these plates. They just do not seem to have considered that aspect. The only recourse for the department as far as this issue is concerned is to fire him.

@@tonebonebgky2 I’ll agree. I was pro police for years and was actually military police for 11 years. I got to know lots of civilian cops and actually have an uncle that’s a retired Texas Ranger. I changed the night I was arrested for public intoxication but hadn’t been drinking. I was injured in the Army and ended up having 5 strokes that left me blind on one side, unsteady on my feet, and permanently slurred and jumbled speech. My doctor testified to my condition and they still took their ‘DWI expert’s’ opinion that I was drunk. It was a hell of an eye opener to be given probation for something I didn’t do.

A lot of states have different looking plates for state owned vehicles. Using those plates would give away any attempt to be undercover. I'm not excusing the cop, he should have to personally pay those tolls and be demoted or fired. Just pointing out that going undercover would be pointless if you have plates that mark your vehicle as state property.

From a nearby town, I got a $900 tow bill for a car I'd sold almost a year beefore. Apparently the buyer had used it as a donor, stripped out some drive train and suspension parts, then just abandoned the hulk at the curb, and it was traced to me by VIN since he'd never titled it. Based on the all-to-common crazy stories like this one, I feared that I would not be able to get out of this. I had a bill of sale, but it wasn't notarized for authenticity, nor did I have proof I didn't still hold title. Luckily when I called the town administrator, he said that's fine, I don't owe the city, just fax or email the bill of sale. Never heard anything more about it. That's how the system is supposed to work!

I had something along these lines happen to me 15 years ago. I sold my first car 15 years ago to a Florida sherif's officer. Being the first time selling a car, I forgot to take the license plate. I called him a few days after asking for the plates and he said that taken them off and they were in his closet. He then ghosted me and stopped answering any calls or tests. I went into DMV and signed an affidavit that I had sold the car and no longer had possession of the plates. Thought it was done, but it wasn't. A few months later I found out my license was suspended. DMV had a computer issue, so it still showed my car as active with me and since I had removed insurance it flagged me as having an uninsured car. A call with DMV the next day fixed this and they said it was a DMV computer issue, their fault. So I thought it was done, nope. I got a collection notice months later. Turns out the sherif never took off the plates. Drove around my car for several months and eventually just abandoned the car (it was an old beater). It got towed and they were looking for about $2000 in fees. Luckily I had a copy of all the documents and sent it to them and it was removed quickly. Never found out if anything else happened from that, doubt it. One more fun thing from this. While DMV acknowledged there was an issue with the computer system, it never removed from my record that my license was suspended. They said I needed to write DMV headquarters and send them a letter and my docs. I did this 3 or 4 times, 2 of them with certified mail. They said all 4 times they never got it, even though I had a signature it was signed for and accepted for 2 of them. Even though I had a name for who signed for it in their building, they said they couldn't solve the mystery. I eventually gave up. 6 years, 11 months, and 29 days later, I went to buy a new car and my new insurance company said they couldn't insure me because I had a suspended license on my record.... Luckily when they looked at it detail, they said they only look back 7 years for any history, so if I go back tomorrow it will be off my record and they can cover me. Went back the next day and had no issues.

And almost 80% of blacks do not support defund the police. But I wondered how they could get an out of state plate, when the vehicle is registered in Colorado ? Several hours later he was pulled over (randomly ran his plates), arrested, and had his car impounded. Despite having the receipt in his pocket for paying the bail earlier that morning, they refused to radio the neighboring township to verify that there was no longer a warrant. I estimate that they were more concerned about the revenue they would make by impounding his car.

They hide the criminality behind Euphemisms, like "misconduct", "policy violation", or "excessive force". And please stop hiding behind "different laws". That's not the issue at hand. The issue is the mindset of police officers and prosecutors. And that is universal across the country. Police would have still beaten a person half to death for fare jumping in the same county. And yes, I do understand the concept of "innocent until proven guilty". But I also understand the concept of "probable cause" (the thing that is grounds for an arrest). And after an arrest, as a defendant, you're still innocent until proven guilty, but you have been arrested. And in this Sergeant's case, there is A LOT of probable cause. Enough for a couple of nights in county jail, until a judge sets his bail conditions.

Thank you for your story. Although it is dated, it is important to mention that it has a practical purpose in my home state. Recently as I was helping out a veteran friend of mine. I had to verify with the tow truck individual that a certain type of plate would be destroyed. This is a classic reason in advocating that it made sense to make sure that the old plates were destroyed. 🤔❤🇺🇸

I don't think Qualified Immunity would apply here. The cops knew full well what he was doing, and knew full well it was a crime.

Qualified immunity near unanimously covers civil liability, but not criminal, so I would agree here.

Then again there is likely no precident for this, so it's unlikely to pass muster for a lawsuit.

Actually, there is. There was a SC case that put a judge away, I think. The final opinion was, "Fraud is not a judicial function, and therefore does not fall under Qualified Immunity."

Qualified immunity is a blanket to protect the police from everything, period.

@@stuartbuckley8720 no, it's almost always a civil immunity with limited scope that some courts have interpreted to have broader reach than it really ever did.

Update: The city paid the fines and the officer is now working in a unit that investigates gang crimes...

"What need we fear who knows it, when none can call our power to account?" - Lady MacBeth. It's not this event that troubles me. It's that the police officer had very good reason to believe that he was immune from the consequences here. It's that arrogance and corruption that bothers me. Our system of judges and prosecutors have obviously given these officers a pass. Want to lie to con or trick someone out of their 5th amendment rights? Sure, go ahead. "I smelled marijuana". A culture of officially sanctioned lying has got to stop.

I was recording my driving in my new SUV. The Police pulled me over and said "I SMELL MARIJUANA." Well since I don't smoke anything I said to the Police officer "YOU SMELL YOUR ASS!"

The cop should be charged with busting the toll booth and made to personally pay the tolls.
