Taking the case and ruling on standing is still valuable. By taking the case they are saying this is an important concern. Rules on standing are done to prevent the Court from getting in the business of rendering advisory opinions. The Court is saying come back to us when you have a plaintiff with standing, someone who has actually been harmed in a measurable manner.

This one is complex, yes these tech companies are private. However, they still cannot violate the law. The law is clear on free speech. For example, private companies cannot own slaves because it is against the law. Either these media companies are publishers and therefore liable, or they are platforms that must not censor lawful speech.

Yes, these are private companies, but the issue that Rand is trying to address is that OUR GOVERNMENT coerced these companies to censor Americans free speech. The companies didn’t just decide on their own to censor because it violated their policies (which they have a right to do), they were threatened by the government with repercussions if they didn’t comply. This is not ok. Our country fought for our freedom against government tyranny and control and we should NEVER allow this to happen again.
