That "sword" swings both ways. "Hands up, don't shoot" never happened, yet it's being chanted by the crowd. People hate Trump so it doesn't matter what the actual facts are...he's wrong about everything. It would be interesting to see an equally thought out and thorough dissertation from someone with a more conservative approach. Then I could decide for myself what's important and stake a position. Also, acting like no harm is being done across this nation by everything that is happening seems silly to me. Two people were murdered in CHAZ/CHOP, in Seattle, while the police were "banned" so this so-called "summer of love" is not quite so rosey. Our society has problems and issues to deal with, there is insidious racism in our systems that "white" people don't know about, don't understand or unfortunately don't care about, and that needs to change. The faulty, white, rich, slave-holding men that formed our current govt did build a pliable, system that is resistant to "mob-rule" but can be changed. And that is a good thing. However, I believe we might be in the in the process of "throwing the baby out with the bath water".

@@jameskrivda1151 I highly doubt that the rioting has made people care more about racism. It's probably increased anti-Black sentiments. Peaceful protests work, we've seen this. Riots make your cause look nutty, because the people supporting it look like nutjobs. Hence anti-Islamic sentiments tend to rise after terror attacks, and thus Republicans tend to gain ground, because people seek comfort in law and order, which Conservatives tend to provide.

I have a hypothetical question. Could the governor of Oregon have ordered the Oregon National Guard to protect the protestors from the federal police? To me, this is exactly what "a well regulated milita, being necessary to the security of a free state" meant to the drafters of the second amendment.

You pose an interesting scenario. I do not have expertise in this subject so my thoughts are my own opinions. My initial reaction is no... they cannot. If the federal police are there enforcing federal laws (which is their claim) then they are not attempting to overthrow or stage a coup against local and state governments. The state cannot bar federal officers from enforcing federal laws. From my understanding, the national guard is under state control but is also a federal entity... so I don't know who holds the ultimate authority over them.

It's entirely possible, but the President would say "lol no", and, as the commander in chief, the foremost power of the executive branch and the military, he would be prioritized. Also, the national guard should definitely not be used like that and the national guard is nowhere even close to a militia, it is a military branch, with military weaponry and training. Also some of those protesters dressed up like edgy people at night and threw bombs/molotovs at federal buildings, so it would probably not work out so well.

I was thinking about this, too. What would have happened if someone just thought they were getting kidnapped and started blasting? With the way some of these whackadoos who travel cross-country to "fight the libs" dress, I wouldn't hesitate to think a couple well-armed and well-equipped domestic terrorist psychopaths were grabbing me.

@@stevenswenson8971 While under state command they are the commander in chief but the president can federalize their command if your asking this questions its actually happened several times before at various points the most recent case was segregation which case they followed federalization order but there was several cases during the great depression they ignored the federalization and refused to supress protests in this case I think it strongly likely they would follow federal orders and being entirely honest if a president enacted the insurrection act they have very broad authority to bring order

I was there for the protests as I live in Portland. That singing and just....doing nothing outlandish was 99% of the protests. It was only the few people who came out late at night who wanted trouble that made headlines and labeled us as troublemakers and out of control. They had no interest in the movement, but just wanted to fight and break storefront windows under the guise of protesting. It really shed a bad light on us. His sister’s reporting was spot on and it was usually a great time!

Don't bother blaming those few people. The media was just looking for a reason to label the protests altogether - and you're always going to have those select few who turn to more violent or destructive means, whether because they simply were looking for an excuse, or because they understand that nonviolent protest alone is entirely ineffective at bringing about any real change. Blame the corporations behind the media, not the protestors.

NGL, I think it was a bit more than a few people. And a lot more than a little damage was done to local businesses and federal buildings. I'm all for peaceful protests, but I believe that loosely organized violent groups like ANTIFA should be labeled as domestic terrorists and removed with the same violence they inflict on others.

There are KZbin videos many hours long of up to 9 CCTV cams at once along with cell phone footage showing people trying to burn down, barricade or vandalize federal buildings; throwing fireworks; and fighting with police. I get that the protesters marching during the day had little to do with what happened at night, but there's no point in trying to downplay the absolute fuckshow that was happening every night.

@@young98-cc5ls batons are meant to be non-lethal weapons. They are more important in police force like Japan where regular officers don't carry guns. In US where every officer is packing heat, it's indeed pretty useless and is ironically just cruel.

Dude's a vet. There was an anecdotal story in Iraq about a guy who's hand got mangled in an IED hit. He said to save his trigger finger if they could, but he needed his middle finger saved or let him bleed out if they couldn't.

@@donsanders9675 Except this was some navy pog who thought joining a BLM riot was a great idea, and was genuinely surprised to be sent away when he approached the cordon. Some things are pretty dumb, and that was one of them. Maybe next week he can put on a djellaba, wear fake explosives and run around screaming 'allahu ackbar' just before running towards cops, and cry "police brutality" when they shoot him.

Are We even hating the right group of people actions if we are. then it seem that everyone is simply flip and flopping on who to hate. Like as if the George Orwell predicted the book event in Nineteen Eighty-Four During one particular Hate Week, Oceania switched allies while a public speaker is in the middle of a sentence, although the disruption was minimal: the posters against the previous enemy were deemed to be "sabotage" of Hate Week conducted by Emmanuel Goldstein and his supporters, summarily torn down by the crowd, and quickly replaced with propaganda against the new enemy, thus demonstrating the ease with which the Party directs the hatred of its members. This ease of direction could also be partially attributed to the similarity in the terms "Eastasia" and "Eurasia" because they are more easily confused. All citizens of Oceania are expected to show appropriate enthusiasm during Hate Week, as well as the daily Two Minutes Hate. While participation in this event is not legally required, avoiding or refusing to do so is said to make one appear suspicious to the Thought Police, generally resulting in the vaporisation (execution) of the perpetrator. This ensures that they are against the opposing party and still allied with Big Brother.[1][2] Hate Week is celebrated in late summer. The events during that time include waxwork displays, military parades, speeches and lectures. New slogans are also coined and new songs are written. The theme of the Hate Week is called the Hate Song. It is mentioned that a unit from the Fiction Department was assigned to make atrocity pamphlets (falsified reports of atrocities committed by Oceania's enemies against her) designed to stimulate Oceania's populace further into enraged frenzy against all enemies. The aggregate effect of Hate Week thus is to excite the populace to such a point that they "would unquestionably have torn [captured enemy soldiers] to pieces" if given the opportunity. Hate Week is introduced to the reader for the first time in the second paragraph of the first page of Nineteen Eighty-Four; however, at this point in time, readers have no idea what Hate Week is. "It was part of the economy drive in preparation for Hate Week."[3] as an reality in our current American society?

I live in salem. This is super not ok, especially now. If I were one of those people, pulled off the street, some for no reason, and thrown into a van with no markings by people who won't identify themselves, my first thoughts would be human trafficking, which is a big problem already in Portland. If I then tried to fight, which I could rightly think I would be fighting for my LIFE at that point, who knows what could happen?! This is incredibly dangerous!!!

BUT this is a repeat of the 1960s those riots were in response to police brutality, lynchings, the disproportionate violence and deaths and effects of the draft on communities of color. The same things being protested today. Martin Luthor King Jr, who was critical of the riots but still said "Our nation's summers of riots are caused by our nation's winters of delay." If we want to eliminate these summers of riots we must eliminate the source of their discontent, you want to stop the language of the unheard? Hear them. Further, what we see here is the arrest of people who's crime was being found near where such things were taking place. Protesting yes, but protesting is not a crime, protesting near people who use protests as a screen for destruction is still NOT aiding and abetting a crime on the part of the protestors.

You're missing Article IV; the federal government may intervene in civil unrest in the states only upon application of the state legislature, or the governor if the unrest prevents the legislature from convening. Seeing how Oregon's government has done the exact opposite of asking for federal assistance, they don't have a leg to stand on; this should be a slam dunk case before even getting to the Bill of Rights.

Where the OP was directed at legal eagle and the commentator you were responding to was referring to legal eagle and alluding to the fact that he went to UCLA. Making the “joke” that they did not teach him to read the constitution while he was there. The commentator you responded to did not state anything that we could infer that he was confused about where these event were happening. Only if you thought that he thought that these protest were happening in California could you assume that but as I’ve clarified that is incorrect.

It's almost like the founding fathers hated the idea of a singular, powerful, all encompassing government body, and created a setup that helped to protect against that. The federal government is not supposed to have any direct control over any citizen not employed by said federal government. The federal government is intended to communicate with state government who then communicates with city governments, who are supposed to enforce laws and work directly with citizens. This is the ultimate checks and balances system.

From what I've heard tear gassed was fired AFTER fireworks were launched at the courthouse and a fire set in the courtyard. Apparently many of the fireworks are commercial grade, pretty dangerous things. Hard to get a truly accurate idea of what's going on over there minute to minute.

First, no part of this is legal advice in any way or even guaranteed to be factually correct. I'm just some random person on the internet with no education in law. I'd look up the term Deprivation of Rights Under the Color of Law, which states among other things that an illigitimate arrest is no different from a kidnapping and a unjustified use of lethal force by LEOs is no different than murder or attempted murder. There are supposedly even president-setting cases of people using lethal force to defend themselves from what the court ruled an unlawful and illegitimate arrest and being declared innocent by virtue of self defence.

As a Guardsman who was activated for 2 weeks in Philly for Riots associated with the George Floyd Protests. We were instructed to "Sanitize" our uniforms. I.e. removing of anything that can identify me. This was specifically for protecting our families and us when not in uniform. Our unit insignia was still present.

basically the law needs to be changed and further guidance given, like 100 miles, except in incorporated cities, our counties of a X population, then the area is restricted to 10 miles and direct entry points like docks, airports or navigable waters.

@@userequaltoNull The surprising part is that the officers didn't rough him up and charge him with assaulting an officer when his blood splashes on their uniforms. I won't say that's normal, exactly, but that exact scenario of an unlawful arrest turned into a legal charge due to the messy results of an in-custody beating has happened enough in recent years to really stick in my brain. And that's just the ones I know about.

When I was in prison, one of my cellmates was a lifer. He was given a life sentence after being convicted of kidnapping. The "kidnapping" in question was telling someone to get out of the street, while robbing them. Kidnapping is anytime a person is moved or detained without authority. So, all those dudes marching around detaining people without citing the authority they are acting under are actually in violation of state (and probably federal) law. If they are going to affiliate themselves with the US Marshalls, they should also face federal charges for the abuse of federal authority and defaming the office of the US Marshalls. It would not be unreasonable to call for the arrest of these men refusing to identify themselves. They need to answer for their abuse of authority, if indeed, they even have the authority to detain protestors. If nothing else, we need the names of the Commanding Officers who authorized their deployment on the streets of our nation.

Thank you thank you thank you for addressing this and pointing out that Portland has not fallen into an absolute state of anarchy. I’ve actually had people online tell me, a resident of Portland and only 10 min from the protests, that I don’t know what I am talking about when I inform them that the “riots” are a few isolated incidents of property damage during an otherwise peaceful protest, and things only got worse when the feds entered. Portland is not in a “state of anarchy” or “in flames.” The vandalism is inexcusable, sure, but so are unmarked feds scooping people off the streets and shooting rubber bullets and tear gas at peaceful protestors because their shift is going to end soon and they don’t want to have to stay over.

I was cited 325 by Homeland Security in the Everglades. I was guilty of the crime and I paid the fine. I accept that, however, there was no probable cause to search. It was legal for us to be there, we weren't making a disturbance, and even the National Park Service lets us go. They told us not too long after, they had no idea that DHS was operating in the Everglades. Long story short, the officer searched all of us, including a MTF trans woman, three women, one of whom has anxiety and paranoid dillusions, and two males. He threatened to shoot me if I kept "looking at him like that." It could have gone much worse, but when we asked him about a party that drove in while he was with us, shooting off firearms after midnight, he said they were fine and it wasn't illegal. I know rights were violated that night but there was nothing we could do because it was Homeland Security.

I first found this channel by noticing a real lawyer reacting to Harvey Birdman, and it was amazing. On numerous occasions this channel has brought joy into my life. Fast forward to today and all the chaos that has ensued. I feel the need to state I have profound respect for your profession and what is required of individuals within the legal profession, yet the resounding truth and perspective you provide is a welcome change. A deep hearted thank you from me and my family for being a shining pillar of hope and disregarding the "kayfabe" of the status quo. Thank you!

All federal law was used legally as well as they all had a badge number on there bicep. They do not have names on the federal officers names in order to protect them from the public.

LegalEagle - I am sitting through a second watch of this presentation. I have so many questions and concerns. I'll hold myself to two related ones. What will the legal morass look like when; An unarmed protestor is detained by unidentified camouflaged men pushing him into an unmarked vehicle AND 1) It turns out they are federal agents making a legal arrest. But the protestor resists the arrest. 2) It turns out they are not, and the guy is found dead. In the first case, can the protestor be charged with resisting arrest or anything at all? In the second, is the Federal gov't in any way accountable for creating an environment where "bad actors" can utilize the confusion caused by the Federal officer's tactics?

Padraic your second scenario is playing out right now. Peaceful protests are occurring and 'bad actors' are using the mass of people, all wearing black to violently attack police, and property all over the country millions of dollars, then slip back into the crowd, take off their sweatshirt and switch to something not black. As for using the tactics, every bad actor out there is using the absence of police to cause havoc, causing crime to skyrocket. If you look closely at the video the identifying tag is just above the Patch identifying the agency. And bad actors are identified and arrested immediately, see the article about the Kentucky protest where someone was posing as National Guard and immediately called out and arrested. Understand, there are not a lot of officers, so you know who is on your team, your agency. These are the elite officers, I can imagine they may even train together, and they were picked specifically because they are trained for protests and riot control. If anyone is accountable it should be the local politians for allowing it to get this far. Even cutting of all communication with the federal officers is a recipe for disaster if they do not know what is going on. There could be a shooter incident outside the courthouse and someone could get hurt or killed with cross fire.

Your second question pertaining to the second scenario doesn't make sense. In the second scenario the people in the "uniforms" are not police so the Federal officers' tactics are in fact not the Federal officers' tactics but rather the tactics of bad actors. In either case I don't believe you can hold law enforcement accountable for a bad actor impersonating law enforcement. Impersonating an officer is a crime and if you believe someone is impersonating an officer you should find an identified officer and ask them to investigate the supposed impersonator.

@Nogilthazaa CBP MORAT and SRT units with border patrol are specialized units, trained for riot control in detention facilities and at ports of entry. These are not normal uniformed units, they are elite units with focused training and experience for decades on the border. Watch press conference July 21, where the Director of CBP goes over what the units are trained for.

To be fair, this regulation probably wasn’t in place when OP was active. That being said, hubby knows Arabic numerals etc because of his time oversees, apparently everyone had to learn that stuff on some level. Having your name in both languages would fit in with that basic essential information.

I'm sure you can find other directives for other branches of the armed forces, but please forgive me if I don't have the time or energy to do it for you.

@@Madix-3 I see your point with moving the goalposts. You'll have to forgive my skepticism of the Airforce. When I was deployed to Iraq the Navy had more presence than the Airforce, and every joint operation I was in the Airforce tended to be the butt of every joke because of thier shenanigans.

Objection,sort of: in the comment section of another yt on few mos ago an active duty Army officer they started deploying Army personnel along with the national guard. Maybe the federal police who didn't have name tags & those in military uniforms were actually active duty Army that were being deployed mos ago.

yup, they can. if it is patently obvious somebody is struggling and the 'state official' approaches said altercation, declares himself, and the 'disguised guy' doesn't respond... the 'state official' then follows his training, education, and experience. it's just like if somebody 'dressed as a cop' tries to arrest somebody and a 'real cop' comes upon them.

No, because these officials are clearly identified with gold POLICE across their chest with a unit ID number on their body and patches on their shoulders showing exactly which federal department they are with. Every single one of those objects are larger than a name tag. It is dishonest to say you can't identify them as police unless you mean you can't from 25 yards away.

I understand you are an experienced lawyer, so I expect better of you. I am not a lawyer and noticed made multiple mistakes here. As an experienced lawyer, you should know the vehicles are not required to be marked, just like police. The uniforms are actually marked (there was a press conference showing examples), and they're not just grabbing random people off the street. The federal officers investigating the defacement of federal property in Portland, do have the ability to detain and interrogate suspects as you pointed out. You have failed to mention, however, that a federal courthouse in Portland was extremely vandalized and damaged. It's difficult to claim the protests have been "mostly peaceful" when there's been ~$23 million in property damage. Also, you mentioned ORS 810.400, but it's actually irrelevant in this case since the federal officers were not enforcing state law.

@@rmsgrey The big problem with the "guns prevent government tyranny" argument is it depends on the general public (particularly the ones with guns) actually being opposed to the tyrannical government. For instance, contrary to popular belief, Nazi Germany did in fact allow its non-Jewish citizens to own guns. They didn't overthrow the regime at all, because it was overwhelmingly popular. The pen is mightier than the sword. If the media is controlled by the people who support the regime then the only information people are going to hear is pro-regime propaganda. In America the media is overwhelmingly controlled by the very wealthy who would want Trump to remain in power or at the very least restore "Law and Order". In Germany the Nazis never won a fair election but as soon as they gained control of the country they used the power of propaganda to eliminate most opposition to them. All I'm trying to say here is if the people resisting the government don't find a way to take control of the media, their efforts will be in vain regardless of how well-armed they are.

@@dylanblack8714 If official officers and soldiers are not required to identify themselves, then there is nothing to stop a group of nutters from getting together, dressing up in the same clothes as those officers, and carrying out their own plans. It's already difficult to impossible to identify who has been arrested by whom in all these cases of arrests by unidentified individuals in Portland, D.C., and all over the country, thus making it difficult to impossible to seek recourse for violations of your rights. So, do you think that actual criminals aren't going to take advantage of this to further their own goals? These outfits aren't exactly difficult to acquire, so what's stopping some nutters from going out and "arresting" some individuals while pretending to be legal enforcement for the sake of carting off the individuals to some quiet place for the sake of robbery, rape, human trafficking, or anything else?

I mean it's _possible_ but it's not exactly probable. By far the more likely case is law enforcement entities (briefly) confusing who is from what department at a glance, but they all know they're law enforcement. After that, you get a risk of those "boogaloo bois" using the confusion to dress as nondescript feds and perform acts of terrorism. As for random abductions for the purpose of human trafficking? I'm going to be blunt: I think you've been watching too much Netflix. There are easier ways to acquire victims that won't launch a missing persons report (eg immigrants). Maybe run of the mill kidnapping could happen, but you could just, you know, kidnap them the way people have been doing it for years. Again, I'm not saying it's _impossible_ or that it would never happen. Dahmer dressed like a cop, I guess. The added threat by this is just so minute, to bring it up is distracting.

@@ShroudedWolf51 Perhaps even worse, some nutters dressing up as local cops, getting the Feds to respond to some vandals then "intervening" on behalf of the protesters in which they start a firefight Feds to try and create a fake Fort Sumter level incident. While everyone is screaming about who did what they fade away. As I recall that was a plot element in a Tom Clancy novel except it was NATO and Warsaw Pact troops standing off in Berlin.

There is a DoD manual, which basically lays out how to handle these kind of problems. The manual says that you should not crackdown or the common people start to rise up, and things get loud. How unexpected that the PotUS who brags about his cognitive test results has not read those manuals

Iraq and Afghanistan veteran here. Identifiers are worn in designated 'safe areas' only when in a conflict zone. Taliban and ISIS were among the first to weaponize doxxing as part of or to support terrorist activities. As in, they took your name patch or dog tags, looked you up online, then filmed their torture/execution of you and sent it directly to people you know. Victims of doxxing by antifa and other organizations may not lose their lives, but they do often lose their livelihoods. A perhaps more effective form of terrorism than a soldier dying in a conflict zone, because it actually could happen to you.
