Secondary service-connected claims are by far the easiest claims to file in my opinion. Once you have a primary condition service-connected anything that is stem from it becomes secondary. Example would be flat feet like in my case. My feet are the primary connected condition hence my secondary conditions are knees, hips, ankles, lower back, calves with neuropathy. Now, I have 100% TDIU (P&T), SMC (L) ratings. But one condition caused many other problems over time and became service-connected. Diabetes is another good one. That can cause multiple problems hence secondary conditions are common and can be service connected as well. Kinda see how easy some claims can be on a secondary theory. And achieve higher ratings thru multiple conditions and can protect you from rating reductions in the future. One must read and understand the rules of engagement here when dealing with the VA. I have 14 years hard experience here.

@@Jessie3968 Once you establish a primary condition then any condition afterwards that stems from it can be secondary service-connected. In your question I assume you are saying you developed flat feet from your back, etc?!? That would be hard to prove on a secondary theory because flat feet normally starts the biomechanics of the lower extremity to degrade meaning that flat feet causes the other parts of the body to fail over time like your gait is altered, and hips, back, etc. start to fail. But, for the back, hips, knees themselves to cause flat feet if that is the question. I do not see any medical literature to support that conclusion. It could in theory be done but you would need serious medical evidence and Nexus opinions to establish a service connection tho. Good luck.

I went to see my shrink yesterday and explained to he r my trauma, what surprised me is that she ordered a Sleep Study for me to determine if I had Sleep Apnea. I was about to file my first claim and I have been out of the service for 20 years but I think I should ride this out and get a proper diagnosis before I move forward with any type of claim.

I served in the military during the late 70’s. I was a paratrooper and many jumps from military aircraft. I was also a communications tech assigned to a artillery unit and participated in artillery drills Also I had an accident in the service where I lost my balance and fell 10 feet of a railing and I was unconscious. They transported me to the hospital where I recovered. I am now in my early sixties and I started having knee pain and hearing lost 10 years ago. Can this be tied to my time in the military. Please advise

I hope my suggestion will get to the secretary Mr. McDonough. It would be nice if veterans could go to patience first, urgent care, community care or a doctor that he/ she chooses.It seems like the deck is stacked against the veteran walking through the door. Optum/LHI get a cut off the money than they subcontract to a Nnurse Practitioner, I think this way would save time and money. The DBQ could run though a database and tell the rater within minutes whether a veteran claims is denied or granted, and it would be coming from a neutral party. I have one more thing to add, how much is a C&P exam? I’m curious as to how much money is being spent weekly,monthly and yearly, because someone is getting rich off C&P exams wether its Optum/LHI or Nurse Practitioner or both. Sincerely yours Veteran

Your words hit home for me. I’m in over my head and I need competent representation. I’ve had an ankle fusion, failed. Two ankle replacements, failed. Less than a week ago I had a subtatar fusion because the first one failed. The VA granted temp 100% for a year for both replacements, unfortunately both replacements failed and I was still walking around on a broken ankle, fusions failed to heal or replacement became loose and had to be revised. That’s just one event I’ve dealt with. My knees, 10% have been cleaned out but are still very painful and weak. My insurance changed so I no longer get to see the physiologist I’ve seen for the last two years. I’m at 70% for PTSD. Sleep apnea is 50%, can’t get a new mask but I use the cpap nightly. Shoulders, IBS, lower back are at the VA board of appeals. Do you see my issues, I was a simple trigger puller for 28 years of service, I’m not equipped to talk the VA talk. Living in central Texas, just outside of Ft. Hood, where I retired. Any suggestions for a lawyer in my area? I don’t really want to do the long distance client thing. I'm a Navy veteran. I served from early 2001-early 2005 aboard the USS Carl Vinson. We were the first to strike Afghanistan after 9/11, as well as the first to strike Iraq in March of 2003. So, long story short, I saw a lot of action, and I'm forever a changed person because of my time in the service. I'm just now getting around to filing for compensation. I've been lazy and depressed for years, so that's why I've slacked so hard on it. I submitted everything I have (DD214 showing honorable discharge, medical records, buddy statements, etc). What are my chances of getting compensation, and what could my compensation possibly look like? Obviously you guys can't tell me with any certainty. I'm just putting the feelers out there to see what you guys think. I assume I'll have to be examined by a psychologist, yeah? Any insight would be appreciated.

What if you have been diagnosed with tinnitus caused from working inside a chain locker for the USCG. I'm getting 10% for the tinnitus, but the mental issues, lack of sleep, sleep apnea, heart attack etc., is what I believe to be directly caused from my initial case of tinnitus. Can I qualify for more benefits? They are compensating me with medical care and $135 per month at this point.

Bronson Frank i just did the same for my hearing loss and tinnitus. They would have me standing guard next to loud trailer sized generators in the shipyard with zero hearing protection for days and id beg them not too. VA said nahh your good. Sent up my appeal and they said it takes a while for them to get back to you. Not surprised i called in and asked if it was being processed and they confirmed. I would suggest doing the same call in and make sure there working on your stuff

When I was discharged in 1974 I had a 10% disability for asthma, about a year into my separation I was directed to have another physical. The Doctor wanted to do a rectal exam. I told him that wasn’t going to happen. He said I would lose my disability. I think it was about $25 a month back then. Can I go back now, some 40 years later and try to get it reinstated?

I’m glad to have found this blog. I have a total of 26 years service AF and Air Guard. I have some issues that I could relate to military service. Being an American Legion member I asked for a VSO contact. I called the VSO and the first response was essentially that you were in the National Guard....end of conversation. I will continue to explore these videos with the intention of trying to understand what happens in the VA claim process.

Sorry to hear that Cal. I am was in the guard for 30 yrs and I am at 80%. I used the VFW and the DAV they helped me. The key is what happen during your AD time. Check your medical records to see what problems you have listed in your medical records. I had bad knees from all the running we were asked to do during our time in the military. Good luck to you.

Cal, some VSOs suck worse than a broken vacuum cleaner. Hence you may have to go the DIY route. I did the DIY route myself hence after 14 years of fighting am 100% P&T TDIU, SMC (L) rated. Once must learn the rules of engagement with the VA meaning learning the laws, regs, and caselaw that govern benefits. Then you need to review your own records and see if you had any illness, injury, etc. while on Active Duty that can include weekend drill or your 2 weeks in the summer for training. Key word here is Active Duty time for any condition you are claiming.

Try finding someone at your local VFW post or maybe google and try to find someone in your area. There is usually someone there. I believe you have up to 6 months o your separation date to start your claim. From what I heard if you file while you are still active duty you get your claim faster. Not sure how true that is or not

Sleep paralysis or Hypnopompic/Hypnogogic Hallucinations will more than likely have to go under Nightmares or PTSD. You have to prove that this issue is service connected (started or worsened while serving in military). It's hard to prove if you never sought medical help (psychiatrist, chaplin, doctor) while in the military.

Good Day Sir I am in need of legal VA advice. I am a 100% disable vet, I live here in the Philippines with my wife, we just completed legal adoption of my son, I contacted the VA to add him as my dependent and I was instructed to send copies of all his information which included Filipino passport, birth certificate and a copies of all legal papers along with VA form 21-686c which I did. After 4 months I received a letter stating that he must have a SSN number so I contacted VA by phone and explain that my son is not a US citizen, I was then told he must have a ITIN number, I explained to advisor that the IRS stop issuing ITIN number since 2018 to foreigner not living in the US. I was then told that he can not be add as my dependent. I called again a few days later and talked with another person he told me to fill out VA form 21-4138, and they would review my claim and or request. You said that this form is useless. Herman Rios See my post to Randall Parker. Yes, a C-File stands for Claims File. It contains every scrap of paper, form or note generated on your application for any service-connected compensation. Now-a-days everything sent to the VA goes through: Department of VA, Evidence Intake Center, PO Box 4444, Janesville, WI, 53547-4444. They scan everything (yes even your envelope) and distribute it to your VA Regional Office. My advice is to use a VSO (Veterans Service Officer) from Disabled American Veterans, VFW or any of the 25 plus VSO’s. Better yet, get a VA Accredited Claims Agent. They are listed by state on the eBenefits web-site.

Most vets go through the National Records Center but they all get a letter saying “We don’t have them - the VA does.” My suggestion is to send a FOIA (Freedom of Information Act) request to: Records Management Center, PO Box 5020, St. Louis, Missouri 63115-0020. FOIA form is not necessary but but let’s them know you are serious. Be sure to request “Entire contents of Claims File”. Use your claim number if you know it and the last four digits of your SS number.

A C-file is just a short way of saying Claim folder which is where every decision is placed. In the old days everyone was just a C-file meaning a paper file with up to thousands of pages of stuff. Now, everyone has an electronic folder in a system called VBMS (Veteran Benefit Management System).

I want to talk about racism in Va Hospital, Va Hospital in Connecticut is racism first you don't want be true but is true , nobody want to listen to you. The Doctor at Va. Hospital can get way with murder. That honest truth have anybody notice that write what you saying but don't write what they say which is not fair I have seen they makeup thing about you.
