It is just a platformer. Download unity engine, download assets, put them on scene, use preprogrammed movements for basic platformer, download and use sounds from main game... didnt get where u see that studio :D But if he created all models in Blender for example, then nice one. Congratulations on the work, it's amazing. I advise making an animation for the character to slide on the pole at the end of the level. I also advise improving the death animations of enemies (Koopas) and making them knock down other enemies when thrown like in the original.

I can understand why some people were sued by nintendo if those fans replicated a game and tried to put it on market (for example: you would most likely would get sued by Nintendo for trying to make a 3d version of super Mario bros 3 for the computer.) And the reason why is simple, Nintendo doesn't want people profiting off of their own games, game stories, and stuff they produce. Also, you wouldn't want someone copying your characters in order to sell them. And you wouldn't want someone making the characters you put your heart and soul into look bad or act not the way they should act.
