im a self employed painter for the last 17 years and one of the first things i learned is never work for a contractor . its always much better to work directly for the person who owns or rents the property . from my experience i think the defendant under bid the job and ran out of money so he could not pay anything to the plaintiff . contractors do that sometimes and instead of taking the loss themselves they simply dont pay the workers

Huh? The falling out was due to a customer complaint, he then checked the work, realized it was horrid, confronted him and proceeded to get attacked by the plaintiff. Even in this case, he stated he did what he was told to do, which implies the defendant told him to just paint around the washer and dryer? I don’t think so… because like we all know, it’s 10 additional minutes. Rewatch the cases again, maybe you have amnesia.

Agree with you on the eye contact. TBH none of them are believable. I have a hard time believing the plaintiff was instructed to paint around the washer and dryer, or that any worker who took any pride at all would be OK with that, BUT agree with you the defendant constantly looking down and away from the judge leads me to believe he's being deceptive. Lack of eye contact and shifty eye movement is usually the first sign of a liar.

i bought a 5 bedroom house one time that had been freshly painted inside. The house was furnished when we viewed it. When they moved their furniture, they had painted around ALL of the furniture in the entire house!!! They had also spread a thin layer of cement over the 3 car driveway. The first time we drove on it, it all cracked!!!

Yes, as an employee, he should have done that. He was currently on another project from the defendant, the defendant told him to stop what he is doing on the other project he is paying him for and work on this other project, that he is also paying him for. If my employee is working on a task and tell them to stop and work on something more urgent and they don’t, that’s not ok.

I am so disappointed in the judge. I watch her bc I thought she was the best judge at putting facts before feelings(male or female) but she liked the defendant for some reason. And she let him get away with no evidence. Smh. Just so disappointed.

I have to be honest, living in a prairie town of 35,000 (Born, raised still live here) in Canada, I listen to these locations in New York, and I go look at a map, because it fascinates me! My entire province has a population of less than 2 million, and we are spread over 651,000 Sq kms. Our rush hours here are 15 mins long, takes 5 mins to get anywhere in town, barring idiotic road work, and the list goes on. (We also live through temps of -50° for weeks on end in Jan/Feb) however the comparisons always astound me!

I live in the state of Maine, which has a population 1.3 million, in a town whose population is 1,576. It takes me 5-10 minutes to get to the gas station, grocery store, etc. Our rush hour is when school gets out and 4-5pm. But even then, it's not very busy. Lol

It is 95% not a good idea to hire friends or family for any job, unless there's a specific contract in place, and even with a contract in place, trusting people can get screwed. My parents hired my friend's, of 25 years, husband to be the contractor for their home improvements. After it was all said and done, we are no longer friends. They over charged my parents by thousands of dollars, promised dozens of times they could do everything for $70K, they never fixed the crappy grout lines, uneven tiles, and went way over budget before they even got to the upstairs, and over charged my parents by $10K, and literally pocketed the money. I am so disappointed, so hurt, and so angry with my ex best friend and her husband. The older you become you find out who your real friends.

My painter just does pot. When sober the work is good. He’s only good for 4 hours. ( we are old and 4 hrs works for us). Know what your working with. Have reasonable expectations. My guy does more talking then painting. His dad puts down tile floors. Play the ball where it lay! The ALL KINDS of people are represented so well in the trades. I guess some vices are more tolerated. My dad was an alcoholic but could master an engine anytime. I keep my painter cause he’s affordable, likable and does things in a timely way. We gotta go along to get along folks! Preparing to paint a hallway!! No one ‘clears’ their nose before speaking. That’s cocaine use. That many hours a week could also show hyperactivity from drugs. He’s a mess!!

If you work 50 hours you should get paid for the 50 hours because if your boss hasn't taken the time to check your work then it obviously isn't that bad, but for the judge to only award him 25 hours is insulting, since redoing behind the washer did NOT take 25 hours and had he done that too, that would have been EXTRA time, so in the 50 hours of work he did, he actually did 50 hours, so the judge IS WRONG once again...

The defendant tells the judge from his own mouth the rest of the rooms were fine, so why say at the end it was some other issues? It's not too far fetched to believe the plaintiff when he says he told him to do it that way. Contractors cut corners all the time. I also have a problem with the fact there was nothing to prove customer complaint and no photo evidence. Only employee testimony who could possibly be coached. I also believed they both talked crazy to one another. I don't believe the plaintiff was begging for money from clients because that would have been enough to terminate him or not use him for work anymore.

If he's really that busy, he would've paid the guy $2k, not hired him again, and moved on. It's the cost of doing business. It doesn't make sense to take 1-3 days away from jobs for travel/court and to pay employees to be witnesses in order to save $2k. $500 sounds low if he painted the whole upstairs of a house and did other work too.

There’s a difference between developing a friendship *after* a person has become a coworker and employee, or hiring someone you’ve already established a relationship with. It’s often difficult for people to establish a change in behavior and hierarchy necessary for a working relationship when you’ve already established a friendship. Also, most of your workplace friendships will end shortly after one of you leaves the shared workplace. Not always, but 99% of the time the friendship ends because your common experience has ended.

It's handy, I recently got a gardener by sending him a pic of my backyard to see if he could fix it for me. He sent back a quote then we arranged a day. Beaut job and easily organised.
