Shariah Law is often misunderstood by Muslims and non-Muslims alike. What is it? How do some use it to justify wrong actions? What is a principled approach to Shariah? Scholar of Shariah Dr. Jasser Auda helps us answer these questions.

+Arpus RSL No it doesn't. Sharia law is an "active" form of governing. In the Bible, there has been things said like that, but they are no longer in effect. They were for a certain community for a certain time. Try to correct me if you think I am wrong.

Dr Auda's views here are rational and moderate. Yet the comments section and the number of dislikes demonstrate that many people are not willing to listen and think with an open mind. Ironically, these people are motivated by the same hatred and ignorance that they claim to oppose.

Sun Myung Moon, David Koresh, Pat Robertson, Matthew Hale, Michael Bray, Paul Jennings Hill, Marshall Herff Applewhite, Jr., Jim Jones, Charles Coughlin, Fred Phelps, Sr. All religions have them, if all anyone knows about Islam is learned from the media you will only learn about the extremists.

I'm not religious by any means, but I've noticed such huge similarities between Islam and Christianity in terms of interpretation and application of the doctrine to one's daily life. Humans are far more similar than we want to believe. Sad that there are so many people thumbing down this video.

+lejawinc My God is the universe alone- not some fictional reinterpretation of prehistorical, pagan deities worshiped by ignorant nomads in the Levant. It is time for us all to evolve and recognize the insanity of reverencing these religions that should have no relevance in the 21st century. Despite the differences that have evolved among Judaism, Christianity, and Islam, I argue even their origins are problematic and investing any respect or emotion into such fictional histories keeps us chained to barbaric thought.

Zelph Myster Sure, I may agree with you to some extent (not to the extent of belittling people and it is kind of beside the point of what we're talking about here), but I also find that it behooves members of society to engage others with empathy; if one goes up to someone else and simply casts them aside as a fool, the "fool" will innately reinforce their beliefs out of a defense mechanism, strengthening it as a function of the unempathetic person's offending words. Perhaps there are rare occurrences where yelling will be a catalyst for intellectual change, but I think that is rare and not the best means by which to procure the evolution of thought. If we honestly feel that the letting go of religious thought would benefit the world (I personally believe this, but human nature makes it hard, nor will it happen all at once, it must take a very long time), let that show in the actions and words of each individual who believes that and allow others (third-person witnesses even, as Gandhi mentions) to come to adopt that position on their own, as that is the only way they will adopt it, on their own. One cannot simply yell into another's face and expect the person to quickly take up arms against their old ways of thinking and adopt yours. When one's beliefs no longer serves a function from within the mental constructs one has built for oneself through one's formative years, the belief will have a greater chance of gently (although it may initially be painful) dissipating on their own. I think this is the path that should be taken, allowing the seeds to grow within their own minds rather than thinking I can mentally rape them and force it to grow, heh. We must have empathy for each other and have a realistic respect for the human condition itself. This is all a big, fucked up mess we're in. We're all a part of it. Peace.

+IIllytch321 The big difference between other religions and Islam is that there was a reform in the bible. In Islam if a Muslim even mentions the word reform there putting there life on the line. If you practice Sharia law which they allow in the UK for some reason, You practice outdated laws based on a barbaric man in Muhammad. Do you believe its right that you can marry a girl when she hits puberty?. Do you think apostites should be killed?. For Muslims who don't take the Quran as a literal meaning to me have already evolved passed religion and that's a good thing.

The thing that gets me is the idea that there's no separation of church and state. In the US, Christianity may be the dogma that most people follow/what our country's values were based on initially, but we have that separation so that instead of basing our law that in some cases determines whether a person will live or die on a book that, like many other religious texts, contradicts itself time and time again, we base heavy decisions like that on a firm foundation that's been deliberated on so as to cut out ambiguity at every corner, you can actually literally interpret it since that's how it was intended to be followed. Then you have Dr. Auda saying that essentially the Koran and the Hadith contradict themselves and the 'correct' way to deal with these instances is to just go back and check with the four principles (which i still find very ambiguous). This is fine as a relgion (for the most part, there were inhuman parts to the Bible just as well) but I personally do not believe that it is fit to fairly and effectively govern a society of people that could be considered free.

Dr. Auda seems like a good and educated man. It's good that there are people who struggle to reinterpret ancient and obsolete laws in a modern spirit, but would it not be better to forsake them alltogether, or at least reform their content? You cannot possibly provde everyone with an adequate level of education, and even highly educated people get carried away by the dangerous (i wish the quran and other religious texts were merely ambiguous) messages they contain. You say literalism is bad, but it's equaly bad to cling to tradition if there are better ways out there. You speak about justice, wisdom, common good - these are values that do not need sharia or any other religious code, and it's apparent in the way you speak that your appreciation for them comes not from some written law, but from within.

Love the hate language, way to show that you live by the right way (Christian by the way). I like what he said about wrong interpretations of Sharia. What would it take to have the Muslim community publicly denounce groups that commit acts of crime and murder in the name of the Quran?

+SADIS Banget LOE muslims are not allowed to lie, in fact, muslims believe that God is the truth, so, muslims don't have just to say the truth they worship the truth. if you want to know islam, go and read quoran but if you want to believe any lie you see in the internet you will be a stupid person. I am not saying believe me and don't believe the others who say muslims are allowed to lie because I maybe lying and also the other persons maybe lying too, but I am saying don't trust anyone before you can make sure. in this case, if you really want to be a cultured person not such a stupid person believing anything, and if you really want to know the truth, read quoran so you can judge who is lying. It's too easy to read it if you want, you can just download it from app store or play store or read it directly from google. just be honest and truthful. peace.

+Makes Sense I did never say quoran contradicts itself. i said you have to read the whole book because, for example, in quoran there one verse that says :" The example of those who spend their wealth in the way of Allah is like a seed [of grain] which grows seven spikes; in each spike is a hundred grains. And Allah multiplies [His reward] for whom He wills. And Allah is all-Encompassing and Knowing." and one day, one person came to me and he told me that quoran says that there is 100 grains in every spike and he told this is just one of the mistakes of quoran. that happened because he didn't read all the verse. +Let the Quran Speak Yeah , we saw all you muslims speak out cheering when 9/11 happened. The world saw the stadium full of Turkish muslims screaming "Allah akbar: during the "supposed" moment of silence at the soccer match in Turkey after the Paris massacre recently. There was another stadium full of muslims in another 95% islamic country who did the same thing during the "supposed" moment of silence. I have been seeing muslims "speak out" for about 45 years.

It is estimated that some 600 million Hindus and Sikhs over the 800 year genocidal reign of India by muslims. Present day India is about half the size as it existed before the 800 year genocidal reign of muslims over India. I would talk to any Nazis/death cult folks as i would have talked to German Nazis back in the 1920's, 1930's and 1930's.

Interesting to hear someone say that words written need interpreted into priorities. Does the Christian faith not also have eye for an eye type “laws” written? That has just been interpreted differently. Education of all sides of any subject is the basis for understanding and the wisdom spoken about in this video.

The Chidds In my country Jordan they stopped applying death penalty on people who kill intentionally, according to Sharia law we have to kill killers who killed intentionally so the results is the crimes has increased in Jordan and some are trying to bring the death penalty back to the stage to solve this problem. How ever same applies to thiefs to cut the thief's hand cannot be held if the country got a lot of poor people who steal to feed their families read when the Khalifa Omer ibn alKhatab forgiven a poor man who stole food to feed his family. For example there alot of job opportunities and still some people prefer to steal according to Sharia law their hand should be cut to terror the others not to steal. hope this answer help out

One must always understand that what is “Just” is based on what a society values as a majority. These values can correspond with a society's technologies, discoveries based with this technology, and overall understanding of the world around it. With this understanding comes a higher form of thinking and a higher realization of what is actually “Just” in majority opinion. When you state that literalism should be looked at when interpreting gospel (as in truth), at the same time, you abandoned the very popular idea argument that Jesus Christ is a prophet of whoever you believe is your god.Jesus Christ always taught to people in parables which are defined by the oxford english dictionary as ‘ A simple story used to illustrate a moral or spiritual lesson.’ Within these stories are hidden meanings toward the true lessons that are to be understood and derived, and that is just the thing. With multiple derivatives one can always take multiple interpretations for one piece of gospel weather it be from the bible, or the quran. The issue with literalism is that if we were to take all of Christ’s parables literally then we find ourselves very educated on virgins, oil, dirt, sowing, and killing fatted calf's, but we do not actually see the true meaning behind the creation or application of certain doctrine.If and when people question the actions of prophets, and ancient individuals that associated with such people, then we find that only by looking figuratively we can see the true meaning behind action and application.

equality and justice are two different things. the example of this is: think of a disabled person and healthy person giving each 20kg of weight to workout is equality but justice is to give each according to his ability.

I'm sick of listening to debates where Muslims cherry pick some good lines out of the Quran and then when someone brings up a verse they try and muddy it as if theres a deep profound meaning. What was the profound meaning when Muhammad killed a family and claimed the 9 year old girl as his wife and continued to rape her... Muhammad hated anyone who would not join him and wanted them killed. I could go on all day about the poison that is Islam.

In simple terms Shariah refers to the main sources of Islamic law namely Quran and authentic saying of the prophet while Islamic law encompasses the main sources as well as the sub sources namely Quran, authentic Hadith, Ejma, Qiyas, Astihsan, Masaleh Musala, Saad zaraye ...

Are we meant to interpret laws by their Intent, or by their End Result? One could argue that Sharia Law, if instituted correctly, would be fine. However, what we see is a brutal and barbaric interpretation of Sharia, and it isn't an isolated occurrence. Perhaps the Law isn't so brilliant and perfect if it is so commonly misinterpreted and misused. Of course, this would be the case for any legal system based on vague, antiquated religious texts. That is why, in the West, the dogmatic practices of religion are separated from laws that are applicable to a modern world. And in opposition to religious "law", modern secular law tries to be as specific as possible, in order to prevent the wild interpretations that would otherwise so frequently lead to disaster.

Christianity has the Canon law, and it is understood that the Canon law informs judicial law in Christian countries. Canon law is a matter before God, where God is the "chief justice" answerable to His authority, rather than the judicial which is either codified into principles (civil code) or the result of prior judgements (common law). Is Sharia similar to the Canons?

Okay, here is my question... How important is sharia law to practicing Islam? In the US are laws are secular. If you are Muslim can you live by laws determined by people and voting consensus, even if it goes against some of sharia law? If practicing Islam is going to force you to break US law, then Islam is a both a religion and criminal organization. I don't believe that you have do commit what the US considers crimes, to practice Islam, but the narrative on Islam is "The word of god is absolute and not open to interpretation or alteration". If that's true, then following sharia laws as it is written (or what I was told was "as written" Sharia Laws) would break quite a few US laws. So which is it.... are you okay with secular US law or is the "Absolute Word of God" the requirement for Muslims?

I know what the five pillars are, when you say adhered to, do you mean by the government? The pillars seem to be something an individual adheres to as part of there faith and doesn't require any official adheres by a government. other then the hajj the 5 pillars could exist any where in the world if practiced by an individual. If the law of the land changes, which it often does do varying degrees, how does that affect a Muslim if the changes do violate Islam? In a secular government laws and government are not determined by religion. So violating islam may not be a consideration of the amendments to the laws. What happens then? It seems to me like that could be an issue if we are to co exist under US law

Yea that didn't sit well with me either. I thought at first... If your religion cant work with the laws of America.. then maybe America isn't the right place for you. I don't know if that's how her response was meant so I was going to chalk it up to poor wording. I don't have a problem with the religion. What I do have a problem with is that religion just like race, social class etc..is a way of dividing people into different groups. Right now the Arab Islam group is not the most popular here in America. I have more experience of their culture then most Americans from time served in the US Marines and I think most of the issues are because most Americans have no alternate view of Arab Muslims besides the news and war, which isn't flattering. I have reached out to at least 15 other Arab/Muslim groups, including this site and who this site suggested to me which was the man in the video to try to get a better understanding of their culture and views and hopefully realizing they aren't that different. So far this was the only reply I have received. So look, I gave you a shot. I would have been willing to help you, and stood up for you,if peoples views were incorrect. I tried harder then most people would. I only asked for a reply to a few emails and no one could do that. In regards to me... you missed you're numerous chances. I hope people are wrong about you, but as far I am concerned... you are on your own.

Basics of Islam? What are they? We cannot have a legal system that excludes other religions and calls them invalid like Sharia does. Sharia does not work in Islamic countries, why would it work here? Civil Law is not about achieving something in a life. It is about life, liberty and property. Give God what is his and Ceasar what is his. Since Jesus was a Prophet according to Mohammad, then Islam MUST follow this, yet Sharia does not. Sharia is therefore BLASPHEMY to Jesus. When a Christian or Jew or HIndu or other religion cannot teach his religion in an Islamic country, then Islam is in violation of basic law. If I cannot set up a church and build a new church, preach door to door or advertise, then Islam is violating basic rights. If a person cannot read the Bible as a Muslim, then Islam is weak and invalid. So, If your belief in Islam conflicts with my religion, Sharia claims it can dominate me and force me to comply or die. Such cannot work. Claiming Islam is true does not make it true. Purposes? I don't want Islam in my life, I want my religion and to do so in freedom. Sharia violates this freedom and justice.

Of course, people aren't able to fully understand all the wisdom of Quran, but it's obvious at this point of the history that if Jesus wasn't killed according to Quran though was dead for many centuries even though Jesus' soul was alive (what is written in Quran I believe), murder for murder doesn't mean that criminals should be killed physically in turn.

This is also fair when it comes to punishing a criminal by cutting a hand out. According to Jesus during zakyat, the left hand shouldn't know what the right hand is doing. That's giving away. When it comes to taking away, the punishment might be in my modest understanding, making the fact of stealing and having something unknown by people, because true stealers steal to show off (their money, power etc.)

I find it difficult to believe anything Imams say about the Quran and Sharia Law. There have been plenty of videos explaining the language and its meaning but it seems the language is saying something different. The head covering is meant to cover the bosom. It is a head scarf but can be used as a neck scarf which does cover the bosom! There have been other similar errors which the Imams who are always men, misinterpret. It is time the Muslim men stopped trying to control the women and learned from the women instead.

Vinny the Judge Vinny , you kind of supported his argument. Yes doesn't it sound medieval or outdated? That is why it is absurd. These laws are still practiced by some Constituencies and should definitely stop. The Professor talking in this video properly describes the purpose of these laws (Sharia Laws) but does not go on to explain why they are still practiced. I can logically say that all Religion is based on morals(Well at least on the surface , not as a money sucking scheme) and ethics but its practice could definitely change. Sharia Law goes against the rights of many.

Why is it called a "law?" in the first place anyway? I think that's the part that scares most non-Muslims. Because it gives the impression that you want to implement the Sharia Law in its entirety as a law of the country you live in. And that is something most people don't want to see happen because of all the chopping off hands and stoning to death and such. Because when it's the LAW, it's the LAW. And if the law of the land specifically states that someone should be stoned to death for whatever reason, then there isn't much room for interpretation any more. You can of course, still follow Sharia Law up until the point where it conflicts with the laws of the country you live in, and I for one think that that's where it should stay.

So if I understand well enough, what Dr. Auda means to say is: follow Sharia law, but not 100% verbatim when it doesn't support the common good. Unfortunately I haven't heard from Dr. Auda what he considers to be supporting for the common good or not. I for one would surely say that stoning someone to death or ANY form of capital punishment or punishment at all for things like adultery, fornication, apostasy, divorce and homosexuality does NOT support the common good.

In the islamic state they should not punish other nationals (not belong to the islam faith) who might have violated their fixed or unfixed rules in Islam if they recognized religious freedom and because other countries do not combine religion and politics while in the islamic state their political affairs is completely or mainly imposed based on their islamic religious rules and standards. Nothing would happen brother. In Qur'an it doesn't say a woman can't provide for the family. Yes, it is usually the man however woman can do it too. Especially, if she is a single parent she has no choice but to work and provide for her family. Quran doesn't have a rule that says women can't work or provide for their family or themselves.

And where else in the Islamic world do you see that happening? Go to Turkey, go to Tunisia, go to Azerbaijan, go to Pakistan. Plenty of dance clubs there, with no government interference.

Because as far as I know, nothing in the Qur'an says that a law like cutting the hands of robbers should be understood literally, or the one about beating women. And the Qur'an does use at least some obvious metaphors. In other words, you are being inconsistent.

The explanation in this video seems very different to what we see in the country’s that abide by these laws, I would welcome this idilc life style if it was the example we see of this law already, unfortunately what we see is a a very unforgiving society with low tolerance.

what about the 10 commandments. that is 1000000000 times better then the Sharia law. Remember we live in a secular world. But as a Christian Jesus spent time with text collectors and prostitutes they were sinners but were not scared of Jesus. He didn't condone sin, but sinners were not scared of Him. The highest morals are in the Gospels. What is wrong with islam is that people can save themselves by being good. But as Jesus was trying to teach the reach man. "no one is good" And definitely not good enough to be save oneself.

So basically what he's saying is the difference between a good Muslim and a suicidal, blood spilling maniac is whether they interpret the Islamic scriptures correctly or not. I'm sorry but that doesn't fly. Obviously there are violent teachings in Islam. It's just that the peaceful Muslims follow a teaching which ignores the violent parts and doesn't take them literally. The extremists aren't just making stuff up. They're just being selective. So there obviously is a violence issue within Islam. And denying all of it doesn't help modern Muslims and makes non-Mulims suspicious of Islam in general - which is sad.

None of his answers were backed up with a clear explanation or with precise verses of the Quran or any examples in the real world. He never explained how it is being applied in a successful peaceful way. He said it is Devine law applied by humans but humans will always make the law imperfect. Turn away from your sins and repent. Jesus Christ came to give you freedom from the law and from sin; when he died and took your punishment on the cross for all sins of man. He came to give abundant life and set an example for us to follow so live in freedom, have compassion, love extravagantly. Jesus Christ is Lord.
