@@Constantly1Shotthis is just moving the goal post. When you get pulled over for DUI they don't search your car, you take a test to prove impairment. They don't say "sir I smell alcohol I'm gonna need to search your car for open containers." Whether or not you are "impaired" isn't the issue, it's that they use the presence of a substance as justification to search your vehicle. For reference Police are trained NOT to use the smell of alcohol as an indicator of intoxication. They have to use other indicators and their bs circus tests at a minimum. Even then they do a blood draw at the station to prove intoxication.

Also marijuana can have such a strong lingering smell that it can easily be present in a car long after a passenger who smoked it (outside of the car) has been long gone. The smell of marijuana is in a car is in no way reasonable suspicion that marijuana has been smoked illegally IN the car, or that any other crime has been committed. I used to steam crab legs for an all-you-can-eat buffet, and after leaving work I could smell a strong odor of crabs on myself. Other people who had not been working in that smell for hours probably noticed the odor even more than me. If steaming crabs in your car had been illegal, this stench that saturated my clothing would in no way have been any strong indication that I had done so, and thus would not fall under reasonable suspicion. Just because a crime is always associated with an odor does not mean that the odor is always associated with a crime.

Cops are so good that when one pulled over my Grandma last year, he could smell the last marihuanna cigarette she smoked all the way back in 1953. Or at least, he must have, since he tore her car apart for three hours and didn't find anything, and he wouldn't lie about it or anything, that'd be completely ridiculous, right? At least when she got upset that they were trying to test Grandpa's ashes to see if they were drugs and raised her voice a little bit, they only dislocated one of her shoulders, so at the end of the day it was a good traffic stop. Maybe the next time he would have actually caught her in the act, since clearly she must have found some way to hide it, and exposed her for the unrepentant drug addict that she was apparently, based on what that cop said. Apparently her addiction had gotten so bad that the whole 4 days she was in jail for resisting arrest and assaulting the poor innocent officer by making him sprain his back when he had to hip toss her for getting loud and not listening, that she would not stop asking everyone for her "medication" that she thought she needed to "live", thank god the jailhouse staff ignored her and didn't feed her addiction, even whens he started acting up and stopped responding to them. It's just such a shame that she coincidentally happened to die of stroke while she was there, the stress of having her double life of crimes exposed must have been too much. I remember things such as his copy of "separation of church and state" that he ALWAYS had close by, and the way he would complain about public schools and how drugs should be decriminalized. I must have absorbed a lot of his ideas more than I realized as a kid, I hadn't really gotten into politics much until the past couple years, but as an adult I fall squarely into the same category, based on my understanding and experience with those things (political influence by religious groups, the war against drugs [people], and the slow and steady suffocation of our constitutional rights to be free to make choices, even bad ones, for the sake of "public safety" or whatever sorry excuse they come up with every time). I think there's a lot of issues that might come up along the way, but that's to be expected when you roll out any societal reform or new way of doing things on a large scale. So far, we can see that voting republican or democrat are just two wings of the same bird, the bird that serves and protects the "system" and the people working in it above all else, rather than the people. I reject any system that gives any kind of immunity and special protections to anyone who is given authority and is expected to be held to a higher standard of performance in their duties, and to protect the public. Plus the Supreme Court has made some horrendous decisions, allowing the constitution to be "interpreted" and distorted to best serve their interests. America is becoming what our founding fathers fought to escape from, because too many people "go along to get along" and wholeheartedly believe the people that govern them are trustworthy and have their best interests at heart, abandoning the system of checks and balances that needs to be vigilantly enforced, and we can see where it has led us.

Keep in mind this is only Minnesota. It is still illegal to possess Marijuana in most states. The court only ruled in this favor because possession is legal in those states. In states where its illegal its still probable cause for a search.

I used to work with a retired K-9 cop and he told me that they train the dogs to give sign based on their signals NOT the smell of anything. They are loop holes to violate our rights. He laughed out load in joyful memory. And if the dog comes up with nothing. Then oh well. No recourse!

We also need to address the problems with drug dogs. There have been dozens of good studies now...one that looked at 94,000 searches,...that show that dogs indicated false positives at about 75% of the time. The best was 56% found drugs and the worst was 7% found drugs after the dogs indicated they were there.

Don’t get me wrong - K-9 sniffs aren’t reliable, but the data shows that K9 dogs that sniff for drugs in vehicles are only accurate 44% of the time. NPR reported on it. It simply isn’t as extreme as the OP claimed. Lol at 75% and 93% failure rate!

When this doesn’t turn up anything actually criminal, it’s primarily utilized for *civil asset forfeiture*. Even in the 4 states that have civil asset forfeiture protections, there is a massive loophole called *federal equitable sharing* that allows law enforcement to completely bypass state law in the interest of federal law (like with marijuana being legal in many states but not federally). And for anyone who doesn’t know what civil asset forfeiture is, in a nutshell, it means police can take anything they want if they “suspect” it is involved in illicit activity and YOU have to prove to a court that it wasn’t if you want to try to get it back. Police don’t have to prove anything, and this almost always leads to people giving up and police keeping what they took. They can then use/sell all these assets and use it to enrich the police department however they choose. Also thought it was interesting how much these two anchors tiptoed around the possibility of police being wrong or lying. Really is a reminder that local news has a close relationship with law enforcement because that’s where so many of their stories come from. Don’t want to bite the hand that feeds.

That's not realistic and there's no chance in that ever happening. Best we can hope for is ending this BS with the "I smell, such and such", and to maybe end qualified immunity if we're lucky. This is a tactic cops have been using FOREVER! They say they smell weed and instant probable cause goes into effect! They will ask you if they can search your car and if you say nom they detain you and bring a dog in. Then they bring in their dogs who are trained to detect drugs, yes, but they are also trained in hand signals to make a signal, like sitting down, which is also the signal they give when they smell drugs. So regardless, the cops are tearing apart your car. If people could get $5,000 if the search ends with no drugs found after their BS, it would make sense and even the playing field, then that lying about smelling weed would stop immediately! Of course they have many different BS tactics to use to search your car!

I live in Texas and since we are close to Mexico border, we have border patrol checkpoints set up near border towns. K-9’s by the dozen and border patrol agents at your rolled down window. Got through with no issue. 2 hrs down the road, pulled over for speeding. Cop tells me he smells weed in the vehicle I said “sir, there’s no way I just crossed the checkpoint. If the dogs and border patrol agents didn’t smell weed, I know for a fact you don’t” he replied “well can I search the car yes or no” by this time I’m out of the car already patted down for weapons. I was like 20-21 at the time. This was a few years back. Moral of the story they will lie about you smelling like weed to search your car. I’ve experienced it firsthand.

I'm a retired Law Enforcement and I really like this decision. Also, when the female reported said what about during a search they find an illegal weapon. To me, that's irrelevant when the search was illegal to start with. We can't have our constitutional rights violated for the "what if's" out there or "it's best for public safety". That leads down the slippery path where not so ethical police officers can use that to violate your rights.

Me and my friend went to the cove in La Jolla in San Diego when I was visiting after graduating in 2015 and we were gonna go down and watch the seals and smoke some weed but it was super windy so he talked me into just smoking in the car. For whatever reason I told him to take the keys out of my the ignition. Of course, halfway into the joint a cop rolled up and came up to the window. My friend couldn’t find the keys so he had to open the door and all that smoke came out on the cop. He took our info and basically said since he didn’t have the keys in the ignition he couldn’t charge him with DWI or anything so he said we could either get an Uber or go to jail. We got an Uber but had to get his car before 5:30 or it would get towed so his cousin was pissed lol. I still remember it like yesterday, we were parked right under Eddie V’s restaurant.

Here is the major problem. How often do we smell something thats not there like cigarettes. Happens a lot. Now here is the second problem, how do you refute a smell in court. Its 100% hearsay because there is no way to prove it, even if you did find weed how do you prove it was that weed that you smelled/didnt smell.

I had this happen once on a speeding stop coming home from camping. Now, I don't smoke weed, and I didn't at the time, what I did do is burn a smudge fire the whole time I was out there to keep bugs away, and burning pine needles leave a (while not identical) similar smell to pot, I told the cop as much, he wasn't buying it, and since I was in no rush to get home I told him sure, search the car. Now, I'd just been in the woods for a week, with two other people, and I had brought most of the gear, so my tiny Ford contour was absolutely packed with totes and bags, so I watched him waste almost two hours of his time digging through everything with a smile on my face. I especially enjoyed when he shoved his hand in my trash bag to look for stuff. In the end I left with a speeding ticket, he left smelling like smoke and week old garbage, it was hilarious

I travel to Michigan on a semi-regular basis. Driving on the highway, I can smell weed. The smell enters my vehicle through the climate control system even with windows closed. If I were pulled over for a taillight, the cop could very well smell weed, despite the fact that I haven't touch the substance in over (correction) 40 yrs. Why should I have my 4th Ammendment right violated based on a strong odor that travels virtually uninhibited?

The next thing to understand about Marijuana as a driving under the influence. Marijuana stays in your system stays in your blood for over 3 weeks. If someone gets pulled over for suspicion of alcohol then blows zero a cop can switch to Marijuana charge. One could have smoked last week but when you do a blood test it will show THC in your blood and one will be charged for driving under the influence.

Congress passed a constitutional amendment to make alcohol illegal because they recognized that the congress does not have the authority to prohibit drugs. This is also why congress passed the marijuana tax tamp act rather than prohibit it outright. Further, the declaration of “I smell weed” to circumvent the 4th amendment has always been a constitutional violation and thankfully courts are beginning to uphold what they once did before- that prohibition is unconstitutional.
