@@baboytablo5735 Dollar value isn’t really relevant; a lawsuit is frivolous if the claim has no basis in fact or law. In your example, if the plaintiff was legitimately entitled to that $15 (or had a basis to believe he was owed it), the suit wasn’t frivolous.

And why not go to a physician and have soft tissue damage confirmed, they wouldn't necessarily do any diagnostics, and he could always refuse to have testing done if they suggested it. while soft tissue damage is hard to prove, if you go to a doctor with it, especially following a car accident they will do something for it such as a brace, possibly an RX and suggestions on how to help it heal as well as scheduling a follow up in a couple of weeks ... been there done that, it wasn't that expensive and it was well worth it, the brace alone made life bearable while it healed and I could move and sleep.

My husband got into an accident with a lady he backed up into her going maybe 2 miles an hour. We called the police like you ALWAYS should and police marked her damage on the report. Fast forward our insurance investigator called cause of course they were trying to sue for hella money, pain etc. problem is they reported 1.that a man was driving , 2.her windshield was broken..all bs I told our investigator that and after checking she found out that a couple days later the lady driver had another accident and they thought they were trying to claim damage and injuries from the second accident on us not to mention they lied to insurance about who was driving. Always call the police and always follow up. They were trying to sue us for 20k on LIES!

As someone WITH a fractured back, I think (besides the ridiculous no-sleep-so-money-case itself) the plaintiff is crazy to NOT have an x-ray made of his back when the pain is so bad he (allegedly) couldn’t sleep because of that pain! You usually are STILL ABLE TO WALK even with broken vertebrae! And it can absolutely lead to a spinal cord lesion, so who risks that?! Added: I myself haven’t had a decent night sleep since over 2 years because of my fractured spine (including undergoing 3 high risk surgeries and by now having a truckload of metal inserted in my back) so I recognize the need for good sleeping (and the effect of not getting that) and if I could get the guarantee that I will be able to sleep well from now on to forever, I would pay plenty for that! Heck: I would sell my second born for it!! …..Luckily I have only one kid… I might actually sell my house for it! ….which is speculation at the moment, since I am renting right now 😉. (But I guess you’ll still get a sense of the urgency for good sleeping by these examples) What IS TRUE THOUGH, and I’m NOT kidding here: I know the near DESPERATION when you just CAN NOT sleep! My max is, unfortunately, 4 days + 3 nights in a row and STILL I needed heavy sleep medication to finally get some sleep!! It can make you go absolute CRAZY and VERY ILL!! All because of the intense, never ending PAIN that my back still (even into present day) gives, although the latest x-rays/CT-scan showed that all the fractures and all the screws and pins seem to FINALLY start growing together and thus finally starting to heal…* So there IS HOPE that someday the pain will get less…. Fingers crossed 🤞 * Explanation for who is interested: A Staphylococcus bacteria in my spine had stopped the growth of bone tissue all together, so after the first 2 surgeries the whole thing (spine plus titanium construction) broke AGAIN and that’s why I had to have a third surgery and start all over again…. But THEN they found that bacteria and treated it, so that is why hopefully the result will be much more positive this time around. My surgeon has informed me though that if it would brake again, I am out of options or luck, since he has already used EVERY available spot in my back to connect the 6 long metal pins (they are placed from T10** all the way down to the very last vertebrae, so these pins are about 15-20 inches long!!), with the use of about 26-30 metal screws (varying from 1.5 to even more than 3 inches, attaching 2 of those huge screws into both my hipbones in order to stabilize the construction (because that was the last option he could connect them to, since the rest of the bone tissue is too damaged) ** is the name of the vertebrae, that is about at the height of where your chest muscles are SO TAKE THE FREAKIN’ X-RAYS!!!!! Nobody wants this!!

The Plaintiff settled with the Insurance company, if it wasnt an amount he wanted he should have not taken the offer...I myself was rear ended and went to court...the defendant in my case took his eyes of the road...He hit me at 50 mph...I went to the drs and all...even went to PT...i have to live with pain ever since that accident caused....that was 1991...i was parked to make a legal VT turn around....my pelvic bone fractured in the accident...my seat belt didnt lock so i have a lump on my skull from the steering wheel...I got a settlement for everything....even lost wages....gas to the PT appts...etc...He just wasted the judges time with this case cause he settled too fast with the INS....

I can see not wanting to add medical bills into the equation but if he really did have substantial back pain and sought medical care the defendant's insurance company would have paid the medical bills and most likely offered a bigger settlement. Even if the medical report said there was no obvious injury it would still serve as record of him saying he was in pain. As it stands they made him a small offer that was probably just a good will gesture more than anything but knew he had no proof so of course they're not going to pay more.

so let me get this right - he lost the use of his truck for 3 months, but he was able to pull his trailer behind his station wagon to "carry on" doing whatever it is he does that requires a truck or a car and trailer, but his back hurts so bad he can't sleep. Now I know I'm making assumptions here, but I've yet to know anyone personally who needed a truck or a car with trailer to work that wasn't involved in some sort of labor type work - so he was able to continue his job, but can't sleep because his back hurt. Another assumption here, but my guess is his next stop is applying for SS disability. This guy just wants someone else to carry the load so that he can ... stay in nice hotels, like the one he's sitting in now.
