Clearly the Police Procedure to inform you of bodycam is to ensure that all police employees are complying with the Data Protection Act 1984. So what he is suggesting is that this law does not matter, it does not apply to him & is therefore elevating himself above the Law. If so, how many other Laws is he able to ignore or abuse at will. Until fairly recently a traffic officer could place a black rat sticker in their private car as an unobtrusive way of 'showing out' to colleagues, in the hope that they wouldn't get pulled for driving offences etc. Now-a-days it's more than likely that the car doing 90mph in front of you with a rodent sticker on it's number plate isn't actually being driven by a Black Rat, but a slag boy racer who's chancing his arm. I make no apology for copying and pasting what I posted above, this was a seriously flawed audit that could have escalated towards a lawful arrest were it not for PC Stupid being so gormless and failing to respond correctly to what amounted to an act of civil trespass ... "Far from brilliant - good in bits but when on police property you must leave when instructed to do so as your right of access is only an implied right. In theory the PC could have physically removed the uploader from the grounds of the facility as a completely lawful response to an act of civil trespass. If the uploader were to resist such removal, he could have been arrested as then breach of the peace and aggravated trespass (a criminal offence) comes into play. Too many auditors make this basic error which seriously undermines the PINAC movement. Record them all you like from the public footpath, off their property, and yes launch your

at around 11:52 PTTP had the PC over a barrel and forced him to escalate. He was put on the spot with several people watching, including his colleagues. PTTP then grilled him, interview style into attempting to explain the specific law and failed. PTTP explains this and even the colleague (who knows about lorries) had to interject and confirm this. It was going to be an intimidate exercise (threaten with arrest) and 'make up the law' afterwards situation. I wonder how many times this happens ?🤔

@@SensibleCentrist your interpretation on covert will not be defined the same by the defence and the court. I certainly wouldn’t say it was covert, especially since I can see the light blinking, I can hear the audio signal from the camera reminding me it is recording and I will assume they are recording since they have a camera, and just like myself I record all interactions with people so I would certainly assume my interaction with them is being recorded. Law and policy are not the same and we can argue semantics all day but you will not find any judge willing to prosecute an officer simply because you weren’t told you were recorded on there bodyworn camera. Try it, if you’re so confident you’ll successfully prosecute an officer then put your money where your mouth is and defend someone in that situation and become a lawyer who specialises in suing the police for not telling you they recorded you. I think you’ll struggle.

The rubbish about the badge is pathetic. For PttP & any other mug who likes to do this stuff heed to understand, the wearing of a Union Flag is not against regs. Second, The College of Policing is not the rule making or policy body for any particular force. The Chief police officer is responsible for the policy in advising members of the public are advised. Although, he should have told you he was recording and his video should have had a sticker telling the public that a video was in operation when the light was on. The latest models also have the serial number of the device. The end result will be PttP will be served an injunction banning him and any other self-appointed “auditor” from trespassing upon police property. Waltzing around HQ and an operational station is far different. PttP claims 40-odd people watch his video, when he knows many more do. The issue you can see anything from a drone, but not something that's viewable from someone who is standing next to something, such as a window or next to a car etc.

Breach of the peace Regina versus Howell 1982 states a breach of the peace occurs when someone has the fear of being harmed to give someone the fear of being harmed you have to use threatening and or abusive language or hold a threatening and or abusive sign. It also goes on to say once a breach of the peace has passed there is no breach of the peace its PASSED. So I would argue while there are 3 tyrant pigs are there their is no breach of the peace.

Aye, and not only that but after the case of Trevor Foulkes ( Foulkes v Manchester police) the judge said that the breach must be “real and Imminent” so on that on this occasion the police were proved to be have been wrong to use a breach of the peace. So as we may know Mr Foulkes was only trying to get back into his house after having been locked out by his Mrs (if my memory serves me right) the two constables just used it as a means to an end. I am not surprised that Mr Foulkes was aggrieved at being locked up.

If a member of the public with a camera can research basic laws then a copper certainly could as they need to know which laws they can legally enforce, it's not good enough to get by on pure bluff & bluster! also, any copper that needs 'advice' on trespass law needs re-training.

A total of 52,741 laws have been introduced in the U.K. as a result of EU Legislation since 1990, imagine how many laws the U.K. has in total, and you seriously expect any Police Officer to know all the laws? I would agree there would be some basic requirements, public order offences.

@@kissofjudaz I know the laws on trespass, I also know that just about every time the police misuse a law, we, the tax payer, have to fund compensation claims. At least know the laws that you try to enforce, that'll do for a start. I, just like PTTP, will always make sure I am not breaking any laws if I'm not sure.

@@RedCraig interesting views you have there. Let me check you on it, I don't claim any benefits from the government. I did for a short time during COVID due to a reduce in opening hours of where I worked and therefore there weren't enough hours available. I can assure you that all of my income is fully declared in line with the requirements. How would you begin to know if I had a UTR or not? 🤔😂 And I believe that change can be made this way, by and large it is better now than it was 2-3 years ago. These people can change the way that THEY act which will impact how others act around them. It's the ripple effect. One person can't influence parliament but I can influence handfuls of people at a time.

In an act of civil trespass where the owner/occupier or their authorised agent has requested you to leave and effectively revoked your implied right of access and you refuse to leave, the same owner/occupier/authorised agent may lawfully use reasonable force to remove you from the property. If you resist such an act you are committing a criminal act - aggravated trespass. You did fail to leave immediately upon request - the PC would have been legally able to physically take you by the arm and lead you off the property and if you had resisted he could have lawfully arrested you for aggravated trespass and breach of the peace. When entering any private property to which the public have an implied right of access, you must comply with all reasonable and lawful terms & conditions and any instructions of authorised agents. there is no legal requirement for signage. That is where you are in the wrong. The PC was in the wrong in... failing to identify himself upon initial contact, if he was recording you using his police body cam he failed to notify you at the beginning - he had ample opportunity to do so. I 100% support the PINAC movement but once you are on private property you must comply. Too many auditors like you get this wrong. Most of what he did say was bullshit but he did have the authority to revoke your implied right of access and you failed to comply. Also I would not volunteer the information that you travelled by motorcycle - the PC could have followed you to your bike and ID'd you from the registration.

The lady is a decent human being. Plus she knows her bikes as well (she's right about the 186 mph speed she hit - equates to the 300 kmph limiter on the bike!) @@asensibleyoungman2978 PTTP is bright enough to walk in the opposite direction to where his bike is when he has a 'guide' with him, and bright enough to possibly see another bike and pretend that's his bike, so they run checks on the wrong vehicle. I saw an American auditor do that, they asked him 'is that your truck?' And he didn't confirm or deny, he just sorta went 'umm', and dollars to doughnuts, they ran the plates. It was amusing to watch. 😁

This cop like the 3 the other day always say we're very busy but can stand around for ages discussing/bullying/questioning and it seems are lying to the public, the 3 the other day were standing around for 1 1/2 hours doing ZILCH, like this cop is today........ Money for old rope these guys are getting, their bosses should tell them to get out on the streets patrolling and preventing crime instead of hiding behind the gates of cop shops........how embarrassing was that Bacon looking up a law to try to trap you and didn't know the ruling on a body worn camera, the trainers of these cops should be retrained themselves......

Towards the end when PTTP walks away with the lady, they immediately get on when motorbikes are discussed. There is no hostility from either party despite the previous stalemate that resembled Mexican standoff ! (can you say that ?!). Anyway the lady clearly didn't see PTTP as a threat, despite him doing a very unusual activity. In the end she wouldn't shut up - but what a lovely woman she was.
