This is really fascinating. I live in Norway, and we learned about the sex workers protection laws in high school (religion and ethics-class haha) . But the way they put it, it sounded so good and solid - that people can work within the industry without fearing police etc, meaning if something bad happens they have the law on their side and they can report it without fear of facing criminal charges themselves. Never realized how that also sort of promotes the police/law enforcement to take advantage of sex workers to use them to get to their clients... that is a big thing to leave out when asking us to debate that topic... just goes to show how easy it is to sell an idea when you're not given the full picture. And as that has never been a situation I've encountered, I've never had to look more into it either. So thank you for talking about the different forms of "legalized" sex work! Love your videos, been spending all night watching through your videos, and learn so much!

I was homeless for 5 years and the life is rough, I have friends who passed on and the police did nothing... Thank you for speaking for us, unfortunately women who have been involved in SW are not listened to by almost anyone.

That's the problem with FOSTA/SESTA, and a lot of other laws. None of the people who wrote them, nor the people who voted on them ever asked a single sex worker for their input. In fact the FOSTA/SESTA act was written by people who think that any and all sex workers of any sort are the victims of trafficking, and need to be saved from themselves. It's evangelical christian values made into a law that doesn't seek to protect anyone, but to punish those the authors perceive as "deviant" and disobedient.

My mom came to New York in the 80s from the Soviet Union, and she recalls that there were a lot of other young single women from Eastern Europe coming into the US at that time. Being that they were all poor immigrants, a lot of these women would stay in cheap crowded housing recommended to them by Slavs already established in NY, usually sleazy guys. It became very apparent very quickly to my mom that these convenient housing situations were pipelines to sex trafficking rings. My mom was lucky that she didn't fall into one of those scams that ask for your passport first before letting you move in, so she was able to get the hell out of there pretty easily once she realized something fishy was going on. But she didn't know what to do once she left, whether she should call the police, she still wasn't even fluent in English I imagine the guys who ran this thing were taking advantage of the messed up laws around sex work, because the way these things were set up the girls were made to think that they were "fairly" agreeing to be prostitutes to pay their rent, and not being trafficked like they actually were. I could also guess, based on similar accounts I've read, that they were threatened with being sent back to their home country if they told the police about what was going on because prostitution was illegal in the US after all. It's really depressing to think that rings like this are still going on. At the very least there's been more of a push over the past few years to bring the topic of sex trafficking, particularly in NY, to light and to offer more resources for women in these situations.

The new laws would just see these women imprisoned for selling their services. If prostitution were legal, they could file a complaint with the police that they were being abused. They would be the victims of fraud, forcible confinement, sexual assault, etc. Under the old laws and the new, they are themselves criminals and that is the problem.

I live in South Africa; although our legal systems are different the same sentiment towards sex workers exist. As a criminologist I understand the effect that criminalisation has on sex workers ability to access basic health services, the justice systems (when abused or harmed), financial service - by decriminalising sex work - you give a group of marginalised people full access to everyday life. I find it shocking that we still have these staunch, rigid and backwoods laws. The current laws even in South Africa keep those vulnerable in the dark with the monsters that prey on them.

WAIT the min stat 609.324 says “while acting as a prostitute” if you’re offered to be hired for prostitution you’re guilty of a misdemeanor? How do they decide what “acting as a prostitute” looks like? It seems that that specific wording can be problematic based off racist stereotypes and whatnot because I’m sure what “acting as a prostitute” constitutes as varies by race. I wonder if there are any studies. I’ll look into it.

There should be some regulations around sex work. For example, they should be required to test for STDs and should be punished if they give someone else an STD. If these kinds of things aren't made into law when sex work is made not illegal, then many people will not do the right thing.

Ok. Now, as far as I know, sex work is not legal, in the ENTIRE STATE OF NEVADA, ( which is what I heard you just say) but in some counties. Example: In Clark county, its illegal, so no legal boom, boom in Vegas, however, in neighboring Nye county it is, hence the bunny ranch and other " exotic?" lo-cals are located in the glorious town of Pahrump. ( I was born in Vegas, so I try and keep up with Nevada issues when I can.) :)

One of the things that never gets talked about is the vast majority of sex workers are forced into it by organized crime. These are not independent business women, they are usually young girls with very little education or resources that get violated. We had a high profile case of a "sex worker" who was advocating for 30 other sex workers. It turned out she was their pimp and she abused them and took all their money. She was not some courageous prostitute. She was a criminal. I think she is in jail now because she beat one of her women so badly she nearly killed the women. My ex was sold into prostitution to Asian organized crime. It was pretty bad. I grew up as a rich kid in the suburbs and went to a good university and then law school. I didn't even know about any of this and thought much like you do in this video. Talk to former sex workers who have gotten out of it. The ones in it are just saying whatever the people controlling them want them to say.

there's a difference between sex work and sex trafficking, and it's possible to legalize one without legalizing the other. forcing people into a job through organized crime will always be illegal whether or not there are unfair regulations on sex work.

@@cabbage-soup I can agree with the first part of your argument. I have no problem with consenting adults doing whatever they want. However the countries where sex work is legalized have a massive problem with what you call sex trafficking. I think it should be legal for people that are happy and safe in their sex work job to do so. I just don't think that is most of the people involved in this. I don't know what the solution is. It is not legalizing it, it is not criminalizing it. I just don't know. All the alternatives are bad. Maybe their needs to be a legal distinction between sex work and sex trafficking. Would having a license help? Strippers have to get a license. I as someone that practices law had to get a license. Maybe that would work? Maybe a professional Union? There are a number of allegations around Terri Jean Bedford that she forces women into sex work. She was one of the main proponents of having Canada's prostitution laws struck down. She threatened judges and lawyers. She runs several brothels. Do we want people like that in charge of a sensitive unregulated industry like sex work? I practice Law in Ontario. I would be happy to take and Employment complaint for any sex workers to help them out, but those of us in the law are not sure if they are even covered. Perhaps the framework is already there for people being abused in their sex work jobs like any other jobs. Those of us that practice law just don't know.

@@bgb9822 it's difficult to regulate a market that is entirely illegal. legalizing sex work won't eliminate sex trafficking, but clients and sex workers alike may find it easier to report and stop instances of sex trafficking or forced sex work if sex work wasn't criminalized.

@@bgb9822 im not a lawyer, but from what i've heard as a canadian, i think canada operates under the nordic model. As a result, the selling sex work itself is legal, but it is illegal to buy sex work, and so i imagine it'd be alright to represent sex workers. i think anyone who forces people into any profession is absolutely despicable. but that doesn't mean sex work should be illegal. to take a comparison: people are sometimes forced into farm labour under unfair conditions, but farming should not be illegal altogether.
