I have some tics with my OCD, and for some reason they get triggered really bad when I hear other people's tics! (It doesn't come up often, but when I used to go to church, one of the other members had vocal tics and I'd always have to do my own in response... Mine are silent so I'm sure she never knew tho.) Don't approach a witness or hand something to a judge without asking first. If they're friendly, let them set the boundaries but follow them. Excellent advice all around. Especially breaking down the other side's momentum should they ever build some up.

I object to something that wasn't really the point of what you were talking about. I have Tourette Syndrome. I just wanted to snipe the whole "I can't control it" thing. I actually kind of like what he said here. I really like that he clarified "not for any length of time". Most people think Tourette's is straight-up uncontrollable, but that's not strictly accurate. I can only speak from my experience. I'm sure there are other people who have a stronger case than mine, but I found that I can actually control it. It's not like a muscle spasm like you might get when your muscles are cramping. It's more like you just get these really strong urges to move or vocalize in a certain way. If you focus in on resisting those urges, you can actually succeed in suppressing them. You can't necessarily do anything to make the urges go away, but you can learn to resist indulging the urge. But that's why it's really great that he clarified "not for any length of time," because the difficulty with resisting the urges is that it can take a lot of focus and attention. For some people with really strong urges, that requires a level of concentration that precludes all other activities. It's simply not possible to function as a human being while maintaining that level of concentration for any length of time. Having Tourette's basically means that you have to feel out every new situation, every new professional/social context. You have to do a sort of cost/benefit analysis and think about what the allowable tolerance is for your ticks in the current situation and figure out how to function. It can be really hard, especially for young kids, especially in new situations. That's why it's great to have people in your life who understand what you're going through and give you the freedom not to control it. For myself, I've been able to find a sweet spot where, in most situations, I can suppress my ticks to a point where I seem mostly normal. It probably helps that I work from home, lol. But I know there are others where the need to function in a given situation takes too much attention away from controlling their ticks that they simply can't do both. In that case, "I can't control it" is probably a fine short-hand, but what it really means is, "Yeah, I can control it, but it's not worth it right now." Expecting people with Tourette's to completely restrain their ticks around you (if you're aware of their condition) is basically telling them you want them to make your desires the center of their attention and they must completely shut everything else down so as not to bother you. Edit: I posted this immediately following the comment "I can't control it, not for any length of time." I then went on to watch what came after. Just wanted to note that his case is an extreme example. Not everyone swears like that. Some people swear. Some just make rapid movements. For me, it was my arms. Regarding the drugs, I can't speak to that. They wanted to put me on Ritalin when they first diagnosed me. I think my parents declined because I don't remember taking a lot of drugs. Looking back, Ritalin was a really bad script. It's been known to cause Tourette's. I don't know of any of the drugs the other attorney mentioned. I've no experience with them, so I can't comment. By God's grace, I was able to learn to cope with my condition without the use of drugs, and the primary thing that helped was people who supported me instead of making me feel like I was somehow wrong to be struggling with this.

As someone with tourette's myself, I would like to make it known how incredibly rare it is for your tick to be actual words. Mine are almost entirely physical. I did know a girl who whooped though. I am very glad, however, that his verbal tick is not the ill-informed, unfunny stereotype of swearing. (Edit: I commented that before he said the N word... and bitch...) (Edit: The only medicine that has ever helped has been marijuana. Nothing the neurologists prescribed really did anything. One helped, but very quickly needed very large increases in dose and became an unviable option almost immediately.)

R Nickerson I dated a woman in her early 30’s quite a few years back. She also would take a puff now and then for the same reasons. Obviously since she had it she would also pour a glass of wine on the weekends and smoke more then the odd puff. Her condition manifest with flailing hands especially when she got excited. So the pot kinda damped her down. I never smoked any myself because I am simply not interested and never have been. I’ve seen more then a few people abuse this simple drug, and it has a habit of taking away motivation. However in her case the opposite was true. She would take risks and go out in public instead of being a weird shut-in. More research is needed. Also congratulations on it working for you. But even vitamins can be dangerous so caution is always needed.

Law & Order is the definition of the procedural genre. So much so that you can swap out all of the main characters with no effect to the drama. As I got older I began to see more of the artistic liberties they take, but dang if the show didn't, at least, put me into an analytical mindset whenever I watched it. The investigation, the prosecution, *dun dun* there's the formula. I ate it all up. It never got old. I really enjoy this stuff. Thanks.

The reason they enter the well in most movies/ series is for visual storytelling. The attorney getting visibly closer to the witness is a narrative device to strenghten the feeling of the connection between characters, the plot "thickening" and also creates tension. It allows to shoot the conversation in closeup composition (face clearly visible) and allows to show emotions and intensity.

@Neri Matrixx Depends what jurisdiction you are in, maybe you would get away with this in the US where it seems there is a far more expansive risk of excuses to get rid of jurors simply because one side feels it is in their advantage to do so. Probably not in the UK though as to challenge a juror for cause in the UK the burden of proof is on the challenging party to show evidence of bias on the part of the juror, allowing exclusions on the basis of profession or similar attributes opens the door for jury stacking a practice which while seemingly common in the US is frowned upon still in the UK.

Hmmm... I like you man. You bought yourself a sub today. :) More videos of this nature would be awesome! I watch a TON of Law and Ordrer; SVU & CI, so i'm loving this show format. Oh, and one thing that's ALWAYS bothered me... In SVU, lawyers (defense attorneys in particular) tend to ask an inflammatory question, or doesn't ask anything and flat out makes a statement. Immediately the ADA (prosecutor) makes an objection, to which the defense just says "Withdrawn." before the judge can rule on the objection. Then, that exact same scenario will play out over and over and over... at some points, not even giving enough time for an objection to be made before saying "Withdrawn" again..I've always found that to be really unrealistic.. as I'd imagine a Judge would have very little tolerance for that sort of legal nonsense, and shenanigans in the court room.. *Am I wrong?*

I recently had the pleasure of watching Shark, with James Woods. I have not practiced yet (still in school), but I can say that the trial skills are accurate. I still think James Woods is the best actor to play a trial lawyer, True Believer doesn't get enough attention and neither did Shark. Anyway, it's worth a look!

Wanna go Hard Mode? Try the Phoenix Wright animé. It's ridiculous, it's bizarre, and the legal accuracy boils down to Scooby-Doo logic. But even with all that, it's incredibly fun to follow the over-the-top ideas and craziness! It doesn't hold a candle to the actual games, but reacting to those would prove a bit more difficult.

I think the conviction rate in Japan is about 98-99% Basically, they either don't even bother unless they know they can get a conviction...or they keep on trying a case *until* they get a conviction.

A courtroom trial is like a game of chess. Your success of your middle game is largely dependent on your opening move. King's Gambit, Queen's Gambit, King's indian, Sicillian, etc, etc. White on the board has a move upper hand because according to chess, white moves first. How you play your middle game will determine the success of your endgame. Thinking your moves or turns ahead, or possible move scenarios on the board is a very big key to your game success. That's the courtroom in a nutshell. I've always loved courtroom drama. It makes for great thought processing.

In the first scene from suits, Harvey couldn't have objected on the grounds of speculation/hearsay since the whole reason Mike got kicked out was to save Trevor's ass. So Trevor not only knows it first hand, he's the very reason it happened in the first place. And Mike and Harvey know that.

Just found your channel and I'm enjoying it immensely. I'm a court clerk for juvenile court myself, and it's extremely interesting to listen to this. Personally never heard of the term "well of the court." In our court that is basically where the attorney questions the witness. Behind a podium in the well of the court. I don't think they can touch the witness stand becauseno attorney ever does but they do walk around in the well especially the SAAGs. We are also more informal though as attorneys often pass exhibits directly to our judge I think because our courtroom is smaller. Ironically, our judge gets more upset when the clerk beside him is directly approached or handed things. If anyone wants to hand the clerk paperwork they have to hand it to him and he hands it to us or give it to the bailiff.

as a person with tourettes i relate so hard to this. We have to jump through hoops and legalities because society is not kind to people with disabilities. And working in an office unfortunately would be hell for me. honestly doing any job is hard. people don't realize how physical tourettes is. its a neurological condition and it can be painful. ive ended up in the er because of tics. If our country gave people who needed to be on disability a living wage, I would for sure take it. But it's damned if i work and damned if i don't. and i can't afford to be on disability. medication is expensive and without it I'd probably kill myself. i need it to survive. so I have to endure work which can be torture. and ive develope migranes and stomach issues from the stress. my sympathetic nervous system is breaking down because im in a constant state of stress. ill probably die relatively young. it's a shame that our capitalism has turned into an oligarchy. everyone deserves to live in basic decency and dignity and not have to kill themselves to do it. Hopefully one day that will change and people like me will be more protected and taken by the law. we didn't choose this life but we have to endure the punishment for being born different in a world that inherently fears and ostracises us

I was an La Law junkie. I remember this episode well . Also a big fan of Law and Order. This was one of two episodes in which Kathleen Turner appeared as a defense attorney. In fact several well know actors and actresses appeared on Law and Order.

I believe they have to recuse themselves and are under obligation to inform any court they participate in of their status as an attorney. I remember my brother talking about that when he was preparing for the bar, but I could be wrong. Would love to hear more about the ethical responsibilities and expectations of legal professionals.

Here in Canada lawyers and judges (a long with some other professions) are disqualified from jury duty. I remember my professor said that in the States lawyers are usually not disqualified from jury duty. However, during the selection process the lawyers for the parties will petition to have them not selected or removed.

I’m not an attorney- but I’m a Guardian Ad Litem/CASA for kids in foster care, so I’m in court pretty frequently. Here’s my thing- real judges don’t ever use a gavel. I’ve NEVER once seen a judge use one. I think they’re so cool, and I’d use mine all the freaking time! Another thing I’ve noticed on the TV shows is that an attorney makes an objection, and everybody just keeps talking before the Judge rules on it. Yeah, that doesn’t happen- I’ve seen an attorney do that, it wasn’t pretty.

HILIOLI! It is actually based almost perfectly on Japanese court. The courtroom layout, trial by judge, guilty unil proven innocent, surprise witnesses and evidence and what ever else an individual judge is cool with, the three day trial, the only thing completely made up is the ten year old girl occasionally turning into her busty dead sister.

I did a quick research and found an article which said that the Japanese criminal justice system was more or less copied from the German system in 1908 and is still pretty similar. In the German legal system, you are innocent until proven guilty. The article I found didn't mention anything else. I'd love to learn more about this.

I think OP is referring to the fact that Japan has an exceedingly high conviction rate (99% or so), which basically translates to if you get caught, you get punished. And a lot of the time is based on criminal confessions, which are the result of different police procedures than in the US. But the guilty until proven innocent isn't right, even if only technically.

Wow, I didn't know that their conviction rate is that high. But this doesn't have to mean that you get punished if you get caught. It only means that once you get indicted, you get punished. In fact, there's a paper by Ramseyer & Rasmusen indicating that Japanese prosecuters only try rock solid cases due to their low budget which Ramseyer & Rasmusen consider the more probable reason for the Japanese conviction rate. Of course, that's only a theory, it might as well be that Japanese judges just consider you guilty once you're indicted. There seems to be no real proof. The paper can be found as a link on the Wikipedia page "Criminal justice system of Japan" (reference 9).

I like the explanation of 'indemnity'. I'm a translator and often have to proofread other legal translators' work. "Indemniser" (in French) means 'to compensate' (in a general sense, there don't have to be three parties involved) - but often translators will translate it as "indemnify", which usually makes no sense whatsoever in the context.... Thanks, more evidence for when I next make this change !
